II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): The Department
of Community, Rural & Gaeltacht Affairs wishes to establish three multi
operator framework agreements over a 4-year period for training and
support services.
The Department of Community, Rural & Gaeltacht Affairs invites expressions
of interests for training and consultancy support services to Community
Based Organisations (Projects) Funded Under The Community Development
Programme.
The objectives of the programme of training and support for Projects are
to develop the capacity of volunteer board members and staff in
undertaking their legal and other responsibilities in compliance with
corporate governance, financial management, company law and Human
Resources and related matters.
With regard to the above, the services will be divided into the following
framework agreement lots:
(Lot 1) Framework Agreement for Training and Support in Corporate
Governance and related matters.
(Lot 2) Framework Agreement for Training and Support in Financial
management and related matters.
(Lot 3) Framework Agreement for Training and Support in Human Resource and
related matters.
Service Providers will be required to provide quality support in the form
of direct and indirect training and development support to volunteer board
members and staff of Projects.
It will be possible to provide support on a regional or national basis. In
this respect, there are some 60 Projects in the greater Dublin area, with
the remaining 120 in urban and rural areas countrywide (180 overall, of
which 170 may require support).
Full details of locations of projects to be supported are appended to this
notice.

LOT NO 1
TITLE: (Lot 1) Framework Agreement for Training and Support in Corporate
Governance and related matters
1) SHORT DESCRIPTION: 1. Corporate Governance and related Support
Legal framework surrounding the running of a Company and what that
entails.
Statutory responsibilities and obligations of Directors in respect of
decision making, delegation of responsibilities, company law, memorandum &
articles of association, employment law, equality legislation, company
health and safety requirements, requirements and implications of data
protection and procedures for AGM’s/EGM’s.
2) COMMON PROCUREMENT VOCABULARY (CPV): 74141200, 74100000.
3) QUANTITY OR SCOPE: Framework agreement for training and consultancy
support services for Corporate Governance and related matters to Community
Based Organisations (Projects).
There are approximately 170 Projects that may require training and support
throughout the lifetime of the framework.

Forecasting for sustainability and solvency.
2) COMMON PROCUREMENT VOCABULARY (CPV): 74141200.
3) QUANTITY OR SCOPE: Framework Agreement for the provision of training
and support for Financial Management Support to Community Based
Organisations (Projects). There are approximately 170 Projects that may
require training and support throughout the lifetime of the framework.
LOT NO 3
TITLE: (Lot 3) Framework Agreement for Training and Support in Human
Resource and related matters
1) SHORT DESCRIPTION: 3. Human Resource Management and related Support
Outlining the Company’s legal responsibility as an employer
How to effectively implement and manage recruitment, probationary system,
staff appraisal and review system and grievance and disciplinary
procedures.
The successful service provider will provide appropriate advice and
training to Voluntary Management Committees on the variety of legal
obligations that are placed upon them in their capacity as employers.
The Employment Support Group will provide Recruitment Packs to Projects as
required.
The Packs should be updated regularly to incorporate new developments in
employment legislation.
The service provider will also be responsible for the provision of
independent representation on interview boards for staff of projects
funded under the Community Development Programme.
2) COMMON PROCUREMENT VOCABULARY (CPV): 74141400.
3) QUANTITY OR SCOPE: Framework Agreement for the provision of training
and support for HR Matters. There are approximately 170 Projects that may
require training and support throughout the lifetime of the framework.

the successful framework members.

whom the contract is to be awarded: A grouping, if successful, may be
required to contract as a single entity, having joint and several
liability.

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number:
Objective criteria for choosing the limited number of candidates: Upon
receipt of expressions of interest for each Lot, candidates will be
evaluated in respect of the financial, economic and technical capacity
information and minimum levels stated. Candidates will be scored and at
least the top 5 scoring candidates under each Lot, depending on the
quality and number of applications received, will be invited to tender for
that Lot.
IV.2) AWARD CRITERIA
IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.
IV.2.2) An electronic auction will be used: No.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: The Department will not be responsible for
any costs, charges or expenses incurred by tenderers, whether or not a
contract is concluded.
Formal award of contract will be subject to the approval of the competent
authorities.
The Department is subject to the Freedom of Information Act as amended and
therefore all candidates should indicate whether any of the information
provided by them in the course of this procedure is to be treated as
sensitive commercial information, which should remain confidential to the
Department.
The successful tenderer(s) will be required to furnish a valid tax
clearance certificate from the Irish Revenue Commissioners. Contract
awards may be subject to satisfactory performance at interview.
Please indicate clearly the lot or lots for which you wish to be
considered when submitting your questionnaire(s).
Note that under the public procurement rules the Department will be
required to give a 14 day notification period to the preferred bidder /
framework members and to the unsuccessful tenderers, prior to the award of
any contract.
The Department reserves the right to award individual contracts to more
than one supplier.
Establishment and Operation of each of the Frameworks:
— Following the evaluation of the applications, separate tender lists will
be drawn up for the various lots and tenders invited, the results of which
will be used to establish the framework agreements,
— Applicants are reminded that successful economic operators appointed to
the frameworks will be required to avoid potential conflict of interest
throughout the lifetime of the framework,
— Admission to a framework agreement will be conditional upon formal
acceptance of the Department's terms and conditions,
— Admission to a framework agreement will be conditional upon production
of a valid tax clearance certificate and the maintenance of tax clearance
status throughout the period of the framework agreement,
— Following on from the establishment of a framework agreement, new
contracts will be awarded either by mini-competition among the framework
members or on the basis of the original tender submitted,
— Those admitted to a framework will be entitled to due consideration for
all contracts awarded under that framework. However, no guarantee can be
given that any contract will be awarded to any given firm within a
framework,
— While these framework agreements will, as a general rule, be utilised
for the services described above, the Department may, on certain occasions
and at its sole discretion, opt to carry out a separate contract award
procedure outside of the framework.
