This Invitation for Tenders follows the General Procurement Notice for
this project first published on the European Bank for Reconstruction and
Development (EBRD)'s website on 2.8.2006 and updated on 18.4.2008. EBRD is
one of several co-financiers on the project to rehabilitate the Kutaisi
Municipal water system. EBRD Procurement Policies and Rules as modified by
certain exceptions established in an agreement between Millennium
Challenge Georgia Fund ("MCG") and EBRD, dated 25.4.2007 (the "Parallel
Financing Cooperation Agreement") shall govern this tender.
Pursuant to the Grant Agreement dated 26.4.2007 ("the Grant Agreement"),
the Municipal Development Fund ("MDF"), hereinafter referred to as "the
Employer" has received a Grant (the "MCG Grant") from MCG and intends
using the part of the proceeds of the MCG Grant towards the cost of
Kutaisi Municipal Water Project (the "Project"). Tendering process and
contract implementation will be carried out by MDF.
The Employer now invites sealed tenders from contractors for the following
contract to be funded from the MCG Grant and including the following:
Rehabilitation of water supply network on Chavchavadze and Akhalgazrdoba
streets
The contract envisages rehabilitation of Chavchavadze and Akhalgazrdoba
streets water supply systems, in particular 5 851 km water supply network
including construction of 8 inspection wells (manholes), installation of
77 water meters and construction of 20 fire hydrants.
Basic quantities of construction works:
Removal of asphalt layer 3 cm thick – 949 m³;
Earthworks excavation – 3 765 m³;
Backfilling - 898 m³;
Bedding and pipe surrounding with sand – 2 385 m³;
Imported gravel backfilling – 1 260 m³;
Construction of pipe line (d=315-40) – 5 851 m;
Installation of valves for underground inspection (OD 150-32) – 75 set,
fittings;
Construction of manholes – 8 pieces;
Construction of fire hydrants – 20 set;
Construction of water meters – 77 pieces.
The project area is located in West Georgia, 220 km west from Tbilisi and
comprises the territory of the city of Kutaisi.
The envisaged period of Works completion: 6 months.
Tendering for contracts to be financed with the proceeds of the MCG Grant
is open to firms from all countries, subject to the following exceptions:
MCG Grant funding will not be used for the purpose of any payment to
persons or entities, or for any import of goods, if, (i) as a matter of
law or official regulations, Georgia prohibits commercial relations with
the country of their nationality, provided that MCG is satisfied that such
exclusion does not preclude effective competition for the supply of goods
or the contracting of works required; (ii) such payment or import is
prohibited by Georgia in compliance with a decision of the United Nations
Security Council taken under Chapter VII of the Charter of the United
Nations; (iii) anyone or any entity debarred or suspended from
participation in procurement funded by the US Federal Government or
otherwise prohibited by applicable United States law or Executive Order or
United States policies, including under any then-existing anti-terrorist
policies.

Tenderers are invited to submit a tender for the total Contract.
To be qualified for the award of the Contract, Tenderers (in combination
with their affiliate companies) must satisfy the following minimum
criteria:
(a) The Tenderer has an average annual turnover over the last 3 years of
not less than USD 4 500 000 equivalent;
(b) Successful experience as main Contractor of at least 2 projects each
of a value not less than USD 900 000 or its equivalent. The projects shall
be of complexity comparable to this contract and shall be executed within
the last 5 years.
(c) Each Tenderer must have access to credit and other financial
facilities adequate to assure the required cash flow for the duration of
the Contract. In any case the financial amount available for the execution
of this project should, as a minimum be equal to USD 600 000 equivalent.
(d) The Tenderer should demonstrate his strong financial position and
long-term profitability by providing audited balance sheets and profit and
loss statements for last 3 years.
(e) For Georgian companies: It is necessary that all taxes owed in Georgia
during the last 2 years have been paid. Statement of Tax Administration
about absence of indebtedness in taxes shall also accompany the Tenders.
(f) The Tenderer must have suitably qualified personnel to fill the
following key positions: the proposed construction manager shall have not
less than 10 years total experience, 7 years experience of similar work,
and 5 years in a similar position.
(g) Litigation and arbitration record over the last 5 years which does not
indicate a consistent history of awards against the Tenderer.
(h) The Tenderer shall own, or have assured access to (through hire,
lease, purchase agreement, availability of manufacturing equipment, or
other means) equipment essential for carrying out the works, as per
details provided in the tender documents, in full working order, and must
demonstrate that, based on known commitments, they will be available for
use in the proposed contract.
The figures for each of the partners of a joint venture shall be added
together to determine the Tenderer's compliance with the minimum
qualifying criteria of subparagraphs (a) and (c) above; however, for a
consortium to qualify, each of its partners must meet at least 25 % of
minimum criteria (a), (b), and (c) above for an individual Tenderer, and
the partner in charge at least 40 % of those minimum criteria.
Tender documents may be obtained from the office at the address below upon
payment of a non-refundable fee of GEL 200 or equivalent in a convertible
currency plus courier expenses if a Tenderer would like the Tender
documents to be sent by Courier. If requested, the documents will be
promptly dispatched by courier, but no liability can be accepted for loss
or late delivery. A copy of the purchased tender documents may be
forwarded to the contractors by e-mail.

All tenders must be accompanied by a tender security in the form described
in the tender documents in US Dollars not less than to USD 20 000.
A pre-tender meeting for the interested Tenderers to receive additional
clarifications will be conducted at the address 7b Yetim Gurjy St., 0105,
Tbilisi, Georgia, 27.6.2008 (11:00).
Tenders must be duly completed and delivered to the office at the address
below on or before 28.7.2008 (12:00), local time, at which time they will
be opened in the presence of those Tenderers' representatives who choose
to attend. Documents, which are received late, will be rejected and
returned unopened.
