II.1.5) Short description of the contract or purchase(s): With a view to
the forthcoming European elections to be held in June 2009, the European
Parliament's Information Office for Germany is planning a series of events
especially aimed at first-time voters. The core feature will be a youth
hearing on Europe: school children and students will ask questions —
Members of the European Parliament and the German state parliaments will
provide answers.

II.2) Quantity or scope of the contract
II.2.1) Total quantity or scope: The European Parliament's Information
Office for Germany intends to conclude a contract for the design, running,
supervision and evaluation of 16 youth forums during the period from
mid-2008 to end-2009, starting from signature of the contract. The
contract is not renewable.
Estimated value excluding VAT:
range: EUR 240 000–EUR 320 000.

months from the award of the contract.
Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: Not applicable.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them (if applicable):
Payment of invoices: invoices are to be paid within 45 calendar days of
registration at the authorised registration department of the authorising
officer responsible; the payment date is the date on which the body's
account is actually debited. If a payment request is unacceptable, the
authorising officer shall notify the contractor to this effect within 30
calendar days of the date on which the payment request was originally
received. This notification shall contain a description as to why the
request is unacceptable. The remaining payment period shall continue from
the date on which the duly issued payment request is registered for the
first time. Under the terms of Article 3 of the Protocol on Privileges and
Immunities, the European Communities are exempt from paying all indirect
taxes. The Governments of Member States make subsequent refunds to the
European Parliament based on receipts, or grant it with direct exemption.

whom the contract is to be awarded: Not applicable.

contract is subject: No.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
exclusion criteria: potential contractors will be disqualified from taking
part in this invitation to tender if:
(a) they are bankrupt or being wound up, are having their affairs
administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of
proceedings concerning these matters, or are in any analogous situation
arising from a similar procedure provided for in national legislation or
regulations;
(b) they have been convicted of an offence concerning their professional
conduct by a judgment which has the force of res judicata;
(c) they have been guilty of grave professional misconduct proven by any
means which the contracting authority can justify;
(d) they have not fulfilled obligations relating to the payment of
social-security contributions, taxes or other duties in accordance with
the legal provisions of the country in which they reside or with those of
the country of the contracting authority or those of the country where the
contract is to be performed;
(e) they have been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) they are currently the subject of an administrative penalty from the
contracting authority either because, during a previous contract
procedure, they have furnished false information or failed to furnish the
information required, or because they have been in serious breach of
contract for failing to comply with their contractual obligations under
the European Parliament budget.
The following documents are to be submitted as proof:
(i) all tenderers should enclose with their tender a duly signed and dated
solemn declaration (Annex C to the letter of invitation to tender) in
which they affirm that they are in neither any of the situations referred
to in Articles 93 and 94 of the Financial Regulation nor the situations
referred to in points (a) to (f);
(ii) only the tenderer awarded the contract is required to submit proof
regarding the exclusion criteria under points (a) to (f), in support of
the declaration in point (i), within a deadline set by the contracting
authority prior to contract signature.
As sufficient proof that the situations in aforementioned points (a), (b)
or (e) do not apply to the tenderer awarded the contract, the contracting
authority will accept a recent extract from the judicial record or,
failing this, an equivalent certificate from a judicial or administrative
body in their country of origin or provenance showing that these
requirements have been met. As sufficient proof that the situation in the
aforementioned point (d) does not apply to the tenderer, the contracting
authority will accept a recent certificate from the appropriate body in
the country concerned. Where the certificate referred to in point (i) is
not issued in the country concerned, and if the other aforementioned
exclusion cases apply, it may be replaced by an affidavit or a solemn
declaration made by the tenderer concerned before an appropriate judicial
or administrative body, a notary or a qualified professional body in their
country of origin or provenance. (Annex C to the invitation to tender can
be used for this);
(iii) depending on the national legislation of the country in which the
tenderer resides, the documents referred to in point (i) relate to legal
entities and/or natural persons, including, where considered necessary by
the contracting authority, company directors or any person with powers of
representation, decision-making or control in relation to the tenderer;
(iv) the contracting authority can exempt a tenderer from having to submit
such proof, if it has already been submitted for another award procedure,
provided that the documents were issued less than 1 year ago and are still
valid. In this case the tenderer shall affirm, in a solemn declaration,
that such proof has been submitted for a previous award procedure and that
no changes have occurred in his situation.
Award of contract: tenderers will be excluded from the contract award
procedure if they are in the following situations:
— they are subject to a conflict of interests,
— in supplying the information required by the contracting authority as a
condition of participation in the invitation to tender procedure they
supply false information or fail to supply the information required,
— they are in any of the exclusion situations referred to in points (a) to
(f) of this award procedure.
Professional capacity:
(a) name, address, telephone and fax numbers;
(b) legal form;
(c) VAT number;
(d) bank details, including IBAN/BIC codes. For legal entities, the
following additional information or evidence must be submitted:
(e) full names of the people with managerial roles;
(f) commercial licences and/or permits in accordance with the statutory
provisions of the Member State where the tenderer resides.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating whether requirements have been met:
(a) the tenderer must submit a bank reference attesting to the financial
capacity of the company/institution or evidence of professional risk
indemnity insurance. The bank reference and evidence of professional risk
indemnity insurance may be replaced with balance sheets or summaries
thereof for the past 3 financial years for which accounts have been
closed. If this is not possible since the company/institution was founded
less than 3 years ago, the appropriate evidence since the formation of the
company/institution must be submitted;
(b) the tenderer must provide a statement as to overall turnover and
turnover generated in the field of activity relevant to the contract in
the past 3 financial years. If this is not possible since the
company/institution was founded less than 3 years ago, the appropriate
statement must cover the period since the formation of the
company/institution.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met:
(a) brief profile of the company/institution, with details of the number
of permanent and external staff. Minimum number of staff required: 2
full-time staff;
(b) proof of suitability of the staff entrusted with the project: provided
in the form of CVs and certificates/documents. Evidence that the assigned
staff speak and write German fluently must be provided. Minimum
requirement for proof of suitability: university degree and proven
experience in conveying information on European politics and in the
design, running and supervision of similar events. Proof of a similar
experience must be provided in the form of certificates or documents
attesting to participation in seminars or advanced training;
(c) precise description of the resources available to execute the
contract, particularly the available infrastructure and technical
equipment. Service providers must specify exactly which parts of the
contract they may subcontract to third parties;
(d) reference lists demonstrating the tenderer's experience of similar
series of events. This comprises contracts of various contracting
authorities over the past 3 years which are similar to the contract to be
awarded. The value, execution period and location of the contract must be
specified.
