Invitation to Proponents

This Request for Proposals ("RFP") is an invitation to prospective Proponents to submit Proposals for the provision of Services in relation to the Ontario’s Mandatory Remedial Measures Program, as further described in Part 2 - The Deliverables (the “Deliverables"). This RFP is issued by Her Majesty the Queen in right of Ontario as represented by the Minister of Transportation for the Province of Ontario (the “Minister").

Type of Contract For Deliverables
The selected Proponent will be required to enter into an agreement with the Ministry for the provision of the Deliverables in the form attached as Appendix A to this RFP. It is the Ministry’s intention to enter into the Form of Agreement attached as Appendix A to this RFP with only one (1) legal entity. The term of the agreement would be for a period of five (5) years with an option in favour of the Ministry to extend the agreement, on the same terms and conditions, twice for a period of one (1) year each time. For greater clarity, the Ministry would only exercise its option to extend the agreement twice, i.e., for a maximum of three (3) terms over seven (7) consecutive years. It is anticipated that the agreement would be executed on or around October 1, 2008. A Proponent who submits conditions, options, variations or contingent statements to the terms set out in the Form of Agreement, either as part of its Proposal or after receiving notice of selection, may be disqualified.

Background
Under Ontario’s Mandatory Remedial Measures Program that has been in place for about ten years, individuals who have been convicted of a drinking and driving offence (including those convicted of failure or refusal to provide a sample) under the Criminal Code are required to serve their full mandatory driver’s licence suspension period and participate in the Program which includes an assessment, education or treatment, and follow-up before their Ontario driver’s licence is eligible for reinstatement. The Convicted Offenders who do not complete the Program as required remain suspended. For further information please refer to www.mto.gov.on.ca/english/safety/impaired.

Objective of the RFP/Service
Beginning October 1, 2008, the selected Proponent will be responsible for offering the Program for Convicted Offenders. The Program consists of the following Components:

·    Assessment;
·    Education or treatment; and,
·    Follow-up

Starting as early as November 30, 2008, the selected Proponent may also be responsible for delivering the Program for drivers found to have a BAC in the Warn Range two or more times in a five (5) year period. The Programs would include an education Program for drivers who have had two instances of driving in the Warn Range in a five (5) year period, and a treatment Program for those who have had three or more instances in a five (5) year period. For these drivers, it is likely that neither an assessment nor a follow-up will be required to complete the Program requirement.

The Proponent must demonstrate an understanding of the Program and the Services to be provided and must describe the approach it will take to meet the Ministry’s requirements.
