Public supply contract No COR/LIB/2008/1 for the supply of periodicals in
various forms for the departments of the Committee of the Regions of the
European Union and the European Economic and Social Committee.

supply contract is for subscriptions to specialist periodicals in various
forms for the departments of the Committee of the Regions of the European
Union and the European Economic and Social Committee. The aim is for these
departments to be informed as soon as possible of news published in the
general-interest and international press. This invitation to tender
consists of 1 lot: supply of subscriptions to certain periodicals for the
departments of the Committees.

Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Payments will be
made only if the contractor has fulfilled all contractual obligations on
the date the invoice is issued. Requests for payment must be accompanied
by the relevant invoices, mentioning the contract reference number and the
order to which they relate, in order to be considered acceptable. Payment
of the invoices concerned will be made within 30 days of the date on which
the Committee approves the documents enclosed with the payment request.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
A. Submission of applications:
requests to participate must be placed in a double envelope and sent by
post prior to the deadline in point IV.3.4. Both envelopes must be sealed,
and the inner one must be marked with the name of the department to which
it is addressed (see above) and the following: 'COR/LIB/2008/1 — Demande
de participation de (name of company) — À ne pas ouvrir par le service du
courrier'. Self-seal envelopes must be sealed with sticky tape, with the
sender's signature written across the tape.
Candidates may choose to submit their requests to participate:
(a) either by post to the official address in point I.1;
(b) or by delivering them to the Committee of the Regions via a
representative or a courier service. In this case, the full address in
point I.1 must be written on the outer envelope and a receipt will be
supplied as proof of submission. Said receipt will be signed and dated by
the person at the Committee's main reception who takes delivery of the
application. The opening times of this department are 8:30–17:30, Monday
to Thursday, and 8:30–15:30 on Friday. It is closed at weekends and on
Committee holidays.
B. Candidates' particulars:
candidates must:
— quote reference COR/LIB/2008/1 in their request to participate,
— enclose a detailed identification sheet stating the following: name,
legal status, nationality, address, telephone and fax numbers, contact
name and e-mail address, VAT number, official registration number (where
applicable) and bank details,
— enclose the documents and information required under point III.2
'Conditions for participation'.
C. Legal position:
— name of the country in which candidates have their head office or are
domiciled, and relevant documentary evidence in accordance with
legislation in their country of residence,
— documents certifying that candidates are not in any of the situations
which would disqualify them from participating in a contract awarded by
the European Communities, i.e. proving they are not subject to exclusion
from the procedure (exclusion criteria).
Exclusion from participation in the procedure:
(Name of company representative) hereby declares that the aforementioned
company or organisation:
(a) is not bankrupt or being wound up, its affairs are not being
administered by the courts, it has not entered into an arrangement with
creditors or suspended business activities, is not the subject of
proceedings concerning these matters and nor is it in any analogous
situation arising from a similar procedure under national laws or
regulations;
(b) has not been convicted of a criminal offence by a judgment which has
the force of res judicata;
(c) has not been guilty of grave professional misconduct proven by any
means the contracting authority can justify;
(d) has fulfilled its obligations relating to the payment of
social-security contributions and taxes in accordance with the legal
provisions of its country of residence or those of the country of the
contracting authority or those of the country where the contract will be
carried out;
(e) has not been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) is not currently subject to an administrative penalty as laid down in
Article 96(1) of Council Regulation (EC, Euratom) No 1605/2002 of
25.6.2002 (OJ L 25, 30.1.2003) on the Financial Regulation applicable to
the general budget of the European Communities, as amended by Council
Regulation (EC) No 1995/2006 of 13.12.2006 (OJ L 390, 30.12.2006).
Exclusion from contract award:
tenderers will not be considered for contract award if, at the time the
contract is awarded, they:
(1) are subject to a conflict of interests;
(2) are guilty of misrepresentation in furnishing the information required
by the contracting authority in order to take part in the contract, or
have not furnished said information;
(3) are in any of the exclusion cases mentioned in points (a)–(f) above.
NB: the tenderer to whom the contract is likely to be awarded must provide
the following documentary evidence in support of his declaration, within
the timescale set in writing by the contracting authority and before the
contract is signed:
— recent extract from the judicial record or, failing this, an equivalent
document recently issued by a judicial or administrative body in the
tenderers' country of origin or provenance, stating that they are not
bankrupt or being wound up, their affairs are not being administered by
the court, they have not entered into an arrangement with creditors, they
have not suspended business activities, are not the subject of proceedings
of this nature, nor are they in any analogous situation arising from a
similar procedure under national laws or regulations,
— recent extract from the judicial record or, failing this, an equivalent
document recently issued by a judicial or administrative body in the
tenderers' country of origin or provenance, stating that they have not
been convicted of an offence by a judgment which has the force of res
judicata and have not been the subject of a judgment which has the force
of res judicata for fraud, corruption, involvement in a criminal
organisation or for any other illegal activity detrimental to the
Communities' financial interests,
— recent certificate issued by an appropriate body in the country in which
tenderers reside, or in the contracting authority's country or the country
in which the contract is to be carried out, stating that they have
fulfilled their obligations in respect of payment of social-security
contributions,
— recent certificate issued by an appropriate body in the country
concerned, stating that tenderers have fulfilled their obligations in
respect of payment of taxes (direct taxes and VAT) in accordance with
legal provisions in the country in which they reside, or those of the
contracting authority's country or the country in which the contract is to
be carried out,
— any document (such as an appropriate declaration or certificate issued
by a judicial or administrative body in tenderers' country of origin or
provenance) proving that tenderers have not been guilty of grave
professional misconduct and have not been declared to be in serious breach
of contract for failure to comply with their contractual obligations
following another procurement procedure or grant award procedure financed
by the Community budget. Where no such documents or certificates are
issued in the country concerned, they may be replaced by a statement under
oath, or failing that, a solemn declaration made by tenderers before a
judicial or administrative body, a notary or a qualified professional body
in their country of origin or provenance.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating whether requirements have been met:
— copy of the balance sheets and profit and loss accounts for the past 3
financial years, showing the annual pre-tax profit. If, for a valid
reason, service providers are unable to provide them, they must enclose a
statement as to annual pre-tax profits for the past 3 financial years. If
the balance sheets or the statement show an average loss over the past 3
years, then candidates must furnish another document as proof of their
financial and economic standing, such as appropriate bank references or
proof of professional risk insurance cover,
— statement as to overall annual turnover in the past 3 financial years,
— statement as to turnover in the past 3 financial years in the field
covered by this contract.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met:
tenderers must comply with the following criteria:
(a) tenderers must have the appropriate knowledge relevant to the context
and scope of the contract;
(b) tenderers' activities must be relevant to this contract and they must
furnish proof of similar services provided over a period covering at least
the past 3 years. The contracting authority will accept the following
documents as proof that the aforementioned criteria have been met:
— tenderers' and/or company managerial staff's academic and professional
qualifications, particularly those of the people who will be responsible
for the services sought,
— list of the main services and supplies provided over the past 3 years in
the field covered by this contract, giving precise details of the type of
work carried out, the date, the human and financial resources used, the
contract value and the recipient (public or private),
— description of the technical plant, tools and equipment to be employed
for performance of the contract,
— description of the quality assurance measures employed with regard to
the supplies and services, and of the company's study and research
facilities,
— statement on the service provider's or contractor's average annual
manpower and the number of managerial staff over the past 3 years.
