Contract specifications
6. Type of contract: Technical assistance contract with externalised
direct labour operations.
7. Contract description: The tenderer, on behalf of the awarding
authority (Delegation of the European Commission in Dakar), will be
responsible for the operational, contract, administrative and financial
management of the programme to improve sub-regional cooperation for the
monitoring, inspection and overseeing of fishing activities in the area of
the Sub-Regional Fisheries Commission (SRFC). The tenderer must devise a
methodology and propose all staff and equipment for the programme
management unit, which will be the technical body implementing and
monitoring the aforementioned programme.
The PMU will be the beneficiary of a service contract signed by the
Delegation of the European Commission in Dakar. Staff assigned with
carrying out payment authorisation (managers) and payment (accountants)
tasks will be determined by the service contract with the PMU. Therefore,
they must be duly empowered by the PMU to sign and execute on its behalf
all contractual documents.
8. Number and titles of lots: 1 lot only.
9. Maximum budget available: EUR 1 500 000.
10. Object of additional services: Not applicable.
Conditions for participation
11. Eligibility: Participation in contract procedures is open on equal
terms to natural persons and legal entities (irrespective of whether they
are taking part as individuals or as part of a grouping (consortium) of
tenderers) from the ACP countries and the Member States of the European
Union who contribute to the European Development Fund, and also to
international organisations as authorised by the instruments applicable to
the programme under which the contract is financed (see also point 30).
The nationality rule also applies to experts put forward by service
provider companies.
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, this will result in the application concerned being
automatically disqualified (in particular, the application from the whole
consortium where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Candidates invited to tender may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions.
16. Subcontracting: Not applicable.
17. Number of candidates invited to tender: A minimum of 4 and a maximum
of 8 candidates will be invited to submit detailed tenders for this
contract, depending on the applications received.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 8/2008.
19. Provisional start date for the contract: Between 12/2008 and 1/2009.
20. Initial contract length, and possible extension: The permanent team
will provide services during a 36-month scheduled phase.
Nevertheless, the services must be completed before 31.12.2011.
Selection and award criteria
21. Selection criteria: The selection criteria must be clear and
non-discriminatory, and may not extend beyond the scope of the contract.
The documentary proof to be requested for the various selection criteria
must be taken into account. See section 2.4.12 of the Practical Guide to
contract procedures for EC external actions.
The following selection criteria will be applied to candidates. Where
applications are submitted by a consortium, then the criteria will apply
to the consortium as a whole.
(1) Candidates' economic and financial capacity (based on point 3 of the
application form).
Candidates must be able to prove that they have been trading for at least
3 years (this applies to all the members of a consortium). The following
documents must be submitted in support of the figures given in the
application form (consortia must provide these documents for all their
members):
(a) balance sheets for the past 3 financial years for which accounts have
been closed;
(b) statement as to overall turnover, and turnover for the services
referred to in the contract, realised over the past 3 financial years.
Candidates' average annual turnover (or consolidated turnover figures for
a consortium) must have been in excess of the maximum contract value (EUR
1 500 000).
(2) Candidates' professional capacity (based on points 4 and 5 of the
application form).
At least 30 % of all the permanent staff employed by candidates (or staff
employed by at least 1 of the candidate members in a consortium) must have
experience of work in fields connected with this contract.
Specialist fields (i.e. the type of services provided) considered relevant
to this contract are:
— project implementation as main operator,
— technical assistance and consultancy services for carrying out technical
studies,
— building up and strengthening institutional capacities and coordination
of state institutions with a view to monitoring, inspecting and overseeing
fishing activities,
— human resources development,
— setting up procedures and conditions to ensure the sustainability and
financial responsibility of work to monitor, inspect and oversee fishing
activities.
A presentation of the company's experience in general will act as the
basis for checking information provided in the application form.
(3) Candidates' technical capacity (based on points 5 and 6 of the
application form).
Candidates (or at least 1 candidate member in a consortium) must have
worked on at least 2 major projects (with a similar or higher contract
value than in this contract) in fields connected with this contract during
the past 5 years.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. Such
bodies, e.g. economic operators' parent companies, must observe the same
eligibility rules, notably regarding nationality, as the economic
operators themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
applications will need to be re-examined to determine which 8 applications
for the invitation to tender are the most suitable. Only the following
factor will be considered in the re-examination: qualifications of the
permanent experts and their staff.
22. Award criteria: Economically most advantageous tender. The criteria
are specified in the invitation to tender dossier appended to the letter
of invitation to tender which will be sent to shortlisted candidates.
Application submission procedures
23. Final date for receipt of applications: 23.7.2008 (17:00), local time
in Senegal.
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:

index_fr.htm. The clauses and format of this form must be strictly adhered
to.
Any application which fails to comply with these provisions will be
automatically rejected. Additional documentation (brochure, letter, etc.)
enclosed with the application will not be considered.
25. Procedures for dispatch of applications: Applications must be drawn
up in French and sent solely to the contracting authority at the following
address:
— by registered post (official postal service),
— by bearer (express courier services in particular) with the application
being delivered direct to the contracting authority, against issue of a
signed and dated acknowledgement of receipt,

The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the application and must be
quoted in all subsequent correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of tenders: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments to, or the withdrawal of, a tender must be drawn up
and sent as per the instructions given in point 25. The word
'Modification' (amendment) or 'Retrait' (withdrawal), as applicable, must
be written on the outside envelope (and on the relevant inner envelope).
27. Working language: All correspondence concerning this invitation to
tender procedure and contract must be in French.
