Training will occur at sites within the Greater Perth-Andover geographic area or
in
consultation with NBCC.

This is a tender notice only. In order to submit a bid, you must obtain official
tender documents from the New Brunswick Opportunities Network, another authorized
tendering service or as indicated in the tender notice.

A bidder must obtain official bid documents from a distribution service, authorized
by the Minister of Supply and Services, in order to submit a bid. The current
authorized distribution services are the New Brunswick Opportunities Network
(NBON) (operated by the Department of Supply and Services, Province of NB),
BIDS (operated by Tender Publications Ltd.) and MERX (operated by
Mediagrif Interactive Technologies). Failure to submit the official bid documents
or provide
proof that the official bid documents were properly obtained will result in
rejection of the bid. In order to facilitate the evaluation process, Bidders are
requested to respond in the same format as the official bid documents.

For procurements which are not subject to the provisions of one or more of the
interprovincial procurement agreements, the Province of New Brunswick reserves
the right to apply Provincial or regional Preferences, consider local content in
the evaluation of bids and/or refuse to consider bids from vendors from other
jurisdictions when it is considered to be in the best interests of the Province.
When determining the use of these conditions, the Province will consider, among
other factors, the
extent to which New Brunswick vendors have access to equivalent procurement
opportunities in those jurisdictions and the treatment accorded by those jurisdictions
to bids from New Brunswick vendors. The Province will be the sole judge of whether
these conditions will be used and the extent to which they will be applied.

Public opening of bids will take place on closing day at 14:00 Atlantic Standard
Time,
in Marysville Place, Room 205, 20 McGloin Street, Fredericton, N.B. E3A 5T8.




All tenders must be F.O.B. destination, freight prepaid.

Sales taxes should not be included in the unit, extended or total prices.



This Invitation is being conducted under the provisions of the Public Purchasing
Act

and Regulation as of the date of the issuance of the Invitation. Bidders may
obtain a copy of the
Act and Regulation from The Queen's Printer, Province of N.B., P.O. Box 6000,
Fredericton, N.B. E3B 5H1


Unless the Central Purchasing Branch has determined otherwise prior to tender
closing, all prices must be extended and totalled.

All discounts quoted will be considered to be without limitations.

Payment of invoices is the responsibility of the department or organization to
whom the goods are shipped or services are supplied.

No right or duty, in whole or in part, of the vendor under a contract issued may
be assigned or delegated without the prior consent of the Central Purchasing Branch.

The Province of N.B. will allow government funded bodies to purchase goods or
services using long term contracts awarded as a result of an Invitation. By
submitting a bid the bidder indicates that it agrees to extend the same pricing to
government funded bodies as per the terms and specifications in the Invitation document.

Award of contracts: no contract shall be awarded and no payment shall be made to
a vendor unless authorized by the Minister or his delegates. The Minister may
make an award to the preferred vendor conditional on the negotiation and acceptance
of a detailed contract between the Province and the vendor. In such cases, should
the detailed contract negotiations not be completed in a reasonable period of
time, the Province reserves the right to discontinue negotiations with the vendor
and
subsequently enter into negotiations with the second preferred vendor.

The Atlantic Provinces Standard Terms & Conditions for Goods and Services apply
to this procurement and are considered to be incorporated into this document. By
submitting a bid, you agree and accept these terms and conditions. Current "Atlantic
Provinces Standard Terms and Conditions" are available on the New Brunswick
Opportunities Network, the Council of Atlantic Premiers' Website or from an authorized
service provider.

If, from the Invitation closing date until completion or termination of a long
term contract, the Bidder offers to any government funded body in New Brunswick
the same goods or services in similar quantities at a lower price than in the
Bid, the price to the Province for these goods or services shall be lowered by
the Bidder to this lower price for all goods or services ordered after the offer
to the third party."

        Lease of Heavy Equipment for Operation Training Program
        At:    Perth-Andover, NB
        This contract begins June 2, 2008 and ends July 11, 2008
        The following applies to this services contract:
        #    NBCC is the delivery agent for this Heavy Equipment Operation training in New
Brunswick;
        #    This will be a joint Public/Private Partnership between NBCC and the Supplier
Company;
        #    Program delivery will be in English;
        #    The total duration of this program is 7 weeks for 8 hours per day
        o    1 week classroom component begins May 26, 2008
        o    1 week of shop equipment maintenance and introductory equipment operation
begins June 2, 2008
        o    5 weeks of on-site equipment operational seat time, observation time and
learning exercises with Company Coaches and NBCC Instructors begins June 9, 2008;
        #    Work schedules for the class may occur at any time during the 24 hour day in
consultation with the Supplier, NBCC and the student(s). Generally deliverable
between 6:00 am and 6:00 pm;
        #    During the on-the-job training, students observe a Supplier Company operator
/ coach performing their work at work sites;
        #    Each student performs equipment operation under the direction of an NBCC
Instructor and the Supplier Company Operator for approximately 2-3 hours per day
depending on the agreed schedule;
        #    Supplier company will / may continue scheduled contracted work and will build
student training into the regular work operation mix in consultation with the
NBCC Instructor;
        #    Training will occur at sites within the Greater Perth-Andover geographic area
or in consultation with NBCC;
        #    Work /on-the-job training may proceed as follows:
        o    Students may work on, at or near the supplier equipment yard, in a gravel /
stone pit
        o    Students may build forest road
        o    Students may grub / remove over-burden to prepare a construction site
        o    Students may dig a basement or simulated basement
        o    Students may dig a trench or simulated trench
        o    Students may move snow
        o    Students may perform any activity consistent with the normal operation of
each piece of equipment
        o    Students will use equipment consistent with the prescribed curriculum available
for viewing at NBCC through Mark Standring, NBCC Manager, (506)778-6764
        NBCC Miramichi will:
        #    Identify and select up to 12 candidates;
        #    Perform student registrations and all NBCC reports;
        #    Provide an NBCC Instructor to ensure a quality learning environment in a 'real
job' setting;
        #    Schedule all student activity in consultation with the supplier company;
        #    Perform classroom training for 5 days of the scheduled 35 days, covering:
        o    Equipment walk around inspection
        o    Equipment start-up and shut-down procedure
        o    Equipment maintenance checks for cooling system, oil, hydraulics
        o    Equipment fueling procedure
        o    OHS, Occupational Health and Safety Legislation and Regulations        
        o    WHMIS, Workplace Hazardous Materials Identification System Certification
        o    TDG, Transportation of Dangerous Goods Certification
        #    Perform all formal tests and evaluations on students at the company work site(s);
        #    Cover participants with Workers Compensation Board coverage;
        Supplier company will:
        #    Provide student access to 4 pieces of equipment (1998 models or newer) for
operation training, including:
        o    Excavator:    minimum 18 ton, 1 ¼ yard bucket, 120 HP
        o    Pay-loader:    minimum 10 ton, 3 yard bucket, 140 HP
        o    Backhoe:    minimum 8 ton, 1 ¼ yard bucket, 85 HP
        o    Bulldozer:    minimum 8 ton, 125 HP
        #    Provide heavy equipment fuels without exception;
        #    Provide heavy equipment lubricants without exception;
        #    Provide heavy equipment parts, repair and maintenance without exception;
        #    Provide all equipment movement / floating to and from sites;
        #    Identify and provide for any and all company safety policy information;
        #    Comply with NBCC policy and regulations concerning the 'no harassment policy',
coach/student integrity, and ethical conduct and honesty with students.

        In addition to the above information:
        -    The supplier company must expect students to perform at a low production rate
during week 1 of operation;
        -    The supplier company must expect students to achieve a steady increase in
production over the training period;
        -    The supplier company must expect fuel consumption to increase over the program
delivery period.
        Reservations:
        #    The delivery of this program is conditional to the identification of an
adequate number of students which translates into the required funding.

attempt to resolve the situation by speaking with the offending person or, if you
do not feel comfortable doing so, please contact     Mark Standring, Manager to permit
a Campus official to assist in the situation. All complaints of discriminatory
harassment made to NBCC will be taken seriously and appropriate action will be
taken by Campus officials to address the situation.



This procurement is subject to the provisions of the Agreement on Internal Trade,
the Atlantic Procurement Agreement and the Quebec-New Brunswick Procurement Agreement.
