Eligibility of Bidders:   (a) The Technical Proposal shall be submitted, giving a detailed comprehensive technical proposal in accordance with the terms of reference attached, sealed in a first inner envelope marked “Technical Proposal RFP № 08-162 on the envelope. The formats and contents of the technical information to be supplied are in SECTION VI, Technical and Financial Forms.

(b) Alternative experts shall not be proposed, and only one curriculum vitae (CV) may be submitted for each position.

(c) Disqualification of expert:
Zero rating resulting in disqualification will be given to a nominated expert if the expert:
• is proposed for a national position but is not a citizen of that country; or
• failed to state citizenship on the CV; or
• the CV is not signed or
• is a current employee of the MRC; or
• has failed to disclose any situation of actual or potential conflict in terms of para. II-01.2

The Financial Proposal shall be sealed in a second inner envelope marked “Financial Proposal RFP № 08-162 on the envelope. The formats and contents of the financial information to be supplied are in SECTION 6, Technical and Financial Forms. The Proposal shall be quoted in US Dollars only, other currencies will not be accepted. The envelopes shall be addressed to the Mekong River Commission at the address as stated in Section I and shall be marked clearly with (Project Name, IFB Number) and the words “DO NOT OPEN BEFORE 4:00 PM ON 20 AUGUST 2008”.
(d) The inner and outer envelope shall indicate the name and address of the Consultant.
(e) If the outer envelope is not sealed and marked as required, the Mekong River Commission will assume no responsibility for the Proposal’s misplacement or premature opening.
(f) Modifications of the Proposal already submitted will be considered only by a letter signed by the same person who signed the Proposal and only if received at the Mekong Secretariat prior to or at the time fixed for the receipt of Proposals.
(g) The Proposal must be signed by a person duly authorized to do so. A Proposal submitted by a corporation must bear the seal of the corporation and attested by its president and secretary.
(h) The Employer assumes no obligation or responsibility whatsoever to compensate or indemnify the Consultant for any expense or loss which may be incurred in the preparation of the Consultant’s proposals, nor is the Employer obliged to give any reason and/or explanation for the rejection or acceptance of any Proposal.
(i) Verbal statements made by the Consultant at any time regarding the Proposals will not be considered.
(j) The sample contract, as attached, shall become the valid contract unless the Consultants propose appropriate modifications which will be evaluated as such. Possible modifications should be stated separately from the sample contract and will be attached to the technical proposal.
(k) The Consultant may be subject to local taxes (such as: value added or sales tax, social charges or income tax on non resident Foreign personnel, duties, fees levies). If the Consultant is subject to payment of any local taxes, it shall be the responsibility of the Consultant and no such amounts shall be included in the Financial Proposal. Based upon The Agreement between MRC and the Government of Lao PDR relating to the Headquarters of the MRC (“The Headquarters Agreement”), the MRC enjoys pursuant to section 16 and 17 privileges and immunities regarding tax. Provision of Consultancy and Technical Services
for
Condition Survey of Dangerous Areas for Navigation
between Houei Sai and Luang Prabang

The Mekong River Commission Secretariat (Hereinafter “the Employer”) hereby invites sealed Proposals from eligible Consultants for the consultancy and technical services for the project called “Condition Survey of Dangerous Areas for Navigation (Dangerous areas) between Houei Sai and Luang Prabang” in accordance with the terms and conditions mentioned in the Request for Proposal.

The project is financed by the Government of Belgium through the Navigation Programme of the Mekong River Commission.

This Request for Proposal (RFP) includes the following documents:
Section I - Invitation for Proposals
Section II - Instructions to Consultants
Section III - General Conditions
Section IV - Forms of Contract
Section V - Terms of Reference
Section VI - Technical and Financial Forms

The Proposal shall be submitted in a global envelope containing two separate sealed envelopes, one for a technical proposal and the other for a financial proposal. The financial proposal shall be in the required format and in an envelope clearly marked “Financial Proposal” on the envelope. The selection will be based upon consideration of both Quality and Cost.

Deadline for submission of the proposal is 20 August 2008 at or before 16:00, Lao time

Any additional information required in the preparation of the Proposal may be obtained by interested bidders at their own expense through consultation with the Mekong River Commission Secretariat (Vientiane) not later than 06 August 2008.
