SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Rhondda Cynon
Taff, Merthyr Tydfil, Cardiff and the Vale of Glamorgan Local Health
Boards, are inviting established and experienced organisations to express
their interest in the provision of an Independent Mental Health Advocacy
Service IMHAS, under the statutory obligations of the new Mental Health
Act 2007. The service will be available to people who are:
1. Detained or liable to be detained under the 1983 Mental Health Act.
2. Subject to guardianship under the Act.
3. Community Patients subject to community treatment orders.
4. Conditionally discharges.
5. Being considered for section 57 or 58A treatments, but are not
otherwise subject to the Act (i.e. an "informal patient").
The contract will operate from 3.11.2008 and will initially be for a
period of 3 years, but subject to satisfactory performance and outcome
reviews, the contract may be extended for a further 2 periods each of
1-year duration.
This new service will be hosted by Rhondda Cynon Taff Local Health Board,
and will service the local authority areas as indicated above.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The authority will incorporate a minimum 10-calendar-day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the Trust(s) before the final contract is
entered into. Bidders have 2 working days from the notification of award
decision to request additional debriefing and that information has to be
provided a minimum of 3 working days before the expiry of the standstill
period. Such additional information should be requested from the
Procurement Services Department, North Glamorgan NHS Trust, UK-Merthyr
Tydfil CF47 0SB. If an appeal regarding the award of a contract has not
been successfully resolved the Public Contracts Regulations 2006 (SI 2006
No 5)/provide for aggrieved parties who have been harmed or are at risk of
hard by a breach of the rules to take action in the High Court. (England,
Wales and Northern Ireland). Any such action must be brought promptly
(generally within 3 months). Where a contract has not been entered into
the Court may order the setting aside of the award decision or order the
authority to amend any document and may award damages. If the contract has
been entered into the Court may only award damages.
