6. Nature of contract: Fee-based technical assistance for the management
of the programme.
7. Contract description: The fee-based contract provides for technical
assistance to the SADC Secretariat's Trade, Industry, Finance and
Investment Directorate to ensure the proper and timely implementation of
the programme 'Support to the implementation of the SADC Protocol on
finance and investment' and the efficient use of EDF resources. The
technical assistance will consist of up to 5 long-term technical
assistants (TA) recruited under a service contract for a period of 4 years
through the restricted international tender procedure. The TAs/key experts
will be from the areas of:
(i) investment policy;
(ii) macroeconomic convergence;
(iii) analyst for Macroeconomic Monitoring, Surveillance and Performance
Unit (SADC Secretariat MSPU);
(iv) tax coordination;
(v) development finance.
One of the key experts would perform the role of team leader. The
consulting company selected to provide the long-term technical assistance
will also provide part of the short-term TA needed within the programme.
The purpose of the programme 'Support to the implementation of the SADC
Protocol on finance and investment' is to support SADC Member States in
achieving closer regional economic integration and harmonisation of the
finance and investment sectors, through the implementation of the Protocol
on finance and investment.
The following 8 programme results listed below are to be achieved.
1. Capacities both at regional and national level are strengthened to
ensure a proper implementation and domestification of the Protocol on
finance and investment.
2. National investment policies, legislation and practices drawing lessons
from international 'best practices' are harmonised.
3. Progress in macroeconomic convergence is achieved.
4. SADC Member States' tax regimes are coordinated.
5. The implementation in Member States of monetary and supervisory
policies that are more efficient, market-oriented, and harmonised with the
other Member States.
6. Progress is made toward current and capital account liberalisation.
7. Enhanced development finance institutions structure to mobilise
resources for development.
8. A harmonised framework for non-banking financial institutions
(Committee of Insurance, Securities and Non-banking financial Authorities
of SADC) and securities exchanges (Committee of Southern-African Stock
Exchanges) is developed.
All activities related to the contract must be completed by the
31.12.2012. This date represents the end of the operational phase of the
financing agreement for the project.
8. Numbers and titles of lots: The technical assistance (long- and
short-term) will be tendered in 1 lot.
9. Maximum budget: EUR 5 300 000 (long-term technical assistance
approximately EUR 3 549 000, short-term technical assistance approximately
EUR 1 659 000 — and provision for local transport and office equipment EUR
92 000). The maximum budget is inclusive of any applicable price revision
during the performance of the contract.
10. Scope for additional services: Not envisaged.
Conditions of participation
11. Eligibility: Participation is open to all legal persons of the EU
Member States and the countries and territories of the regions covered by
the programme under which the contract is financed (eligible countries,
see Annex 1) (see also point 29 below). Participation of natural persons
is directly governed by the specific instruments applicable to the
programme under which the contract is financed.
12. Candidature: All eligible natural and legal persons (as per point 11
above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a
grouping which has been constituted informally for a specific tender
procedure. All members of a consortium (i.e., the leader and all other
members) are jointly and severally liable to the contracting authority.
The participation of an ineligible natural or legal person (as per point
11) will result in the automatic exclusion of that person. In particular,
if that ineligible person belongs to a consortium, the whole consortium
will be excluded.
13. Number of applications: No more than 1 application can be submitted
by a natural or legal person whatever the form of participation (as an
individual legal entity or as leader or member of a consortium submitting
an application). In the event that a natural or legal person submits more
than 1 application, all applications in which that person has participated
will be excluded.
14. Shortlist alliances prohibited: Any tenders received from tenderers
comprising firms other than those mentioned in the shortlisted application
forms will be excluded from this restricted tender procedure. Shortlisted
candidates may not form alliances or subcontract to each other for the
contract in question.
15. Grounds for exclusion: As part of the application form, candidates
must submit a signed declaration, included in the standard application
form, to the effect that they are not in any of the exclusion situations
listed in Section 2.3.3 of the 'Practical Guide to contract procedures for
EC external actions'.
16. Subcontracting: Not allowed.
17. Number of candidates to be shortlisted: On the basis of the
applications received, at least 4 and at most 8 candidates will be invited
to submit detailed tenders for this contract.
Provisional timetable
18. Provisional date of invitation to tender: May/June 2008.
19. Provisional commencement date of the contract: October/November 2008.
20. Initial period of execution and possible extension of the contract:
The period of execution is 48 calendar months (limited to 31.12.2012,
which is the end of the operational implementation period of the project).
No extension is foreseen.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. In the case of applications submitted by a consortium,
these selection criteria will be applied to the consortium as a whole:
1) Economic and financial standing of candidate (based on item 3 of the
application form):
— the average annual turnover of the candidate must exceed EUR 300 000,
— the averages of cash and cash equivalents at the beginning and end of
year are positive.
2) Professional capacity of candidate (based on items 4 and 5 of the
application form):
— at least 5 of the staff currently working for the applicant are
permanently employed and work in a field related to 1 or more of the
fields pertinent to the project. The successful tenderer may be requested
to substantiate this requirement.
3) Technical capacity of candidate (based on items 5 and 6 of the
application form):
— the candidate should have a demonstrated track record in the
administration of technical assistance projects, together with relevant
experience of providing technical expertise in developing countries in
general and in ACP countries in particular, during the past 5 years.
Relevant experience includes (short-term and/or long-term) assistance in
areas such as macroeconomic and monetary policies; taxation; development
finance; investment policy; capital markets and regional economic
integration,
— experience in the management of international donor-funded projects,
with experience in the management and administration of EU budget or
EDF-financed programmes being preferred.
An economic operator may, where appropriate and for a particular contract,
rely on the capacities of other entities, regardless of the legal nature
of the links which it has with them. It must in that case prove to the
contracting authority that it will have at its disposal the resources
necessary for performance of the contract, for example by producing an
undertaking on the part of those entities to place those resources at its
disposal. Under the same conditions, a consortium of economic operators
may rely on the capacities of members of the consortium or of other
entities.
If more than 8 eligible candidates meet the above selection criteria, the
relative strengths and weaknesses of the applications of these candidates
must be re-examined to identify the 8 best applications for the tender
procedure. The only factors which will be taken into consideration during
this re-examination are:
1) economic and financial standing (point 3 of the application form) —
maximum 10 points;
2) permanent staff resources specialised in fields related to finance and
investment related assistance; training/capacity building (point 4 of the
application form) maximum 10 points;
3) experience in implementing international or regional technical
assistance programmes in ACP countries and the SADC region (point 6 of the
application form) — maximum 10 points;
4) experience in providing technical assistance experts for finance and
investment related programmes (point 6 of the application form) — maximum
30 points.
Application
22. Deadline for receipt of applications: 19.5.2008 (16:30), local time.
Any application received after this deadline will not be considered.
23. Application format and details to be provided: Applications must be
submitted using the standard application form (available from the
following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm), whose format and instructions must be strictly observed.
Any additional documentation (brochure, letter, etc.) sent with an
application will not be taken into consideration.
24. How applications may be submitted: Applications must be submitted in
English exclusively to the contracting authority:

The contract title and the publication reference (see point 1 above) must
be clearly marked on the envelope containing the application and must
always be mentioned in all subsequent correspondence with the contracting
authority.
Applications submitted by any other means will not be considered.
25. Alteration or withdrawal of applications: Candidates may alter or
withdraw their applications by written notification prior to the deadline
for submission of tenders. No application may be altered after this
deadline.
Any such notification of alteration or withdrawal shall be prepared and
submitted in accordance with point 25. The outer envelope (and the
relevant inner envelope) must be marked 'Alteration' or 'Withdrawal' as
appropriate.
26. Operational language: All written communications for this tender
procedure and contract must be in English.

23.6.2000 as amended on 25.6.2005.
