SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
N26 Stage 2 Property Valuation and Agronomy Services.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Mayo County
Council, in association the National Roads Authority, require property
valuation and agronomy services in relation to the N26 Ballina to Bohola –
Stage 2 Road Scheme.
Mayo County Council have made a Compulsory Purchase Order concerned with
that section of the N26 from Mount Falcon in the townland of Tonybaun to
the N5 in the townland of Bohola. The total length of the proposed section
from Mount Falcon to the N5 is 18.9 km.
The Compulsory Purchase Order and the Environmental Impact Statement for
the N26 Ballina to Bohola – Stage 2 scheme were published in October 2007
and An Bord Pleanala's oral hearing into objections was held between the
19th and 21st February 2008.
The total area of land being acquired is approximately 189.7 Hectares,
consisting of: 159.0 Hectares of Agricultural Land, 21.1 Hectares of
Forestry, 8.1 Hectares of Roadbed, 1.4 Hectares of River and 0.08 Hectares
of Garden. One dwellinghouse is also being acquired.
Approximately 169 individual landowners will be affected. In addition
there are an estimated 21 people entitled to turbary rights. It is
intended to procure the construction of the scheme by means of a design
and build competition.
Specifically, the services may include some or all of the following, as
well as other related services:
— valuation of land and other property,
— evaluation of claims for compensation and preparation of estimates of
compensation with reference to the law relating to compulsory purchase by
local authorities in Ireland,
— evaluation of the effect of road schemes on agricultural holdings and
other properties,
— advising the client on accommodation works and matters relating to
property acquisition,
— advising the client on proposed settlements with persons entitled to
compensation in respect to compulsory purchase,
— negotiating settlements with property owners and their advisers,
— negotiations for the acquisition of land and property,
— preparation for and attendance at Property Arbitrations.

III.1) CONDITIONS RELATING TO THE CONTRACT

whom the contract is to be awarded: Where a consortium is awarded the
contract, each member of the consortium will be required to be jointly and
severally liable to the Contracting Authority.
A Consortium shall establish a sufficient legal identity to allow it to
carry on business without ambiguity under this contract. This shall
include the satisfactory assignment and resolution of Insurances,
liabilities, responsibilities etc.
