II.1.4) Short description of the contract or purchase(s): The Council was
seeking an organisation to be a Host for Derbyshire's Local Involvement
Network (LINk) that has experience of community engagement, involvement
and networking and has links to a wide range of organisations and
communities. The Host will be responsible for setting up the LINk and then
supporting and managing the LINk during the contract period. The LINk will
undertake the following activities:
— promoting and supporting the involvement of people in commissioning,
provision and scrutiny of local health and social care services,
— enabling people to monitor and review the commissioning and provision of
care services,
— obtaining views of people about their needs for, and their experiences
of, local health and social care services,
— making their views known to those responsible for commissioning,
providing, managing and scrutinising services.
The Host may be a single organisation, partnership or consortium. The LINk
will have its own governance structures and decision making processes.
However, it will work closely with the Council's Healthier Communities
Improvement and Scrutiny Committee by focusing on issues of concern to the
local community.

VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Derbyshire County Council will incorporate a minimum 10
calendar day standstill period at the point information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum 3 working days before the
expiry of the standstill period. Such additional information should be
required from the County Procurement Officer.
If an appeal regarding the award of the contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI2006 No. 5) provide for
aggrieved parties who have been harmed or are at a risk of harm by a
breach of the rules to take action in the High Court (England, Wales and
Northern Ireland). Any such action must be brought promptly (generally
within 3 months). Where a contract has not been entered into the Court may
order the setting aside of the award decision or order the authority to
amend any document and may award damages. If the contract has been entered
into the Court may only award damages.
