Contract specifications
6. Contract description: Supply of 4 4x4 pickup trucks, 1 4x4 hardtop
vehicle and 2 spares kits (1 for the pickup and 1 for the hardtop) for the
conservation of protected areas and the fight against illegal hunting.
7. Number and titles of lots: 1 lot only: supply of 4 4x4 pickup trucks,
1 4x4 hardtop vehicle and 2 spares kits (1 for the pickup and 1 for the
hardtop).
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open,
on equal terms, to all natural persons and legal entities (irrespective of
whether they are taking part as individuals or in a grouping (consortium)
of tenderers) from the European Union Member States who contribute to the
9th EDF, and from the ACP countries and territories, and it is also open
to international organisations (see also point 22). Owing to the specific
nature of the goods required, dispensation from the rule of origin has
been granted for this invitation to tender. As a result, no restriction as
to the origin of the goods is envisaged.
9. Grounds for exclusion: Tenderers must sign and submit the declaration,
included with the tender form for a supplies contract, confirming that
they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers cannot submit more than 1 tender for the
lot.
Tenders for part of a lot will not be considered. Tenderers may state in
their tender whether they would grant a discount should they be awarded
the lot.
Tenderers cannot submit a variant tender in addition to their tender for
the goods required in the invitation to tender dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee to the
value of XAF 1 000 000, or its equivalent in euro, when they submit their
tender. This guarantee will be returned to unsuccessful tenderers once the
invitation to tender procedure has been completed and to the successful
tenderer after the contract has been signed by all parties. This guarantee
will be drawn on if the tenderer does not honour all the obligations
stipulated in the invitation to tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The tenderer will have 30 days, from the date on which he receives
the contract signed by the contracting authority, in which to furnish the
bond along with the countersigned contract.
If the successful tenderer does not furnish the bond within the time
allowed, the contract will be rendered void and a new contract may then be
drawn up and sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: There are no plans for a briefing.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: 120 days from the date of contract signature.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
(1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
— their average annual turnover must be more than 5 times the price quoted
in their tender. As proof thereof, tenderers must enclose with their
tender the documentation showing their financial situation and in
particular financial statements for the past 3 years which have been
certified by authorised experts.
(2) Tenderers' professional capacity (based on points 4 and 5 of the
tender form for a supplies contract):
— commercial warranty offered for the vehicles: tenderers must include in
their tender a description of the commercial warranty offered on the
vehicles, in accordance with Article 11.3.a) of the instructions to
tenderers and Article 40 of the special conditions. This description must
include information on arrangements made for carrying out repairs in the
Central African Republic, in the event of breakdowns or faulty parts
covered by this warranty.
(3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
— they must have carried out a similar supplies contract for the same
value or more during the past 3 years.
The potential successful tenderer may be required to produce a copy of the
final acceptance certificate for these vehicles at the time contract award
is announced.
17. Award criteria: Price and delivery time.

18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier is available from the following web address:
http://ec.europa.eu/europeaid/cgi/frame12.pl. It is also available from
the head of section 'ZCV ECOFAC phase IV'. The standard tender form must
be used to draw up tenders. This form can be found in the invitation to
tender dossier, and its clauses and format must be strictly adhered to.

tenders, given in point 19, and the contracting authority must reply at

19. Final date for submission of tenders: 16.6.2008 (10:00), local time.
Tenders received after this deadline will not be considered.
20. Tender opening session: 16.6.2008 (11:00), local time.
21. Language for the procedure: French must be used for all
correspondence concerning this invitation to tender.
22. Legal basis: ACP-EC Cotonou Agreement signed on 23.6.2000, as amended
in 2005.
