II.2.1) Total quantity or scope: Design and construction of a 5 km dual
two lane carriageway bypass scheme, including an over rail line buried
tunnel, two over rail line bridges, four under rail line culverts, one
flyover, two side road overbridges, two underbridges, plus other culverts,
retaining walls, Utilities works and environmental works. Estimated value
£ 85m.
Estimated value excluding VAT: 85 000 000 GBP.

formalities necessary for evaluating if requirements are met: To express
an interest in this contract, a Pre-Qualification Questionnaire (PQQ) must
be uploaded on to the Authority's e-tendering website at
www.devontenders.gov.uk no later than 12 noon on 8th August 2008. The PQQ
will be made available on 16th June 2008. The Council is a Public
Authority under the Freedom of Information Act 2000 and all information
received will be dealt with in compliance with this Act.

necessary for evaluating if requirements are met: Detailed company
financial profile to be supplied through responses to the
Pre-Qualification Questionnaire.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a 15 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have two working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in point I.1. If an appeal regarding the award of a contract has not been
successfully resolved the (for Public Sector) Public Contracts Regulations
2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or
are at risk of harm by a breach of the rules to take action in the High
Court (England, Wales and Northern Ireland). Any such action must be
brought promptly (generally within 3 months). Where a contract has not
been entered into the court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the court may only award
damages.
