Advance Contract Award Notice – Physician’s Services

Background:

Correctional Service Canada has a requirement for contracted sources to provide methadone physician services and general medical services to federal offenders at Millhaven Institution located outside Bath, Ontario.

Current Requirements:

Correctional Service Canada (C.S.C.) intends to establish a contract for the provision of Physician and Methadone services.

Deliverables:

The following scope of work applies to the contract. Work to be performed under the contract includes, but is not limited to the following:

    -Provide medical services and Methadone services to inmates in federal correctional institutions in accordance with generally accepted community standards.

    -Offer, in Health Care Units at appropriate times, medical services which include examinations and assessments of inmates; investigations; diagnostics; treatments; prescriptions; and references to consultants as required.

    -Request outside hospital services when required, and provide relevant information to the treating physician.

    -Provide follow-up to clinical services and/or hospital admissions of inmates, phone consultations, and emergency services for the Institution during working hours, Monday to Friday from 0800 to 1700 hours; except for statutory holidays. Clinic hours provided to the institution will be decided by the Departmental Representative/Project Authority (Chief Health Services) at the site.

    -Document appropriately in the Correctional Service Canada medical files all relevant information concerning all interventions, including examination, diagnosis, treatment or/and prescription according to professional standards.

    -Visit inmates in segregation areas upon request from the Institutional Health Care     Unit

    -Approve Emergency Response Medical Directives and provide advice in the drafting of Institutional Medical Directives that govern the delegation of physician authority to the nursing staff for specific health interventions; review and approve both annually and when a national review of those Directives results in a change.

    -Remain in the institution during crisis situations at the request of the Chief of Health Services / Warden.

    -Attend Regional Health Services meetings on request of Health Services Administrator. Participate as a member of the Pharmacy and Therapeutics Committee at the request of the Health Services Administrator or Departmental Representative/Project Authority (Chief Health Services). Participate in case discussions with members of the health care teams as required.

    -Provide to inmates CSC approved treatment for opiate addiction (as outlined in, for example, Methadone Treatment Guidelines) and participate in training and education when required in order to maintaining professional privileges in this area.

    -Assure continuity of care when appropriate, including the identification of community-based providers and the provision of timely referral information to medical resources upon transfer to another institution and/or discharge to the community.

    -Participate in team/Regional meetings/discussions when requested.

-To ensure a qualified replacement is available in the event the contractor is unable to provide and maintain services.

    -Assess inmates with known or suspected infectious diseases and provide medical management in accordance with professional practice standards and Correctional Service Canada protocols and guidelines.

    -Isolate and report inmates with known communicable diseases in accordance with provincial public health regulations and Correctional Service Canada protocols.

    -Contracted Physicians agree to adhere to the approved Formulary when prescribing medication. Appropriate documentation to justify non-formulary items shall be completed and forwarded to the designated authority. The designated authority will be the Regional Pharmacist in regions that staff this position. In all other regions, the completed documentation shall be forwarded to the National Pharmacist or, in his/her absence, to the Director General of Health Services. The designated authority then has the opportunity to request clarification and suggest cost effective alternatives. Additions, deletions and substitutions shall be determined by the Pharmacy & Therapeutics Committee.

    -Physicians agree to abide by CSC policy, including paragraph 15 in Commissioner’s Directive 800 which reads: “Medication for inmates shall be prescribed by an institutional clinician only when clinically indicated. Accordingly, the administration of medication to inmates for restraint or for other security purposes shall not be undertaken.”

    -To utilize the Correctional Service Canada policies with respect to essential Health Services, including but not restricted to policies set forth in the Commissioner’s Directives, and Guidelines and Standards attached thereto, National Medical Directives, Regional Instructions, and Institutional Medical Directives as well as Correctional Service Canada’s Mission Statement.

    -To adhere to and support Correctional Service Canada policies with respect to the economical and efficient management of Health Service’s resources.

    -The contractor must be on site for the hours of the clinic or the hourly rate will prevail.

Mandatory Requirements:

To fulfill the requirements of the contract; the source must have the following qualifications and experience:

-Provide proof that the proposed physician is licensed as a Physician in good standing with his/her respective provincial College of Physicians and Surgeons. Suppliers must provide a copy of the license(s).

(a)    Provide a signed declaration indicating that he/she is a member in good standing with the College of Physicians of Ontario, and that there are no investigations or judgements against the proposed physician in any area of professional conduct, and that his/her licence to practice medicine has no restrictions. If there are current investigations, judgements or restrictions registered against any of the proposed physicians, details of them must be provided.

(b)    Provide proof that the physician has current Medical Professional Insurance.

(c)    Provide proof that all physician(s) who are proposed to work in CSC institutions through this contract have current training, or a valid licence when applicable, to prescribe treatment for opiate dependence and other addictions. The proposed physician(s) will be responsible to maintain such training/licensure in order to provide approved treatments and to acquire licensure/training if needed to provide treatments newly approved.

Sources must be able to obtain a Correctional Service Canada Security Clearance to the level of Reliability status.

Contract Period:

The contract is for the period commencing on approximately August 1, 2008 to November 30, 2010.

Estimated Cost:

It is intended to award a professional service contract with an approximate amount between $250,000.00 and $350,000.00 (excluding GST) depending on the location to be serviced. This amount covers the entire contract period.


Limited Tendering Reasons:

The contract is proposed under the Government Contracting Regulations, Section 6 (d) that states “only one person or firm is capable of performing the contract”. The Physicians listed below are the only sources available at this time to provide services to the Institutions listed below.

This requirement is not subject to the trade agreements.

Intellectual Property:

The intellectual property arising from this contract will rest with the Crown (Canada to Own) due to prior obligations of the Crown, statutes or regulations such as the Privacy Act.

Suppliers who consider themselves fully qualified and available to provide the services described herein, may submit a statement of capabilities in writing to the Contracting Authority identified in this notice on or before 2:00 PM, July 10, 2008.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

Statements of capabilities must be mailed or faxed on or before the closing date. Statements of capabilities received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and is not to be construed as a competitive solicitation.

Suppliers that have submitted a statement of capabilities will be notified in writing of C.S.C.’s decision to continue with the non-competitive procurement or to compete the requirement.

What is an Advance Contract Award Notice (A.C.A.N.)?

An Advance Contract Award Notice (A.C.A.N.) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a goods, services or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the A.C.A.N., the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the A.C.A.N., the contract may then be awarded using the Treasury Board's electronic bidding authorities.

If other potential suppliers submit statements of capabilities during the fifteen calendar day minimum posting period, and meets the requirements set out in the A.C.A.N., the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
