An ACAN allows departments and agencies to post a notice, for no
less than 15 calendar days, indicating to the supplier community
that it intends to award a good, service or construction
contract to a pre-identified contractor. If no other supplier
submits, on or before the closing date, a Statement of
Capabilities that meets the requirements set out in the ACAN,
the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the
requirements set out in the ACAN, then the contracting officer
will proceed to a full tendering process.

Requirement:
The Canada Border Services Agency (CBSA), has an on-going
requirement for the provision of Air Time for the trunked radio
communications system for use by border officers in the Niagara
Falls/ Fort Erie area as well as corrective maintenance on
as-required basis for an estimated 756 units on a monthly basis.
The initial contract will be for a period of one (1) year to
begin August 1st, 2008 with options to extend for two (2)
additional periods of one (1) year each.

Limited Tendering Justification:
These types of services are regulated by the Industry Canada and
the Technical Sole Source justification from the Canada Border
Services Agency (CBSA) indicates that the CBSA (formerly part
of the Canada Customs and Revenue Agency) originally acquired
services for airtime and warranty repairs from Maxtel Wireless
through a competitive process seven years ago.
The initial procurement was pursued consistent with the
requirements of the relative trade agreements. These services
are critical to the health and safety of the Border Services
Officers (BSOs).

The service provided by the third-party MPT1327 Network is
specially modified for the CBSA to incorporate instant alarm
signaling and reporting in support of safety and health of the
BSOs.
To be able to use this third-party radio network, the CBSA had
to purchase, also through a competitive process, its own radios
for use on the system. The value of this hardware component is
approximately $1.0M.

The CBSA cannot entertain other third-party radio networks that
cover the same vast geographic area required because none exist.
The CBSA would have to install its own infrastructure as well as
user equipment, the cost of which would be prohibitive.

A change in supplier would result in the CBSA incurring
significant incremental costs to:
·    Replace all existing infrastructure (currently using a
third-party MPT1327 network protocol with custom modification
for instant alarm capability) including antennas, feedlines,
tower site leases and frequency approvals from Industry Canada
that cover the Niagara-Fort Erie region
·    Purchase and install new mobile, desk-top, portable and alarm
signaling gear
·    Retrain personnel on the operation of a different radio system

This requirement is subject to limited tendering provisions
contained in the Agreement on Internal Trade (AIT); Article 506,
paragraph 12, subparagraphs (a) for reasons of compatibility
with existing supplies, services and installations as well as to
maintain a specialized product.

Contract Period:
The Contract period shall be from August 1st, 2008 to July 31st,
2009 with 2 irrevocable options of 1 year each.

Statement of Capabilities:
Suppliers who consider themselves fully qualified and available
to provide the services described herein, may submit a statement
of capabilities in writing to the contact person identified in
this Notice on or before the closing date of this Notice. The
statement of capabilities must clearly demonstrate how the
supplier meets the advertised requirements.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
