SECTION VI: COMPLEMENTARY INFORMATION
VI.1) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY
COMMUNITY FUNDS: No.
VI.2) ADDITIONAL INFORMATION: The total final value of the Infraco
contract is 256 232 336 GBP as detailed in point II.2.1. This comprises
221 832 336 GBP infrastructure installation value plus a 1 800 000 GBP
maintenance mobilisation payment at service commencement and 32 600 000
GBP in total over a period of 10 years infrastructure maintenance with a
break option after 3 years.
VI.3) PROCEDURES FOR APPEAL:
VI.3.1) Body responsible for appeal procedures: See VI.3.2.
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Tie Limited communicated the intention to award the
contract to unsuccessful tenderers, the minimum 10-calendar-day standstill
period then elapsed prior to contract signature. This period allowed
unsuccessful economic operators to seek further debreifing from tie
Limited before the contract was entered into. If an appeal regarding the
award of contracts has not been successfully resolved, the Public
Contracts (Scotland) Regulations 2006 (SSI 2006 No 1) provide for
aggreived parties who have been harmed or are at the risk of harm by any
infraction, to take action in the Sheriff Court or Court of Session.
