'Seaborne logistics support stocktaking study'.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The aim of the
study is to take stock of available and planned assets and techniques,
which would facilitate the development of a seaborne logistic capability
to support EU crisis management operations (CMOs). The seaborne logistics
support stocktaking study should provide an informed view of the
challenges needed to be overcome to make effective use of seaborne
logistics in each type of European security and defence policy (ESDP)
operation. The study should cover current logistic concepts, the
availability and use of existing assets, their limitations in the various
scenarios (based on the ESDP missions) and the technological or other
developments that might be made to deliver more effective solutions. The
outcome of the study should be a report providing the EDA participating
Member States (pMS) in general with:
— a robust knowledge of existing programmes/projects related to seaborne
logistics support (including sea basing) and possible future technology
developments (both civil and military) that may deliver improved
capability,
— an assessment of the data on current 'state of the art' for seaborne
logistics and possible developments in the short to medium term, including
key technologies,
— an efficiency assessment and cost of the application of such
technologies, with the purpose of using them in a follow-on seaborne
logistics capability analysis.

III.1) Conditions relating to the contract
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Grouping of companies (consortium) is
authorised:
— subcontracting is authorised but shall be limited to non-essential part
of the services and subject to prior approval by the Agency. The candidate
shall indicate in its request to participate the proportion of the
contract which he may intend to subcontract,
— co-contracting is authorised. In case of co-contracting, the consortium
shall take note that if selected to be invited to submit a tender, it will
be required to provide a copy of the 'consortium agreement' in its final
form along with its tender. Such agreement shall be signed prior to
contract signature.

III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met:
As part of the request to participate, candidates must provide a
declaration on honour as required in Article 41 of the Procurement Rules
(Council Decision 2007/643/CFSP of 18.9.2007 available from the Internet
address: http://www.eda.europa.eu/procurement.aspx) supporting the fact
that they are not in any of the situations referred to in Articles 9 and
10 of the Procurement Rules excluding them from participating. In case of
a consortium, the declaration is to be provided by each co-contractor.
English courtesy translations of the declaration are mandatory.
In case the candidate's situation changes during this procurement
procedure he must immediately inform the Agency thereof.
As part of the request to participate, candidates must provide:
1. a letter of candidature signed by a duly authorised representative. In
case of a consortium, the following options will be considered:
— a single letter to be issued by the prime contractor and co-signed by a
duly authorised representative from each co-contractor, or
— a letter of candidature from each co-contractor signed by their
duly-authorised representative;
2. an authorisation to perform the contract under national law, as
evidenced by enrolment in the trade or professional register or a sworn
declaration or membership of a specific organisation, express
authorisation, or entry in the VAT register (In case of a consortium, the
authorisation is to be provided by each co-contractor.).
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met:
As part of the request to participate, candidates must provide proof of
their sound financial and economical capacity as required in Article 43 of
the Procurement Rules.
In case of a consortium, the economic and financial capacity will be
assessed globally as the sum of the capacity of all the members of the
consortium. However, the prime contractor itself shall account for the
major part of the overall candidate's economic and financial capacity.
The financial and economic capacity of the candidates will be assessed on
the basis of the information contained in the following documents, to be
supplied by the candidates (the prime contractor and each co-contractor):
either 1 or 2, and the statement under 3:
1. an appropriate statement from a bank;
2. a presentation of balance sheets or extracts from balance sheets for
the last 2 financial years for which accounts have been closed, where the
publication of balance sheets is required by company law in the country in
which the economic operator is established;
3. a statement of overall turnover and turnover concerning the services
covered by the contract notice for the last 2 financial years.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
As part of the request to participate, candidates must provide proof of
their professional and technical capacities, as required in Article 44 of
the Procurement Rules. In case of a consortium, the technical capacity
will be assessed globally as the result of the capacity of all the members
of the consortium (prime contractor, co-contractors, and subcontractors).
However, the prime contractor itself shall account for the major part of
the technical capacity.
Candidatures shall:
1. demonstrate the relevance of the candidate's background and previous
experience in the field of maritime and naval issues;
2. demonstrate the candidate's knowledge and understanding of the logistic
support aspects of the EU-led military missions;
3. demonstrate the candidate's knowledge of the EU military environment,
military structures and the understanding of the ESDP tasks and missions;
4. demonstrate the candidate's knowledge and capacity in data gathering;
5. demonstrate, by means of CVs, the knowledge and experience of the
candidate's personnel in the above-related fields;
6. demonstrate the candidate's experience in working with multinational
and multi-professional organisations.
Candidates shall equally provide the following supporting evidence in
their candidatures:
1. a list of the principal services (contracts, studies) corresponding in
terms of scope and complexity to the services of the present contract
notice provided in the past 5 years;
2. a precise and concise statement explaining why the candidate considers
his candidature as being the best placed to conduct the study.

Objective criteria for choosing the limited number of candidates:
On the basis of the number of received candidatures requesting to
participate, at most 5 admissible candidates will be invited to submit
detailed tenders for this contract. If more than 5 candidatures meet the
conditions of participation (as per III.2), the candidates will be ranked
by the Evaluation Committee based on the technical capacity criteria (as
per III.2.3) in order to retain the best 5 candidatures who will be
invited to tender.

in IV.3.4 shall be disregarded.
Modalities for the submission of the request to participate:
Requests to participate can be freely formulated, but must clearly
identify all the consortium members and indicate the exact contact details
(see model below):

as the prime contractor),
— name, title, address, telephone, fax, e-mail of the point of contact of
the candidate,
— consortium members (identification and qualification as prime
contractor, co-contractor or subcontractor).
Requests to participate, together with all the necessary documentation,
shall be submitted in 3 hard-paper copies to the Agency at the address
given below within the time-limit indicated in IV.3.4:

Opening hours: from Monday to Friday (except EDA and public holidays in
Belgium: 1, 2, 9 and 12.5.2008) between 9:00–12:00 and 14:00–17:00.
And shall be submitted:
(a) either by registered post with acknowledgment receipt; in which case
the relevant date is to be the date of receipt (during business hours) by
the Agency of the registered post; or
(b) by hand-delivery to the premises of the Agency by the candidate in
person or by an agent, including courier service, in which case a (signed
and dated) receipt will be issued.
The relevant date is to be the date of receipt (during business hours) by
the Agency.
The contract title (as per II.1.1) and the file reference (as per IV.3.1)
must be clearly marked on the envelope containing the request to
participate and must always be mentioned in all subsequent correspondence
with the Agency.
Any request to participate which does not conform with the submission
modalities set above may be disregarded.
Requests to participate shall not be submitted (either partly or wholly)
by fax or electronic mail.
Any additional documentation (brochure, letter, etc.) sent with the
request to participate will not be taken into consideration.
Request for further information/clarification:
While the procurement procedure is under way, all contacts between the
Agency and candidates shall satisfy conditions ensuring transparency and
equal treatment. Any contact in the context of this contract notice
between the candidates and the Agency shall be prohibited save, by way of
special exception under the Procurement Rules, under the following
conditions:
— on the initiative of the candidates, solely to ask in writing (e-mail,
fax, regular mail — see I.1 above) the Agency for additional information
/clarification relating to the contract notice but not later than 8 days
before the deadline for the receipt of requests to participate. In which
case the Agency will publish the questions and the answers on its
above-mentioned web site,
— on the initiative of the Agency, if it notices an error, a lack of
precision, an omission or any other type of clerical defect in the texts
relating to the contract notice, or when the Agency is requesting a
clarification(s) from a candidate. In which case the Agency will publish a
corrigendum on the EU OJ web site and simultaneously on its own
above-mentioned web site.
