Contract specifications
6. Description of the contract: The subject of the contract is the supply
and delivery of the following goods:
— 52 kWp of photovoltaic modules for the installation of 4 arrays with the
following generating capacities: 1 of 20 kWp, 2 of 15 kWp and 1 of 2 kWp.
Type of the photovoltaic panels: monocrystalline or polycrystalline,
— photovoltaic modules support structure,
— spare parts.
7. Number and titles of lots: There is only 1 lot.
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to natural and legal persons (participating either
individually or in a group (consortium) of tenderers) from ACP States and
Member States of the European Union contributing to the European
Development Fund and international organisations as authorized by the
instrument applicable to the programme under which the contract is
financed (see also point 22). All goods supplies under this contract must
originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical Guide to contracts procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in their tender that they would offer a discount in the event that their
tender were accepted for more than 1 lot. Tenderers may not submit a
tender for a variant solution in addition to their tender for the supplies
required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of EUR 4
000 when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if tenderers do not fulfil all
obligations stated in their tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which submitted the next-best compliant
tender.
13. Information meeting and/or site visit: No information meeting is
planned.
14. Tender validity: Tenders must remain valid for 90 days after the
deadline for submission of tenders.
15. Period of performance: Delivery period: no more than 120 days from
the date of signature of the contract by the Head of Delegation of the EC
Delegation for the Pacific.
Provisional acceptance: within 60 days of the arrival.
Final acceptance: 1 year after provisional acceptance and once the
warranty period of 1 year has expired (indicative deadline of end of
January 2010).
Selection and award criteria
16. Selection criteria: See Section 20 of the instructions to tenderers.
17. Award criteria: Price (or, if appropriate after derogation, the best
value for money which is a combination of quality of services/price).
Tendering
18. How to obtain the tender dossier: The tender dossier is available
from the following Internet address: http://ec.europa.eu/europeaid/work/
procedures/implementation/supplies/index_en.htm. The tender dossier is
also available for collection from the contracting authority. Tenders must
be submitted using the standard tender form for a supply contract included
in the tender dossier, whose format and instructions must be strictly
observed.

(mentioning the publication reference shown in point 1) at least 21 days
before the deadline for submission of tenders given in point 19. The
contracting authority must reply to all tenderers' questions at least 11
days before the deadline for submission of tenders. Eventual
clarifications to the tender dossier shall be published on the EuropeAid
web site at http://ec.europa.eu/europeaid/cgi/frame12.pl.
19. Deadline for submission of tenders: The deadline for submission of
tenders is 21.4.2008 (18:00), Fiji local time, at the address specified in
the instructions to tenderers.
Any tender received after this deadline will not be considered.
20. Tender opening session: The tender opening session is to be held on
22.4.2008 (10:00), Fiji local time, in the REP-5 Programme Management Unit
Office in Suva, Fiji.
21. Language of the procedure: All written communications for this tender
procedure and contract must be in English.
22. Legal basis: ACP–EC Partnership Agreement signed at Cotonou on
23.6.2000 as amended on 25.6.2005.
Decision No 2/2002 of the ACP–EC Council of Ministers published in OJ L
320 of 23.11.2002.
