SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Norshukon Link Ferry Service.
II.1.2) Type of contract and location of works, place of delivery or of

II.1.4) Short description of the contract or purchase(s): The Norshukon
Link Ferry Service project is a joint initiative between Shetland
Development Trust, Møregruppen AS (comprising the counties and private
sector interests in Mid Norway) and ZetTrans (Shetland Transport
Partnership) (the ‘Partners’) who, along with other relevant
transport/development agencies, promote and take forward an initiative to
introduce a new RoRo ferry service for freight between Mid-Norway,
Shetland, the UK mainland and the European Continent (with transshipment
from the UK to the European Continent leg a possible option). The
Norshukon Link Ferry Service was recently promoted as a RoPax service
(i.e. passengers, cars and freight), however, the Partners, having
reconsidered the options for the service, believe that a freight RoRo
service is likely to be more viable in the short to medium term. The
medium to long term objective for the service is to increase tourism
potential in the areas served and it is a matter for bidders to decide
whether a limited capacity to carry passengers and cars is provided
without affecting the viability of the service. The voyage distances
involved and journey times suggest that a vessel operating this service
may achieve 2 full round trips/week. However, timetable/fare
structure/vessel type and port selection (which may or may not include
Shetland and/or a UK mainland port) will ultimately be matters for
bidders, subject to evaluation of their proposals in accordance with the
evaluation criteria set out in the Invitation to Tender. Proposals will be
evaluated in accordance with the evaluation criteria set out in the Marco
Polo/TEN-T Guidelines. It is anticipated that the service will be
implemented using funding through the EU Motorway of the Seas TEN-T policy
initiative and Marco Polo funding. Other funding may also be available as
anticipated in the Vademecum issued by the Commission in conjunction with
the call for proposals TEN-T 2005. Subject to the relevant EU rules on
State Aid, additional funding may also be offered by the Partners to the
winning operator, although longer term viability of the service and value
for money will be key considerations in the selection of the preferred
operator. The objective of this tender is to allow the Partners to
identify and select an operator with which to submit proposals for EU and
other funding, likely to be, but not limited to, the EU TEN-T and Marco
Polo programmes. It is anticipated that responses to this tender will be
received from consortia of shipping and transport operators. The tender
process to identify consortia with which to submit a proposal for funding
is subject to the rules governing the award of public service contracts
for Part B Services. To comply with the general principles of the EC
Treaty and the rules governing the award of State Aid, a fair and
transparent procurement process will be adopted by the Partners. This will
include a prequalification stage, call to submit tenders to those who
qualify against published criteria, followed by the selection of the
preferred operator. Following the selection of the preferred operator, the
Partners and the preferred operator will enter into a joint venture
arrangement setting out the arrangements for implementation of the ferry
service. This will set out in detail the role of each participant in
procuring the ferry service and any arrangements in relation to the
payment of State-Aid. The parties will then submit an application for
Marco Polo and TEN-T funding to finance the start-up of the service. The
Anticipated Programme is as follows (although this may be subject to
amendment): Submission of Expressions of Interest from potential operators
– until 7.01.2008 Issue of pre-qualification questionnaires – from
10.12.2007 until 7.01.2008. Submission of pre-qualification questionnaires
– 11.01.2008. Issue of Tender Documents to pre-qualified Bidders –
15.01.2008. Submission of Proposals by Bidders – 29.02.2008. Selection of
Preferred Operator and submission of Marco Polo Application – 31.03.2008.
