SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Parent Company Guarantee may
be required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Lump sum fixed price
tender. Payments in accordance with the Terms and Conditions of Contract.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Each member is to sign an undertaking
to be jointly and severally liable for the completion and performance of
the contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The successful tenderer will require to enter into a legal agreement with
Sanctuary Housing Association Limited. A copy of the terms and conditions
will be provided with the ITT.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Firms
wishing to express an interest must provide the information requested in
items a, b or c below together with the information requested in items
d-l. a) If registered on the United Kingdom, Department Environment Trade
and the Regions Constructionline Database, (formerly known as NQS) provide
details of registration number and notification levels, (minimum notation
£5.00 million); b) If registered on an official list maintained by another
Member State, submit a certificate of registration issued by the competent
authority. This certificate should state the reference which enables them
to be registered on the select list and the classification given. c) If
not registered with either a) or b) then companies must provide the
following information. c.i.) A statement of the company's overall turnover
and the turnover on construction works for the previous 3 (three)
financial years. c.ii.) A statement of the company's average manpower and
the number of managerial staff for the past 3 (three) years. c.iii.) The
Contractor's educational and professional qualifications and/or those of
the person or persons responsible for carrying out the works. d) QA
standard required: BS EN ISO 9001: 2000, (or ISO 9001 1994). Firms must
provide evidence of their QA registration and QA scope appropriate to this
contract. They should supply copies of their registration certificate and
relevant QA scope. e) All prospective tenderers should be "Registered or
Certified" under Inland Revenue Construction Industry Schemes, (CIS).
Evidence of your CIS status should be supplied otherwise Sanctuary and or
their representative will be unable to give any further consideration to
your request to tender. Should the bidders not be registered at time of
tender they should confirm that registration will be provided should they
be successful. f) Provide the name, address, telephone and facsimile
numbers of the company and office from which the project will be managed,
and that for any parent company (with corporate structure diagram). Should
the bidder not have a local office they should provide confirmation that
suitable local office will be provided to manage the project. g) Submit
details of how the tenderer envisages the construction works will be
managed, together with a diagram of the proposed management structure, and
curriculum vitae's for the Project Director, the Contracts Manager, the
Site Agent and/or the Tenant Liaison Officer as a minimum. h) The
following information is to be provided for the most relevant contracts of
similar nature and complexity undertaken and completed in the last 5
(five) years for which the applicant has been the Main Contractor: Project
title, value, date, duration, contract strategy, conditions of contract
and nature - provide 5 relevant examples. i) Provide a copy of the
company's Health and Safety Manual. Details of any independant or internal
monitoring/assessment of the policy and details of the assessment
procedure. Provide a statement demonstrating your knowledge, understanding
and proposed application of the CDM Regulations 2007. j) Provide details
of any fatalities and serious injuries in the last 5 (five) years, which
shall take account of payroll employees, self-employed persons and
sub-contractors. Details of any prohibition notices and improvement
notices filed against the company in the same period. k) Provide details
in the form of a policy statement of the company's environment policy. l)
Please provide your organisation's policy statement regarding Diversity
and Equal Opportunities. m) The response to this advertisement shall be
restricted to 10 (ten) sides of A4 text, exclusive of the requested Health
and Safety Manual, document covers, requested certification and standard
forms.

does not bind itself to accept the lowest or any offer. Sanctuary Scotland
Housing Association will not be liable for any costs incurred by those
expressing interest in, or tendering for, this contract. Compliance with
all relevant legislation is required during the tendering process and the
terms of any resulting contract. Any contract awarded will be subject to
laws of Scotland. Under this procurement the successful bidder will be
required to support the contracting authority's economic and social
regeneration objectives. Accordnigly contract performance conditions may
relate, in particular, to social and environmental considerations.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: To be advised..
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Sanctuary Scotland Housing Association Limited will
incorporate a minimum of ten calendar days standstill period at the point
that information on the award of the contract is communicated to
tenderers. This period allows unsuccessful tenderers to seek further
debriefing from Sanctuary Scotland Housing Association Limited before the
contract is entered into. Applicants have two working days from the
notification of the award decision to request additional debriefing and
that information will be provided a minimum of three working days before
the expiry of the standstill period. Such information should be requested
from the contact point set out in Annex A - Section 1. If an appeal
regarding the award of the contract has not been successfully resolved,
The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No 1) provided
for aggrieved parties who have been harmed or are at risk of harm by a
breach of the rules to take action in the Sherriff Court or Court of
Session. Any such action must be brought promptly (generally within three
months). Where a contract has not been entered into, the Court may order
the setting aside of the award decision or order Sanctuary Scotland
Housing Association Limited to amend any document and may award damages.
If the contract has been entered into, the Court may only award damages.
