Contract specifications
6. Nature of the contract: Fixed price.
7. Contract description: To carry out a study on the socio-economic
impact of anti-personnel mines (APM), improvised explosive devices (IED),
and unexploded ordnance (UXO) in Colombia, in order to provide:
(a) information on the socio-economic impact of APM/IED/UXO on affected
communities and classify same in order to focus on priority areas for
intervention;
(b) general information on the topography, accessibility, infrastructure,
history, and public-order situation and level of threat regarding each
affected community;
(c) information on the victims of APM/IED/UXO in affected communities and
their general behavioural patterns;
(d) indications on the scope and boundaries of dangerous areas, due to the
presence or suspected presence of APM/IED/UXO, in affected communities.
The contract performance period will run for up to 15 months. Planning and
development of activities under the contract must adhere to the standards,
principles and protocols required for their certification by the United
Nations Certification Committee.
8. Number and titles of the lots: 1 lot. Study on the socio-economic
impact of anti-personnel mines and unexploded ordnance in Colombia.
9. Maximum budget: The maximum indicative budget is EUR 800 000.
10. Any additional services: The contracting authority may, at its own
discretion, extend the duration and/or scope of the project, subject to
the availability of funds. Under no circumstances may this exceed the
duration and value of the initial contract. Any contract extension will be
subject to satisfactory performance by the contractor.
Conditions for participation
11. Eligibility criteria: Participation is open to all legal entities
established in the EU Member States or the countries and territories of
the regions which fall within the scope of application of the specific
instruments applicable to the programme under which the contract is
financed, or which are authorised by said legal instruments (see point
30). International organisations may also take part. Participation of
natural persons is governed by the specific programme funding the
contract.
12. Application: Natural persons or legal entities who are eligible (see
point 11) or groupings of said parties (consortia) may take part in the
invitation to tender.
A consortium can be a permanent grouping with a legal status or an
informal grouping created for a particular invitation to tender. All the
members of a consortium (i.e. lead tenderer and all other members) are to
be jointly and severally liable vis-à-vis the contracting authority.
Should a natural person or legal entity take part who does not meet the
eligibility criteria (see point 11), this will result in the party
concerned being automatically disqualified. Furthermore, should said party
belong to a consortium then the whole consortium will be disqualified.
13. Number of applications: Natural persons and legal entities are only
able to submit 1 application, irrespective of the form their participation
may take (as a single legal entity, or as lead tenderer or member of a
candidate consortium). Should a natural person or legal entity submit more
than 1 application, all the applications involving said party will be
rejected.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Shortlisted candidates may not form alliances or subcontract to each other
for the contract.
15. Grounds for exclusion: Candidates must enclose with their
application form a signed statement confirming that they are not in any of
the situations listed in section 2.3.3 of the Practical Guide to contract
procedures for EC external actions. This statement forms part of the
application form.
16. Subcontracting: Subcontracting is permitted, however it must not
exceed 40 % of the contract value.
17. Number of shortlisted candidates: Between 4 and 8 candidates will be
invited to submit detailed tenders for this contract, depending on the
applications received. If the number of eligible candidates meeting the
selection criteria is less than the minimum of 4, the contracting
authority may invite these candidates to submit a tender. If more than 8
applications prove to be eligible, i.e. meet all the selection criteria,
then the merits of the applications from these candidates will need to be
re-examined so as to determine which 8 applications for the invitation to
tender are the most suitable, in accordance with the criteria given in
point 21.
Provisional timetable
18. Provisional date for the invitation to tender: 23.6.2008.
19. Provisional date for commencing the contract: 3.9.2008.
20. Initial contract length, and possible extension: Contract duration:
15 months. Possible extension: 15 months.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
(1) Candidates' economic and financial capacity (based on section 3 of the
application form):
(a) candidates' average annual turnover for the past 2 years (2006, 2007),
converted into euro, must be at least equal to the estimated budget for
this contract;
(b) figures for cash and cash equivalents at the end of the past 3 years
must have been positive.
(2) Candidates' professional capacity (based on sections 4 and 5 of the
application form):
(a) there must have been on average at least 80 people on candidates'
staff in the past 3 years (2005, 2006, 2007);
(b) of the 80 staff members required under point (2)(a), at least 15 % (12
people) must be working on a permanent basis;
(c) of the 80 staff members required under point (2)(a), at least 10 % (8
people) must have worked in fields relevant to this contract.
(3) Candidates' technical capacity (based on sections 5 and 6 of the
application form):
(a) the following specialities are required, as a minimum: devising and
carrying out studies or assessments of the socio-economic impact of
landmines or in other areas;
(b) in the past 7 years, candidates must have carried out at least 3
socio-economic impact studies or assessments which have included in situ
activities and the collection and handling of data;
(c) at least 1 of the studies or assessments under (3)(b) must have had a
budget of at least 50 % of the estimated budget for this contract.
Economic operators may, if necessary and for a specific contract, make use
of the resources and capacities of other bodies irrespective of their
legal relationship. In such a case, they must provide the contracting
authority with proof that they will have the resources needed to carry out
the contract, for example, by producing a written commitment by said
bodies to make such resources available. In their capacity as economic
operators, these bodies, e.g. the parent company of the economic operator,
must comply with the eligibility and, in particular, nationality rules.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the merits of the applications from these
candidates will need to be re-examined so as to determine which 8
applications for the invitation to tender are the most suitable. Only the
following factors will be taken into account in this re-examination:
(1) highest level of experience in socio-economic impact studies or
assessments which have included in situ activities with communities;
(2) highest number of projects carried out in 2007 with a budget of at
least 50 % of the estimated budget for this contract, in accordance with
point 6 of the application form;
(3) the total budget for projects carried out in 2007, in respect of point
6 of the application form, must be no less than EUR 500 000.
22. Award criteria: Economically most advantageous tender.
Application
23. Deadline for the receipt of applications: 6.6.2008 (16:00), local
time in Bogotá, Colombia.
Applications received after this deadline will not be considered.
24. Information to be supplied and application form: Applications must
be submitted on the standard application form (available from the
following web address: http://ec.europa.eu/europeaid/work/procedures/
documents/execution/services/b3applform_es.doc). The instructions given in
this form and its format must be strictly adhered to.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.
25. Application submission procedures: Applications must be sent to the
contracting authority only, using 1 of the following methods:
— registered post (official postal service) addressed to:

— or handed in (including by courier service) to the contracting
authority, in return for a signed and dated acknowledgement of receipt, at
the following address: Luis Humberto Jiménez, Fondo Financiero de
Proyectos de Desarrollo — FONADE, Calle 26 nº 13-19 Piso 25, Bogotá,
Colombia.
The envelope containing the application must be clearly marked with the
contract title and the publication reference (see point 1). These must
also be quoted in all correspondence with the contracting authority.
Tenders submitted in any other way will not be considered.
26. Amendments to, or withdrawal of, applications: Candidates may give
notice in writing before the deadline that they intend amending or
withdrawing their application. Applications cannot be amended once the
deadline for the receipt of applications has passed.
Notice of amendments to, or withdrawal of, applications must be sent as
per the instructions given in point 25. The word 'Modificación'
(amendment) or 'Retirada' (withdrawal), as applicable, must be written
clearly on the outside envelope (and where an amendment is involved, on
the inside envelope too).
27. Working language: All correspondence regarding this invitation to
tender procedure must be in Spanish.
