SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-Swindon: community services.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Swindon Borough
Council is seeking expressions of interest from suitably qualified,
experienced organisations wishing to tender for the provision of seven
contracts supporting Community Services in the following areas:
1. Advice Services.
It is recognised that intervention and support given to local people in
relation to advice services has a direct impact on the mitigation of
future demands on Council services (e.g. homelessness, rent arrears,
poverty, ill health) and multiple issues can often be resolved through a
single agency. Current 3 year grant funding covers Debt, Welfare Benefits,
Housing and Immigration advice services with over 12 000 cases a year.
There will be one contract to provide a generic advice service including
debt, welfare benefits eligibility, housing, immigration and employment
issues. Contractors will be required to provide an accessible service in
central Swindon and an outreach service in other parts of Swindon.
2. Priorities for support for victims of Domestic Violence.
Requirements are for a 24-hour refuge open for 365 days a year and a
24-hour helpline also operating 365 days a year. In addition to this the
refuge will need to provide an outreach service for former residents. This
is being tendered as one contract.
A second contract is for the provision of outreach services for victims of
Domestic Violence who have not been residents of the Refuge.
3. Signposting and Advice for Asylum Seekers, Refugees and Migrant
Workers.
Swindon is a reception area for asylum seekers and refugees. Continued
support is required in accessing services and learning about how to settle
in Swindon. It is difficult to identify the total numbers in Swindon,
however, there are some broad indicators:
— Borders and Immigration Agency Identify 151 (plus their family members)
in Swindon in June 2007,
— The Harbour Project, which provides a drop in facility for support and
signposting to asylum seekers, has about 350 visits a month. It is open 60
hours a month dependent on volunteer availability.
The Council's responsibilities include approximately 100 refugee children
in schools and 20 pre-school children.
Requirements are as follows:
— Signposting and advice on accommodation, tenancy rights and
responsibilities,
— Signposting and advice on employment, rates of pay, health and safety
issues, discrimination and harassment,
— Signposting to services and local facilities.
There will be one contract to work with the Council and other agencies to
provide signposting and advice.
4. Support for the wider Third Sector.
This is defined as services to support the wider third sector or
particularly those smaller groups who receive no direct support from the
Council and rely on volunteers.
There will be three contracts summarised as follows:
— To provide information about developments, opportunities and
requirements to the widest possible number of third sector organisations
and to ensure that the views of the organisations are made known to the
Council and other bodies local, regional and national,
— To provide bespoke advice on specialist areas eg Health and Safety,
organisation development, new partnerships, income generation etc to
smaller third sector groups using where possible existing skills and
experience from within the sector,
— Support volunteering by working with individuals and organisations to
increase the numbers and skills of volunteers.
All contracts will be for a period of 2 years with an option to extend for
a further one year, subject to satisfactory performance and availability
of funding. This is a competitive tender, and a contract will be awarded
to the organisation that is deemed to represent the most economical and
advantageous tender.

II.2.1) Total quantity or scope: The figures quoted below are per annum
figures.

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A performance bond will be
required for the full contract sum.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Payment shall be
based on monthly consolidated billing for each entity utilising the
framework agreement.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (a) is
bankrupt or is being wound up, where his affairs are being administered by
the court, where he has entered into an arrangement with creditors, where
he has suspended business activities or is in any analogous situation
arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata
in accordance with the legal provisions of the country of any offence
concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26.5.1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of
the use of the financial system for the purpose of money laundering.
