and Infrastructure, on behalf of the National Authorising Officer to the
European Development Fund (EDF), Republic of the Gambia.
Contract specifications
6. Description of the contract: The contract involves the supply and
delivery of vehicles, and supply, delivery and installation of a
generator, IT office equipment and office furniture to the National Roads
Authority, MDI Road, Kanifing, Gambia, duty unpaid (DDU delivered duty
unpaid, i.e. duty free).
The contracting authority will arrange for the necessary duty waivers and
other documents that may facilitate clearing of the goods from the air/sea
ports.
7. Number and titles of lots: 2 lots:
lot 1: supply of 3, 4-wheel drive station wagons, 7, 4-wheel drive double
cabin pick-up vehicles and 1 generator as per attached technical
specifications (Annex II);
lot 2: supply of 5 notebook computers, 7 desktop computers, 7 laser
printers, 2 laser colour printers and IT accessories, various office
furniture and equipment as per attached technical specifications (Annex
II).
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) from ACP States
and Member States of the European Union contributing to the European
Development Fund and international organisations as authorised by the
instrument applicable to the programme under which the contract is
financed (see also item 22 below). All goods supplies under this contract
must originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the supplies required in
the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 2 % of
the total amount (total of all submitted tender/lots when submitting their
tender (as an example, should tenderer A submit an offer for lot 1 and 2
being EUR 100 000 the offer for lot 1 and EUR 200 000 for lot 2, the
tender guarantee will be unique and of an amount corresponding to EUR 6
000)). This guarantee will be released to unsuccessful tenderers once the
tender procedure has been completed and to the successful tenderer(s) upon
signature of the contract by all parties. This guarantee will be called
upon if the tenderer does not fulfil all obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which has submitted the next best
compliant tender.
13. Information meeting and/or site visit: No information meeting is
planned.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of performance: Lot 1:
3 station wagons must be delivered up to 60 days of contract signature;
7 double cabin pick-ups must be delivered up to 60 days of contract
signature;
the generator must be delivered up to 60 days from contract signature.
Lot 2:
7 desktop computers must be delivered up to 45 days of contract signature;
5 notebook computers must be delivered up to 45 days of contract
signature;
7 laser printers must be delivered up to 45 days of contract signature;
2 colour printers must be delivered up to 45 days of contract signature;
office furniture must be delivered and installed up to 45 days from
contract signature.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. In the case of tenders submitted by a consortium, these
selection criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of tenderer (based on i.e. item 3 of
the tender form for a supply contract):
— the average annual turnover of the tenderer must exceed 2 times the
financial proposal of the tender.
2) Professional capacity of tenderer (based on i.e. items 4 and 5 of the
tender form for a supply contract):
— has a professional certificate appropriate to this contract such as a
valid and up to date business registration in the country in which the
company operates.
3) Technical capacity of tenderer (based on i.e. items 5 and 6 of the
tender form for a supply contract):
— the tenderer has successfully completed at least 1 contract with a
budget of at least 60 % of that of this contract in the past 5 years.
4) Compliance with technical specifications (based on i.e. Annex:
technical specifications).
An economic operator may, where appropriate and for a particular contract,
rely on the capacities of other entities, regardless of the legal nature
of the links which it has with them. It must in that case prove to the
contracting authority that it will have at its disposal the resources
necessary for performance of the contract, for example by producing an
undertaking on the part of those entities to place those resources at its
disposal. Such entities must respect the same rules of eligibility and
notably that of nationality, as the economic operator.
17. Award criteria: The sole award criterion shall be the price. The
contract will be awarded to the lowest compliant tender.
Furthermore, tenderers of ACP States who offer supplies of at least 50 %
in contract value of ACP origin shall be accorded a 15 % price preference
where tenders of equivalent economic, technical and administrative quality
are compared.
Moreover, where 2 tenders are acknowledged to be equivalent, preference
shall be given:
(a) to the tenderer of an ACP State; or
(b) if no such tender is forthcoming, to the tenderer who:
— allows for the best possible use of the physical and human resources of
the ACP States,
— offers the greatest subcontracting possibilities to ACP companies, firms
or natural persons, or
— is a consortium of natural persons, companies and firms from ACP States
and the Community.

18. How to obtain the tender dossier: The tender dossier is available

using the standard tender form for a supply contract included in the
tender dossier, whose format and instructions must be strictly observed.

19. Deadline for submission of tenders: Tenders must be received before
7.7.2008 (11:00), at the Department of State for Works, Construction and
Infrastructure, MDI Road, Kanifing, Gambia.
Any tender received after this deadline will not be considered.
20. Tender opening session: The tenders will be opened in public session
on 7.7.2008 (11:15), at the Department of State for Works, Construction
and Infrastructure, MDI Road, Kanifing, by the committee appointed for the
purpose. The committee will draw up minutes of the meeting, which will be
available on request.
21. Language of the procedure: All written communications for this tender
procedure and contract must be in English.
22. Legal basis: ACP-EC Partnership Agreement signed at Cotonou on
23.6.2000 as amended on 25.6.2005.
