FIAS, the Investment Climate Advisory Service of the World Bank Group, is seeking consultancy services to prepare studies on licensing practices worldwide for selected economic sectors.

We are requesting expressions of interest and a statement of qualifications from individuals or firms who are qualified and available to prepare brief studies on good and bad licensing practices in one or more of the following sectors:

• mining,
• agribusiness (food staples),
• trade licenses,
• construction permits,
• environmental impact,
• licensing of professionals,
• manufacturing,
• banking,
• telecommunications and
• provision of gas/water/electricity.

Each study should present and analyze good (and bad) practices, and contain country case studies. Licenses are understood to be commonly used forms of regulation which affect specified businesses and occupations by regulating entry into markets and conduct within markets. Licenses typically impose on businesses a range of conditions, obligations and rights.

The identified good and bad practices will be based on features identified by FIAS as common to good licensing administration and practice, including minimum necessary conditions and obligations to ensure compliance, minimum necessary compliance burdens placed on businesses, easily accessible information on requirements, regulator’s adherence to clear rules, transparent and timely decision-making processes, documentation of interactions, enforcement strategies that are effective in ensuring compliance but not impose on businesses unnecessary obligations, costs or risks, and a credible appeals system. The case studies should cover a range of countries with a balanced distribution in terms of geography and economic development.

Each sectoral licensing report will follow a standard format so that the studies are consistent, well-informed, and can be verified and compared. For more information, please see attached documents: draft Terms of Reference and draft Report Outline with Attachments.

FIAS will then use each sectoral report to identify commonalities and divergences across different sectoral licensing regimes. The findings on principles and practices of sectoral licensing systems will be disseminated to government reformers and other practitioners, including World Bank and IFC technical advisers, as part of a broader contribution to implementing successful licensing diagnosis and reforms.

The selected consultant will rely on her or his existing expertise and network of contacts with fellow experts and practitioners. No travel or significant administrative expenses are anticipated for this project.

Estimated level of effort / cost: 30 consultant days (for individuals) or less than $50,000 (for firms).

Estimated timing: submission of a first draft report to FIAS by September 15, 2008, final report by September 30, 2008.
