II.1) Description

II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with a
single operator.
Duration of the framework agreement: 4 years.
Estimated total value of purchases for the entire duration of the
framework agreement:
estimated value excluding VAT: EUR 230 000–EUR 350 000.
II.1.5) Short description of the contract or purchase(s): The aim is to
enter into a service contract with a firm specialising in life and
property security. This firm will be required to provide the Delegation of
the European Commission in Santiago with its own security guard service to
ensure the safety of:
— buildings (offices located at the address in point 1.1),
— living quarters of designated Delegation members or any other location
specified by the Delegation,
— Delegation staff.
The firm must undertake to:
— control visitor access to buildings,
— keep buildings under general surveillance so as to prevent any intrusion
affecting persons or property,
— install, monitor and control the anti-intrusion and alarm systems in the
offices and living quarters,
— take immediate on-site action in the event of an incident,
— assist persons in danger,
— manage actions in response to alarms triggered.

III.1) Conditions relating to the contract
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: Tenders submitted by consortia, firms
or groupings of contractors must specify the role, qualifications and
experience of each member of the grouping.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
(1) candidates' particulars:
(a) name;
(b) legal formation and registration of company;
(c) physical and postal address, telephone, fax and e-mail;
(d) names and positions of the members of the management bodies or of the
person authorised to represent the company;
(e) number, country and date of entry on the trade register.
(2) Candidates must submit a solemn declaration, duly signed and dated,
stating that they are not in any of the situations given in Articles 93
and 94 of the Financial Regulation.
These criteria are as follows: Article 93: candidates will be disqualified
from taking part if they:
(a) are bankrupt or being wound up, are having their affairs administered
by the courts, have entered into an arrangement with creditors, have
suspended business activities, are the subject of proceedings concerning
those matters, or are in any analogous situation arising from a similar
procedure provided for in national laws or regulations;
(b) have been convicted of an offence concerning their professional
conduct by a judgment which has the force of res judicata;
(c) have been guilty of grave professional misconduct proven by any means
which the contracting authority can justify;
(d) have not fulfilled obligations relating to the payment of social
security contributions or the payment of taxes in accordance with the
legal provisions of the country in which they reside, the contracting
authority's country or the country where the contract is to be performed;
(e) have been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) are currently the subject of an administrative penalty in accordance
with Article 96(1) of the Financial Regulation. Article 94: candidates or
tenderers will be disqualified from contract award if, during this
contract procedure, they:
(a) are subject to a conflict of interests;
(b) are guilty of misrepresentation in supplying the information required
by the contracting authority in order to participate in the contract
procedure or have failed to supply this information.
(3) Before signing the contract, the tenderer selected for the framework
contract must submit the following proof: with regard to points (a), (b)
and (e) of the grounds for disqualification: the tenderer must submit a
recent extract from the judicial record or a recent equivalent document
issued by a judicial or administrative body in his country of origin or
whence he comes or, where such a document or certificate has not been
issued by the country concerned: a statement under oath or solemn
declaration made by the interested party before a judicial or
administrative body, a notary or a qualified professional body in their
country of origin or whence they come; with regard to point (d) of the
grounds for disqualification: the tenderer must submit a recent
certificate issued by the appropriate authorities in their respective
country.

necessary for evaluating whether requirements have been met:
— certificate of good standing,
— documents showing total annual turnover and annual turnover for security
services for the past 2 financial years for which accounts have been
closed: balance sheets and operating accounts endorsed by an audit firm or
accounting auditor,
— tax registration,
— certificates demonstrating the regular payment of taxes to the relevant
authorities,
— document recording the company's history.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met:
— list of main customers in the past 3 years in areas relevant to this
contract, with particular reference to services provided for international
or foreign companies, diplomatic missions or representations of
international organisations,
— authorisation to perform security and security guard services,
— details of the total manpower of the company and the number of permanent
staff working in areas relevant to this contract (security), indicating
length of service.
