Contract specifications
6. Type of contract: Unit price.
7. Contract description: The contract covers the recruitment of a support
unit (PSU) for implementing the programme as well as providing the project
with a team of experts for short-term assignments in the following fields:
(1) modernisation of the prison system;
(2) introduction of international standards governing
management/conditions of detention and prevention of repeat offending by
facilitating reintegration of prisoners into the economic and social life
of the country;
(3) humanising conditions of detention, improving the rehabilitation and
social reintegration system for prisoners;
(4) improving the running and security of penal establishments.
The contract also includes a sizeable training section.
The PSU will be formed by 5 main experts (over 15 years' experience) and
12 assistant experts (3 or more years' experience) for long-term (48
months) assignments. The main expert, head of the PSU, must have in-depth
experience in prison issues (management and organisation of penal
establishments and their environment; management of prison reforms); the
other main experts will be a training specialist, an information-system
specialist, a magistrate and an administrator/financier. The assistant
experts' profiles will be in prison management, socio-educational,
organisation, applied research, security technology and information system
fields. The experts must have a good command of French and it would be
desirable for a certain number of them (especially those responsible for
training, socio-educational facility, applied research, medical follow-up,
security) to have a good knowledge of Arabic (spoken).
The PSU shall have the support staff, equipment and means required for its
everyday running. The PSU will be tasked in particular with producing
programme-estimates and activity reports, and preparing invitation to
tender dossiers.

9. Maximum budget: EUR 7 500 000.
10. Additional services: No.
Conditions for participation
11. Eligibility: Participation in the contract is open to all legal
entities (either as individuals or as part of a grouping — consortium — of
candidates) who reside in a European Union Member State or in a country or
territory in the regions covered and/or authorised by the specific legal
provisions applicable to the programme under which the contract is
financed (see point 30). Participation is also open to Member State
government bodies and to international organisations. Participation of
natural persons is governed by the legal provision applicable to the
programme under which the contract is financed.
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, this will result in the application concerned being
automatically disqualified (in particular, the application from the whole
consortium where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Candidates invited to tender may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions.
16. Subcontracting: No.
17. Number of candidates invited to tender: On the basis of the
applications received, between 4 and 8 candidates will be invited to
submit a detailed tender for this contract. If the number of eligible
candidates who comply with the selection criteria is less than the minimum
of 4, the contracting authority may invite those candidates complying with
the criteria to tender.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 10.6.2008.
19. Provisional start date for the contract: 11.10.2008.
20. Initial contract length, and possible extension: The contract will
run for 48 months.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
1) Candidates' economic and financial capacity:
(a) candidates' average annual turnover in the past 2 years must have
exceeded EUR 7 000 000;
(b) cash and cash equivalents at the end of candidates' (and/or of the
consortium's) financial year for the past 2 financial years and forecasts
for the current financial year must be in surplus (see standard
application form; see point 24 for details of how to obtain this form).
2) Candidates' professional capacity:
(a) at least 20 % of all candidates' (and/or consortium's) permanent staff
must have worked in fields relating to government department reforms and
especially in the legal field (possibly including prison management);
(b) at least 10 % of candidates' (and/or consortium's) permanent staff
must have specific experience in legal reform support, design and
implementation of training for government departments in the legal (and,
if possible, prison) field.
3) Candidates' technical capacity:
(a) candidates must have implemented at least 1 project of an equivalent
value (EUR 5 000 000) in the past 3 years that was based around the issues
involved in legal (preferably concerning prison management) and/or police
reform;
(b) candidates must have taken part in at least 2 projects (with a value
of EUR 2 000 000 or more) in the past 5 years in the field of design and
implementation of sector-based management tools relating to legal and/or
police and/or prison reforms.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. These
entities, e.g. economic operators' parent companies, must observe the same
eligibility rules, notably regarding nationality, as the economic
operators themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
applications will need to be re-examined to determine the 8 best
applications for the invitation to tender. Only the following factors will
be considered in the re-examination:
(1) total value in EUR (candidate's share) of the projects cited in 3(a);
(2) total value in EUR (candidate's share) of the projects cited in 3(b).
22. Award criteria: Economically most advantageous tender.
Application submission procedures
23. Final date for receipt of applications: 24.5.2008 (16:00).
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:
http://ec.europa.eu/europeaid/work/procedures/index_fr.htm. The clauses
and format of this form must be strictly adhered to.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.
25. Procedures for dispatch of applications: Applications must be sent to
the contracting authority, and no other:
— either by registered post (official postal service), to the following
address:

The contract title and the contract notice number (see point 1) must be
clearly marked on the sealed envelope containing the application and must
be quoted in all subsequent correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of applications: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments to or the withdrawal of a tender must be drawn up and
sent as per the instructions given in point 25. The word 'Modification'
(amendment) or 'Retrait' (withdrawal), as applicable, must be written on
the outside envelope.
27. Working language: All correspondence concerning this invitation to
tender procedure and contract must be in French.
