II.1.3) The notice involves: The conclusion of a framework agreement.
II.1.4) Short description of the contract or purchase(s): Three Rivers
District Council has transferred circa 3 900 dwellings to Thrive Homes, a
newly formed Registered Social Landlord. Approximately 42 500 000 GBP of
maintenance and investment works will be required over the next 4-5 years
following transfer. It is proposed that these works will be delivered via
framework agreements and 1 off contracts packaged according to work type
and size. Thrive Homes is seeking to establish a framework agreement
between 1 and 3 contractors depending on the quality and number of
suitable bids received. This framework agreement will govern the letting
of contracts for mainly internal refurbishment works including but not
limited to the supply, replacement and renewal of kitchens, bathrooms, and
the provision of electrical services, central heating services and
associated works (including where necessary asbestos removal) with a total
approximate cost of 18 000 000 GBP. There may also be a provision to
undertake external works which currently do not meet the decency standard.
The framework agreement will be linked to the client and other contractors
for a maximum period of 4 years with annual call-off contracts let to each
contractor under the ACA Standard Form of Contract for Project Partnering
("PPC2000, as amended 2003").

VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority incorporated a minimum
10-calendar-day standstill period at the point information on the award of
the contract was communicated to tenderers. This period allowed
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract was to be entered into. Applicants had 2
working days from the notification of the award decision to request
additional debriefing and that information had to be provided a minimum of
3 working days before the expiry of the standstill period. If an appeal
regarding the award of a contract has not been successfully resolved the
Public Contracts Regulations 2006 (SI 2006 No 5) provides for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into, the Court may order
the setting aside of the award decision or order the contracting authority
to amend any document and may award damages. If the contract has been
entered into the Court may only award damages.
