Summary:
Republic of the Congo — Brazzaville
Service contract notice
1. Publication reference: EuropeAid/126623/D/SER/CG.
2. Procedure: International restricted invitation to tender.
3. Programme: European Development Fund.
4. Financing: Financing agreement No 9 ACP COB 21.
5. Contracting authority: L'ordonnateur national du FED, ministre d'État,
ministre du plan et de l'aménagement du territoire de la République du
Congo.
Contract specifications
6. Type of contract: Unit-price contract.
7. Contract description: The technical assistance team will support the
EDF National Authorising Officer in the Republic of the Congo for a period
of 24 months. It will work within the 'Direction des programmes avec
l'Union européenne' (DPUE) of the 'Ministère du plan et de l'aménagement
du territoire' in the Republic of the Congo. The team will work in
collaboration with the director of the DPUE, and will be responsible in
particular for capacity-building within the departments of the National
Authorising Officer. Said capacity-building will lead to better
implementation of EU resources through the improved performance of the
'Direction des programmes avec l'Union européenne' (DPUE), which will
allow it to carry out the following roles to the full:
— policy intermediary to facilitate implementation of Congo-EU cooperation
and overcome possible policy obstacles to certain initiatives,
— planning the national cooperation strategy and the national indicative
programme, through better knowledge and monitoring of development issues
and the national poverty-reduction strategy,
— awarding authority for EU-funded projects and programmes (operational,
administrative and accounting aspects).
8. Number and titles of lots: The contract has not been divided into
lots.
9. Maximum budget available: EUR 310 000.
10. Object of additional services: Subject to the availability of
funding, the contracting authority may decide, at its own discretion, to
extend the term of the project and/or its object up to a maximum amount
not exceeding the initial contract value and duration. Any contract
extension is subject to satisfactory performance by the contractor.
Conditions for participation
11. Eligibility: Participation in contract procedures is open on equal
terms to natural persons and legal entities from the ACP countries and the
Member States of the European Union who contribute to the European
Development Fund, and also to international organisations as authorised by
the instruments applicable to the programme under which the contract is
financed (see also point 30).
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, this will result in the application concerned being
automatically disqualified (in particular, the application from the whole
consortium where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Candidates invited to tender may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions.
16. Subcontracting: Subcontracting is not permitted for this contract.
17. Number of candidates invited to tender: A minimum of 4 and a maximum
of 8 candidates will be invited to submit detailed tenders for this
contract, depending on the applications received.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 30.6.2008.
19. Provisional start date for the contract: 15.11.2008.
20. Initial contract length, and possible extension: Initially, the
contract will run for 24 months. However, subject to the availability of
funding, the contracting authority may decide, at its own discretion, to
extend the term of the project and/or its object up to a maximum amount
not exceeding the initial contract value and duration. Any contract
extension is subject to satisfactory performance by the contractor.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
(1) Candidates' economic and financial capacity (based on point 3 of the
application form): candidates' average annual turnover must exceed EUR 100
000 and cash and cash equivalents at the beginning and end of the
financial year must be in surplus, overall.
(2) Candidates' professional capacity (based on points 4 and 5 of the
application form):
2.a) at least 1 member of candidates' permanent staff must have
implemented a project in the field to support the EDF National Authorising
Officer over the past 3 years;
2.b) at least 1 member of candidates' permanent staff holds a masters
degree (Bac+4) from a university or a 'grande école' (higher education
establishment) in management or an equivalent field. A copy of the degree
certificate must be enclosed with the application form.
(3) Candidates' technical capacity (based on points 5 and 6 of the
application form):
candidates must have obtained good results in the past 10 years for at
least 2 projects with a budget that equalled or exceeded the budget for
this contract and where the fields involved were connected with this
contract (i.e.: administrative, financial and accounting management of
development cooperation projects financed by the European Development Fund
or the general budget of the European Communities).
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. Such
bodies, e.g. economic operators' parent companies, must observe the same
eligibility rules, notably regarding nationality, as the economic
operators themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
tenders will need to be re-examined to determine which 8 applications for
the invitation to tender are the most suitable. Only the following factors
will be considered in the re-examination:
number of projects with a budget that equalled or exceeded the budget for
this contract and where the fields involved were connected with this
contract (i.e.: administrative, financial and accounting management of
development cooperation projects financed by the European Development Fund
or the general budget of the European Communities) for which candidates
have obtained good results in the past 10 years.
22. Award criteria: Economically most advantageous tender.
Application submission procedures
23. Final date for submission of applications: 10.6.2008 (12:00), local
time in Brazzaville.
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:
http://ec.europa.eu/europeaid/work/procedures/implementation/services/
index_fr.htm. The clauses and format of this form must be strictly adhered
to.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.
25. Procedures for dispatch of applications: Applications must be drawn
up in French and sent solely to the contracting authority:
— either by registered post (official postal service), to the following
address:
M. Bienvenu Martin Okogna — directeur, 2e ordonnateur national suppléant
du FED, ministère du plan et de l'aménagement du territoire, direction des
programmes avec l'Union européenne, Brazzaville, Republic of the Congo,
— or by bearer (express courier services in particular) with the
application delivered straight to the contracting authority, in return for
a signed and dated acknowledgement of receipt, at the following address:
M. Bienvenu Martin Okogna — directeur, 2ème ordonnateur national suppléant
du FED, ministère du plan et de l'aménagement du territoire, direction des
programmes avec l'Union européenne, Brazzaville, Republic of the Congo.
The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the application and must be
quoted in all subsequent correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of applications: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments to, or the withdrawal of, a tender must be drawn up
and sent as per the instructions given in point 23. The word
'Modification' (amendment) or 'Retrait' (withdrawal), as applicable, must
be written on the outside envelope (and on the relevant inner envelope).
27. Working language: All correspondence concerning this invitation to
tender procedure and contract must be in French.
28. Additional information: Not applicable.
29. Date of publication of the corresponding contract forecast:
12.2.2008.
30. Legal basis: Partnership Agreement signed in Cotonou on 23.6.2000, as
amended in 2005.
Decision No 2/2002 of the ACP-EC Council of Ministers published in OJ L
320 of 23.11.2002.
As this contract is financed from the balance of the 7th EDF transferred
to the 9th EDF, the eligibility and nationality rules of the 7th EDF
apply. Legal entities eligible for this contract must therefore have their
headquarters in an ACP country or EU Member State, with the following
exceptions: Austria, Finland, South Africa and Sweden, and the 12 new
Member States that have joined the EU since May 2004 (Bulgaria, Cyprus,
Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland,
Romania, Slovakia and Slovenia). The nationalities of the experts proposed
under the tenders must meet the same criterion.
