authority wishes to establish a framework agreement/contract for use by or
on behalf of UK public sector bodies (and where appropriate their
statutory successors and organisations created as a result of
re-organisation or organisational changes). These will include but not be
limited to: Central Government Departments & their Agencies, NHS Bodies
(e.g. Primary Care Trusts and other such bodies), Local Authorities (i.e.
a local authority as defined in Regulation 3(2) to (5) of the Public
Contracts Regulations 2006 (‘the Regulations’)), Police & Emergency
Services (e.g. fire authorities, fire and rescue authorities, police
authorities and the Metropolitan Police Authority as defined by Regulation
3 (1)(j) to (p) of the Regulations) and Educational Establishments (e.g.
Governing Bodies of schools maintained by local authorities; Voluntary
Aided Schools; Foundation Schools; Diocesan authorities; Academies; City
Technology Colleges; Foundation Partnerships; the Learning and Skills
Council; further education establishments; higher education establishments
and other educational establishments).

but this could increase substantially depoending on competitive nature of
the framework and customer uptake. It is estimated that the total volume
in the public sector is around 50TWh.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The Energy Consortium (TEC) is considered
to be a “contracting authority” for the purposes of the UK Public
Procurement Regime, it is lawful for other public sector bodies to rely on
a framework agreement which TEC has generated using a proper competition
for the provision of goods and services. Such public bodies will be able
to rely upon the competitions which TEC have run, to meet their best value
obligations under the Local Government Act 1999, general EU obligations
that some advertising and competition is required; and that it is a
central purchasing body under the procurement regulations. Bidders are
entirely responsible for their own costs. The contracting authority
reserves the right not to award the contract or to amend or alter this
process in any way. Nothing in this tender process generates any
contractual rights whether relating to the process or otherwise. After the
contract is awarded, TEC reserves the right to procure any repetition
using the negotiated procedure under Regulation 14 of SI 5/2006.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: The Energy Consortium,

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: TEC will incorporate a minimum 10 calendar day standstill
period at the point that the award of contract is communicated to
tenderers in a ‘standstill letter’. Tenderers have rights to certain
information. As will be explained in the ‘standstill letter’, if certain
conditions are met, an application at this stage for certain specified
information must be met and a minimum of 3 working days notice provided
before the contract can be signed. Tenderers must raise their issues with
the contracting authority in the first instance. Certain aggrieved parties
can initiate court proceedings before the High Court, including under
Regulation 47 of the Public Contracts Regulations 2006 (SI 5/2006), but a
variety of procedural requirements and timelines must be met. The Court
has a wide range of remedies, including damages, until the contract is
signed and thereafter may award damages.
