II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Advantage West
Midlands (AWM), the Regional Development Agency for teh West Midlands,
requires the sevices of a Managing Agent to manage and deliver a Centre of
Expertise for enterprise and entrepreneurship that will provide a
dedicated resource which will contribute to the development of a robust
enterprise support model forminority ethnic businesses in the region.

II.2.1) Total quantity or scope: It is anticipated that the tender
requirement for this activity will be in the range from £300 000 - £400
000 over the period of 2 years. the contract will be done on a grant in
aid basis - i.e. only cost recovery.
II.2.2) Options: No.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 24 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Any requirements for financial
bonds or collateral warranties will be stated in the contract documents.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Will be stated in
the Invitation to Tender and Contract documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: The group will be required to nominate
a lead partner with whom the Authority can contract, of form themselves
into a legal entity before the contract is awarded. Each member of the
group will be required to give an undertaking of joint and several
liability before acceptance of the contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: The
Authority will be using a Pre-Qualification Questionnaire and it will
cover: Information concerning the personal situation of the contractor,
supplier or service provider and information and formalities necessary for
the evaluation of the minimum econonic, financial and technical capacity
required. e.g. Organisation Identity - company registration details with
the relevant member state authority e.g. public limited company, or
governed by the UK Companies Act 1985 or equivalent. Provide company name,
address telephone/fax numbers, email address, web address, Authority with
whom registered and registration number and date etc.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Means of proof required:
Company audited accounts for the previous 2 years of trading. As a minimum
these should include: Bankers statements and references Profit & Loss
Account, Balance sheet signed by a Director, Auditors report signed by the
Auditor, Director's report signed by a Director or Secretary of the
Company, Notes to the accounts and Group accounts, where the Company is
part of a Group. Also provide: Cash flow statement that complies with the
Financial Reporting Standard (FRS) or equivalen: Aggregate turnover of
trhe Company and if possible a statement indiciatin approximate turnover
in respect of the services to which this contract relates: Aggregate
balance sheet total assets; Aggregate average number of employees; VAT
registration number; Length of time trading; Annual Report; Professional
Indemnity Insurance certificate.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: Company structure, including names of
Directors/partners; Description of main business activities, speciality
field(s) and experience in delivering similar projects; Capability
statement- describe track record of similar commissions in terms of
approach, technical ability and performance to quality, time and cost
constraints; provide examples of the principal services provided in the
past two years in connection with the services, including the value, dates
and recipients, public or private, of the services provided. Relevant
experience/qualifications of Directors/Partners/members of staff to be
assigned to the project; Identify any aspect/proportion of the services
that may be sub-contracted Professional resources and support facilities
available to support the delivery of the services; Details of recognised
quality and project management systems e.g. EN 29 000/ISO 9000 quality
assurance systems or equivalent; Provide details of Company policy and
operation on equal opportunities, health and safety, sustainable
development and customer management. Any other information you consider
might be useful to those assessing your potential for the contract.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Contracting Authority will incorporate a minimum 10
calendar days standstill period at the point information on the award of
the Agreement is communicated to tenderers. This period allows
unsuccessful suppliers to seek further debriefing from the Contracting
Authority before the Agreement is entered into. Applicants have 2 working
days from the notificatin of the award decision to request additional
debriefing and that information has to be provied a minimum of 3 working
days before he expiry of the standstill period. Such additional
information should be required from the contact point shown in 1.1 If an
appeal regarding the award of an Agreement has not bee successfully
resolved, the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (england, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where an Agreement has not been entered into, the Court may order
the setting aside of the award decision or orrder the Contracting
Authority to amend any document and may award damages. If an agreement has
been entered into, the Court may only award damages.
