SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-Chichester: former Roussillon barracks site - developer selection.

Realisation, by whatever means of work, corresponding to the requirements
specified by the contracting authorities.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): English
Partnerships is seeking to appoint a development partner or development
consortium or separate development partners (all options referred to in
the rest of this OJEU Contract Notice as "development partner(s)") for the
development of the former Roussillon Barracks site in Chichester, through
a competitive dialogue procurement process.
This is an exciting potential development which is envisaged to provide
the opportunity for the creation of a mainly residential development with
a sustainable approach to regeneration. Please note that Chichester
District Council has allocated (in its draft Supplementary Planning
Document, March 2008) the site primarily for housing with a possible
element of community use, including but not limited to, residential
care/retirement home, sheltered accommodation or retirement "living". The
site is approximately 17.07 acres (6.91 hectares) with a developable area
of up to 14 acres (5.67 hectares). The location provides excellent
communications by both road and rail to Worthing, Brighton, London and
Portsmouth. There are a number of buildings on site of varying ages dating
from the late 1800s to 1990s, none of which are listed.
English Partnerships anticipate that it will dispose of the entire site to
the selected development partner(s) by means of a building licence ("the
purchase"). The transfer of interests in the land will be more fully
discussed during the competitive dialogue process.
As such English Partnerships reserves the right, amongst other options,
to:
— Dispose of the site to a single development partner who will develop the
entire site,
— Dispose of the site to a single development partner or developer
consortium who will then divide the site into parts for development by the
single development partner, members of the developer consortium or
sub-contractors or,
— Dispose of separate parts of the site to separate developers who will
then develop their respective parts of the site by themselves or via
sub-contractors.
These options, and others proposed by the bidders, will be more fully
discussed during the competitive dialogue procedure. This will involve
agreeing with English Partnerships a plan for the phasing/division of the
site.
It is also envisaged that the development partner(s) will set up (a)
management structure(s) to deal with the short to long term governance and
management of the site (or parts thereof), the details of which will be
fully discussed during the competitive dialogue procedure.
English Partnerships anticipates that the development partner(s) will fund
the purchase and the development of the site, or parts thereof, with their
own funds. Developer profit is expected to be realised by sale, or
otherwise, of the developed units to private parties, subject to some form
of financial clawback to English Partnerships based upon the value of the
developed site, or parts thereof, such as overage.
Expressions of interest are sought from developers who may be expected to
demonstrate that they are capable of delivering an imaginative and
sustainable development on this site. The development partner(s) will be
required to deliver a high quality development which may be required to
adopt all of the English Partnership's design and quality standards for
new build. It is anticipated that the successful development partner(s)
may also be responsible for some or all of the following (to be fully
discussed during the competitive dialogue procedure):
— Working with a team of sub-contractors, registered social landlords,
retirement "living", sheltered accommodation and/or care/retirement home
providers or similar who English Partnerships will expect the development
partner(s) to identify/appoint during the competitive dialogue process(if
not already part of a developer consortium),
— Jointly preparing a quality masterplan for the former barracks site with
English Partnerships,
— Promoting a sustainable development utilising renewable energy,
— Engaging with the key stakeholders in a process of community planning
and consultation,
— Submitting a joint planning application with English Partnerships,
— Securing planning permission in line with the masterplan,
— Negotiating and completing a Section 106 agreement with Chichester
District Council and West Sussex County Council (as appropriate) and,
— In addition to Chichester District Council's requirement for 40 %
affordable housing, the selected development partner(s) may be expected to
provide 10 % FTBI or such other similarly promoted units.
Development partner(s), bidding separately or as a consortium, must
satisfy the requirements set out in the pre-qualification questionnaire to
progress to the competitive dialogue stage. For example, they must: be
able to construct a residential/retirement, sheltered accommodation,
retirement "living" accommodation or similar accommodation; or have the
ability to procure, or demonstrate previous experience of having procured,
the sub-contracting of the construction of such accommodation.
It is currently envisaged that the development partner(s) may be selected
on the basis of award criteria including compliance with English
Partnership's Quality and Price Standards and Level 4 of the Code for
Sustainable Homes.
A limited number of parties (currently envisaged as a minimum of 4) will
be selected to enter into competitive dialogue with English Partnerships.

Brochure which is available upon request to the contact points set out in
Section I.1 to this contract notice.
Interested parties should be aware that the above short description of the
contract opportunity is for illustrative purposes only and throughout the
procurement process, or after the preferred bidder is chosen, the
contracting authority may alter the specifications set out here, or the
description of the contract to be entered into by the preferred bidder, to
a non-material extent.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The contract involves the disposal of
the former Roussillon Barracks site to a lead developer or developer
consortium who will take on the development of the site whilst
incorporating the quality standards and requirements of English
Partnerships through a partnership process. More detailed bid requirements
will be finalised in the Stage 2 developer guidance material. The capital
construction costs are expected to be in the region of 35,000,000 GBP to
45,000,000 GBP.
Estimated value excluding VAT:
Range: between 35 000 000 and 45 000 000 GBP.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:
1.5.2009. Completion: 3.12.2015.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A parent company guarantee may

being procured using the competitive dialogue procedure, any financing
conditions and payment arrangements are very likely to be subject to
change.

whom the contract is to be awarded: In the event of a successful
consortium bid, English Partnerships may specify that the consortium takes
a particular legal form and/or require that a single consortium member
takes primary liability or that each member undertakes joint and several
liability irrespective of the legal form adopted.
Where a subsidiary company is used, the ultimate parent company may be
required to provide a guarantee in respect of the performance of the
contract by the subsidiary before acceptance.

Objective criteria for choosing the limited number of candidates:
Candidates' suitability will be checked in accordance with the following
criteria: track record and experience of delivering similar projects by
the bidder and their proposed parties / consultancy teams; technical
capacity of the bidder and financial and economic strengths of the
organisations interested in bidding for the project. Further details and
criteria are set out in the pre qualification questionnaire. The objective
criteria include those as envisaged by Regulations 23 to 25 inclusive of
the Public Contracts Regulations 2006.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: This notice is being placed as a works
procurement and it is anticipated that works award will be made. The
structure of bidders' proposals may lead to a services award being made
instead.
The stage 2/competitive dialogue evaluation criteria will be issued to
those shortlisted. There may be a requirement for the bidders to respond
on the basis of including a building developer in their development team.
There will be a requirement for bidders (i.e. themselves, or a member of
their consortium) to be able to provide a residential care/retirement
home, sheltered accommodation, retirement "living" accommodation or
similar accommodation, or be able to sub-contract the provision of such.
Furthermore EP reserves the right to invite proposals on renewable energy
as part of the evaluation process. Similarly, the selected development
partner(s) may be expected to achieve Code for Sustainable Homes Level 4.
English Partnership wishes the development of Roussillon Barracks to
include a number of homes under New Build Homebuy shared ownerships scheme
(run by the Housing Corporation and delivered by the Housing Associations)
and the First Time Buyers' Initiative (FTBI). Therefore, English
Partnership may take into account the financial offer made for the land
and the cost to English Partnership of delivering FTBI units. FTBI aims to
give more people the opportunity to own homes by increasing the supply of
affordable housing for sale. FTBI is part of the CLG's Homebuy low cost
home ownership initiative and is positioned to target key workers and
other eligible groups that have sufficient income to sustain home
ownership but are currently prevented from entering the housing market by
the prevailing demand/supply conditions. FTBI is a shared equity scheme
offering first time buyers an affordable share in a new home (minimum of
50 per cent) with English Partnership contributing to the purchase price
by way of a payment to the developer (with the first time buyer accepting
an obligation to make the repayment on re-sale of the unit). Further
details on FTBI will be made available during the competitive dialogue
process.
English Partnerships is the trading name adopted by the Urban Regeneration
Agency and the Commission for the New Towns carrying out their operations
together.
All discussions, meetings and communications will be conducted in English.
The contract will be subject to English Law.
Tenders and all supporting documents must be priced in GBP and all
payments under the contract will be made in GBP.
Requests to participate must be made by completion and return of the
Pre-qualification Questionnaire (PQQ) available from Knight Frank through
the contact details in section I.1. The PQQ is to be returned by 30th May
2008, 12 noon.
Candidates are advised that English Partnerships is subject to the Freedom
of Information Act 2000 ("the Act"). If a candidate considers that any of
the information supplied as part of this procurement procedure should not
be disclosed because of its commercial sensitivity, confidentiality or
otherwise, they must, when providing this information, clearly identify
the specific information they do not wish to be disclosed and clearly
specify the reasons for its sensitivity. English Partnerships shall take
such statements into consideration in the event that it receives a request
pursuant to the Act which relates to the information provided by the
interested party. Please note, it is not sufficient to include a statement
of confidentiality encompassing all the information provided in the
response.
The Contracting Authority shall not be responsible for any costs, charges
or expenses incurred by candidates or tenderers and accepts no liability
for any costs, charges or expenses, irrespective of the outcome of the
competition, or if the competition is cancelled or postponed.
The Contracting Authority reserves the right not to award all or any part
of this contract.
All dates and time periods specified in this notice are only provisional
and the Contracting Authority reserves the right to change these.
Section II.1.9: Variant bids will be accepted in addition to standard bids
provided that the Contracting Authority's core requirements are met.
Section II.3: It is anticipated that the contract will be signed in May
2009 and that the works (and/or services and/or supplies) will complete in
December 2015. Due to the transformational nature of the Development
Opportunity, such an estimate of duration of the contract/development
agreement is subject to change.
