SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Mutton Island Wastewater Treatment Works Design Build Operate and Maintain

II.1.5) Short description of the contract or purchase(s): Galway City
Council proposes to pre-qualify a panel of Private Service Providers (PSP)
to whom Tender documents for a design, Build, Operate & Maintain Contract
will be issued for the Mutton Island Wastewater Treatment Works project,
which includes the provision of a sludge dryer. The project will involve a
significant upgrade to the existing treatment capacity at the plant, and
its operation & maintenance for a 20 year period.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Galway City Council intends to award a
20-year contract for the upgrade, operation and maintenance of the Mutton
Island Wastewater Treatment Works. The Private Service Provider will be
required to design a significant upgrade to the plant and carry out the
upgrade works on receipt of approval, while maintaining the plant
operational under the terms of the EPA wastewater discharge licence and to
operate and maintain the Mutton Island Waste Water Treatment Works for a
period of 20 years. The contract will include all aspects of the receipt
of waste water, its treatment and the disposal off-site of sludges in an
approved manner.
The facility is currently designed to treat municipal and industrial
wastewater to a population equivalent of 91 600. The contract may include
the operation and maintenance of a number of pumping stations in Galway
City. The Private Service Provider can expect that the contract will
include capital works at the outset, which will be necessary to increase
the facility treatment capacity and to modify the facility to suit the
operational contract. These works are likely to include construction of
new buildings or alterations to existing structures, alterations to
existing mechanical & electrical plant, alterations to existing pipework
and processes, and the installation of new mechanical and electrical
plant. The detailed design of these works will be delegated to the Private
Service Provider under a Design Build contract arrangement.
The Private Service Provider will be responsible for the management and
disposal of sludges generated at the Works. Initially the PSP will (a)
centrifuge sludges and transport dewatered cake from Mutton Island to a
Sludge Hub Centre elsewhere and (b) construct a sludge dryer (part of
upgrade works) and dry sludges at Mutton Island for transport of a reduced
biosolids volume offsite. Both (a) & (b) will be priced.
The PSP must operate the facility in accordance with the EPA Wastewater
discharge licence at all times, including the period in which the upgrade
works are in progress.

may be obtained from the address in the Annex A.1.1.

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 240 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Performance bond relevant to
the tender price for a one year operatonal cost.
Performance bond in relation to the upgrade works.
Insurances in accordance with the contract documents will also be required
for the Design Build and Operation/Maintenance Works.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: The Contract with
Price Variation in accordance with FIDIC (Orange Book) Conditions of
Contract for Design, Build and Turnkey Contract 1995, as amended by the
contract documents, as described in the tender documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: A copy of the legal agreement between
all parties involved in a consortium will be required prior to the award
of the contract. Applicants, including each member of a joint venture or
group applying, shall confirm that none of the exclusion criteria set out
in article 53(4) (a) to (f) of S.I. 329 of 2006 apply to them and provide
certification in accordance with article 53(6) of the same Statutory
Instrument.

III.2) CONDITIONS FOR PARTICIPATION

III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: The Applicants must
comply with Article 55 of S.I. 329 of 2006 and evidence of the applicants
financial and economic standing must be furnished as set out in article
55(1) of S.I. 329 of 2006 and in particular, those set out in the
pre-qualification document.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: The Applicants must comply with
Article 56(c) of S.I. 329 of 2006 which refers to article 59 of S.I. 329
of 2006. The Applicant is required to submit information in relation to
each of the items outlined in Article 59(1) (a) to (i) of S.I. 329 of 2006
inclusive and in particular those outlined in the pre-qualification
document.
Minimum level(s) of standards possibly required: Further information will
be set out in the Prequalification Document.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: The acceptance of the tender will be
subject to;
The presentation of a performance bond for the operation of the facility.
The presentation of a bond for the upgrade works.
Evidence that the PSP has provided his employees with membership of a
Pension & Sick Pay Scheme, the terms of which are no less favourable than
those of the Construction Industry Federation of Ireland Pension Scheme,
and to the satisfaction of the Employer.
The provision of a Tax Clearance Certificate or a Sub-Contractors C2
Certificate within the specified period. (In the case of a non-resident
tenderer, a statement from the Revenue Commissioners in Lieu of a Tax
Clearance Certificate will be required).
The PSP must, on or before signing the Contract, produce acceptable
Employer's and Public Liability Insurance policies (and receipts for
current premiums) providing indemnity for the PSP & City Council in
respect of any claims arising from the works.
It is a requirement that all site personnel are registered under the
Safe-Pass Programme.
Galway City Council is subject to the provisions of the Freedom of
Information (FOI) Act, 1997. If the Applicant considers any of the
information supplied to be commercially sensitive or confidential in
nature, this should be highlighted and reasons for its sensitivity
specified. In such cases the relevant material will, in response to FOI
requests, be examined in the light of the exemptions provided for in the
FOI Act.
Applicants may be required to attend for interview in Galway City, Ireland
as part of the pre-qualification process.
The PSP will be required to maintain the contract offer for 6 months.
Provisions for further delays will be detailed in the contract tender
documents.
The tenders will be opened in the Offices of Galway City Council as soon
as is practicable after the date of receipt of tenders.
Authorised Officers of Galway City Council will be present at the opening
of the tenders.
