Summary:
1. Awarding authority: The European Patent Organisation (EPO), through
the European Patent Office: Headquarters, Erhardtstraße 27, D-80469
Munich, Postal address: EPO, D-80298 Munich.
The European Patent Organisation is an intergovernmental organisation set
up pursuant to the European Patent Convention, which entered into force in
1977. It now has 34 member states (Austria, Belgium, Bulgaria, Croatia,
Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany,
Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein,
Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland,
Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey
and United Kingdom). The executive body of the EPO is the European Patent
Office, which is charged with the searching and examination of European
patent applications and the granting of European patents. It employs
approximately 6 700 staff at EPO headquarters in D-Munich, a branch at The
Hague (NL-Rijswijk) and sub-offices in D-Berlin and A-Vienna (the number
of member states and staff members is subject to change).
2. Award procedure: International open invitation to tender with
discretionary award of contract
3. Description of the contract: (a) Purpose of contract: Building work.
Work: Completion work.
Part 1 Ceilings.
- removal and refitting of grid ceilings (7 526 m²), removal of
wooden-panel ceilings (1 095 m²), vented ceilings (3 740 m²) and
metal-panel ceilings (9 550 m²);
- replacement of metal-panel ceilings with fully-removable metal-panel
ceilings in class F30 (5 137 m²);
- replacement of metal-panel ceilings in class F0 (18 320 m²);
- removal of wire-plaster ceilings and fitting of new plasterboard
ceilings (3 050 m2).
Period: November 2008 to September 2010.
Part 2 Walls.
- removal and re-installation of separating walls in WCs (156);
- tiling (700 m2), including repairs to damaged tiles (approximately 500
m²)
Period: November 2008 to October 2010.
Part 3 Steel work.
- replacement of defective wired-glass sheets on canopy (approximately 50
m²)
- anti-corrosion work on steel components of two canopies and outside
walkways (245)
Period: July 2009 to August 2009.
Part 4 Masonry.
- building of stone walls in class F90, including plastering (77 m²)
- demolition and building of stone walls in class F90 (690 m²)
Period: December 2008 to October 2010.
Part 5 Doors and gates
- replacement and disposal of damaged door leaves (15).
Period: May 2009 to August 2009.
Part 6 Other work.
- removal and refitting of fixed glazing in class F30 (approximately 5 m²)
Period: June to July 2009.
(b) Division into lots: Not applicable.
(c) Deposits and guarantees required:
Performance bond amounting to 10% of the net contract sum.
Defects liability bond amounting to 5% of the net final-invoice amount.
(d) Main terms concerning payment:
Subject to Part B of the Building Contract Code ("VOB/B") (payment period
for instalments 18 working days / final invoice 30 working days).
(e) Qualifications required by law: Not applicable.

5. Variants: permitted The elements and the planned performance of any
work concerned by proposed variants must be described in the bid in a
comprehensive and verifiable manner. Variants and supplementary bids may
be submitted only with a main bid.

The Procurement Documents may be requested by letter, fax or e-mail.
The EPO does not expect to send the Procurement Documents before early
June 2008 and would therefore ask bidders to refrain from requesting
clarification before then.
(b) Final date for receipt by the EPO of requests for the Procurement
Documents:
- 6.6.2008 (12:00) CET.
(c) Final date for receipt by the EPO of requests for clarification:
- 16.6.2008 (12:00) CET.
- queries must be submitted by letter, fax or e-mail.
(d) Final date for receipt of bids/number of copies to be sent:
- 27.6.2008 (12:00) CET.
- 2 copies, in addition to the original bid to be marked as such.
- The bid must be filed in writing by post or courier service; bids
submitted by fax or e-mail will be eliminated.
(e) Address to which requests for clarification and bids must be sent:
As in Point 6(a), but please note the requirements in Point 6(d).
(f) Language or languages in which requests for clarification and bids
must be drawn up:
German.
The Procurement Documents are available only in German.
7. Legal form of consortium in the event of a joint bid: If several
bidders submit a joint bid, 1 must be designated as prime contractor
responsible for performance of all obligations under the contract.
8. Information and evidence concerning the bidder's financial and
economic standing and technical and professional competence: See
Procurement Documents.
9. Period during which the bidder is bound by his bid: 7 months as from
final date for submitting bids as per point 6(d) above.
10. Criteria for the award of contract: Criteria group I: Economic
efficiency (weighting 70%):
- Price.
Criteria group II: Competence / capacity (weighting 30%):
- In-house performance of services;
- Managerial and operational staff;
- References relating to the provision of similar services in the last 3
financial years;
- Technical equipment available for performance of the services;
- Planned on-site deployment of staff, with breakdown according to
function;
- Turnover in the last 3 financial years;
- Any pending legal proceedings;
- Average number of staff employed in the last 3 financial years, with
breakdown according to function.
11. Other information: The EPO reserves the right to invite bidders to a
meeting to clarify their bid. The costs incurred by bidders in attending
such meetings are not reimbursable.
It is planned to offer bidders an opportunity to visit the premises on
12/13.6.2008 on prior arrangement of an appointment. Requests for an
appointment must be sent in writing by post, fax or e-mail to the address
specified in Point 6(a) by 10.6.2008 (12:00). The request must quote the
number of this tender and the füll name(s) of the person(s) who will be
attending on behalf of their firm. The EPO will inform bidders of the
precise time of the visit.
Contract award is expected to take place in the first week of November
2008.
