SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

Pre-qualification Procedure for the expansion of the existing 30 000 PE
Waste Water Treatment Facility to 40 000 PE by Design/Build, and the
Operation of the plant from the date of the contract signing for 21 years.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The Contract covered by this
prequalification process consists of the expansion of the capacity of the
Greystones WWTF to 40 000 PE with a 21 year O & M Phase. Certain existing
elements of the facility are in need of upgrading or repair. Some of these
works must be carried out to enable the facility to be run under an O & M
contract priced on volumetric/performance based rates rather than on a
dayworks rates basis as it is currently operated.
II.2.2) Options: No.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: If the candidate is a
subsidary company or other economic operator who is deemed by the Client
to demonstrate insufficient financial strength, a satisfactory guarantee
provided by a bank acceptable to the Client or by another economic
operator will be required prior to contract signing.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: A successful candidate which is a
grouping of individual companies shall form, prior to contract award, a
single legal entity or a consortium. In either case, the grouping shall be
required to carry joint and several liability to the Client for the
duaration of the project. The identity of each member of the consortium
and the legal form to be assumed by the consortium must be advised as part
of the Request to Participate.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
- Provision of evidence of operation of quality management system, in
accordance with Regulation 63 of S.I. 329 of 2006, European Communities
(Award of Public Authorites Contracts) Reglations 2006.
- Provision of evidence of operation of a system to ensure compliance with
the applicable environmental management standards in accordance with
Regulation 64 of S.I. 329 of 2006.
- Tax and Social Security Obligation Clearance in accordance with
Regulation 60 of S.I. 329 of 2006.
- Provision of evidence of competence as Project Supervisor Design Phase
(Designer) and Project Supervisor Construction Stage (Contractor).
Evaluation under the terms of S.I. 504 of 2006.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: As stated in
the Prequalification Document.
Special provisions applicable if groups of economic operators are
involved:
- Candidates are informed that they shall be excluded from the
Pre-Qualification Process if any of the conditions specified in Paragraphs
(1) and (4) of Regulation 53 of S.I. 329 of 2006, European Communities (
Award of Public Authorites Contracts) Regulations 2006 apply to them, or
any consortium member. Evidence that none of the specified scenarios apply
to them is required and shall be in the form specified in Paragraphs (6),
(7) and (8) of Regulation 53. Failure to do so will justify exclusion.
- The candidate shall provide a certificate from the relevant authorities
certifying that the candidate ( and all its individual members, if a
consortium or other grouping) has no social security contributions or
taxes outstanding in accordance with Regulation 60 os S.I. No. 329 of
2006, European Communities (Award of Public Authorities Contracts)
Regulations 2006. Failure to do so will justify exclusion.

- Economic and Financial in accordance with Regulation 55 of S.I. 329 of
2006.
- Technical and Professional Ability in accordance with Regulations 56 and
57 of S.I. 329 of 2006.

IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.
