Contract specifications
6. Description of the contract: The contract should allow purchasing for
the 4 towns mentioned in the title of the necessary equipment in order to
improve the quality, access and sustainability of essential services and
to support better environment protection at local level. The purpose is to
promote and demonstrate in the 4 middle-sized cities a comprehensive and
holistic approach on sustainable local development.
7. Number and titles of lots: 17 lots:
lot 1: water metering;
lot 2: laboratory equipment;
lot 3: pumps;
lot 4: water pipes and accessories;
lot 5: trucks and machines;
lot 6: mobile workshop;
lot 7: workshop equipment;
lot 8: electrical cables;
lot 9: miscellaneous equipment for solid waste;
lot 10: miscellaneous equipment for technical services and electronic
facilities in municipalities;
lot 11: SCADA (supervisory control and data acquisition);
lot 12: insulation;
lot 13: boilers;
lot 14: turnkey contracts;
lot 15: miscellaneous equipment for water supply;
lot 16: miscellaneous equipment for water sanitation;
lot 17: miscellaneous equipment for district heating.
Terms of participation
8. Eligibility and rules of origin: Participation is open to all legal
persons (participating either individually or in a grouping (consortium)
of tenderers) which are established in a Member State of the European
Union or in a country or territory of the regions covered and/or
authorised by the specific instruments applicable to the programme under
which the contract is financed (see point 22 below).
In particular, for the Tacis programme this covers: EU Member States;
beneficiary countries of the Tacis programme (Armenia, Azerbaijan,
Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Mongolia, Russian
Federation, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan); member
countries of the European Economic area (Iceland, Liechtenstein, and
Norway); candidate countries as recognised by the European Community
(Croatia, the former Yugoslav Republic of Macedonia, and Turkey).
All goods supplied under this contract must originate in 1 or more of
these countries.
Participation is also open to international organisations. Participation
of natural persons is directly governed by the specific instruments
applicable to the programme under which the contract is financed.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a supply contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the supplies required in
the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of:
— EUR 1 800 for lot 1,
— EUR 8 100 for lot 2,
— EUR 900 for lot 3,
— EUR 4 500 for lot 4,
— EUR 20 900 for lot 5,
— EUR 3 500 for lot 6,
— EUR 1 800 for lot 7,
— EUR 300 for lot 8,
— EUR 47 700 for lot 9,
— EUR 3 100 (three thousand and two hundred euros) for lot 10,
— EUR 2 900 for lot 11,
— EUR 4 900 for lot 12,
— EUR 7 100 (seven thousand and two hundred euros) for lot 13,
— EUR 12 700 for lot 14,
— EUR 1 800 for lot 15,
— EUR 1 500 for lot 16,
— EUR 6 500 for lot 17,
when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in the tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 6 % of the amount of the contract at
the signing of the contract. This guarantee must be provided together with
the return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the next best compliant tender.
13. Information meeting and/or site visit: Optional site visits will be
held on the following dates:
Site visit for lot 14 — Izyum: 18.3.2008 (10:00), Kiev time.
Site visit for lot 14 — Priluky: 20.3.2008 (10:00), Kiev time.

14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of implementation: For each lot, the period of implementation
will run from the date of contract signature until the provisional
acceptance of the goods.
Time-limit for delivery of the goods shall be:
within 17 weeks of contract signature by both parties for lots 1, 3, 4, 7
(items 07.01–07.03, 07.05–07.11, 07.13–07.16), 8, 9 (items 09.08,
09.09,09.11,09.12), 10 and 11;
within 26 weeks of contract signature by both parties for lots 2, 5, 6, 7
(items 07.04 and 07.12), lot 9 (items 09.03–09.07), 12, 13, 15, 16 and 17;
within 37 weeks of contract signature by both parties for lot 9 (items
09.01 and 09.02).
Time-limit for delivery, commissioning and putting into operation of the
goods shall be:
within 38 weeks of contract signature by both parties for lot 9 (item
09.10);
— within 64 weeks of contract signature by both parties for lot 14.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. If tenders are submitted by a consortium, these selection
criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of tenderer (based on i.a. item 3 of
the tender form for a supply contract):
— annual turnover of the tenderer for each of the last 2 accounting years
must exceed the financial proposal of the tender.
2) Professional capacity of tenderer (based on i.a. items 4 and 5 of the
tender form for a supply contract):
— a minimum of 7 permanent staff work in the field related to this
contract for the current year and in each of the 2 previous years.
3) Technical capacity of tenderer (based on i.a. items 5 and 6 of the
tender form for a supply contract):
— the tenderer has successfully completed in the past 3 years at least 1
contract for providing similar items to those in the present tender with a
budget not less than 50 % of the financial proposal.
An economic operator may, where appropriate and for a particular contract,
rely on the capacities of other entities, regardless of the legal nature
of the links that it has with them. It must in that case prove to the
contracting authority that it will have at its disposal the resources
necessary to perform the contract, for example by producing an undertaking
on the part of those entities to place those resources at its disposal.
Under the same conditions, a consortium of economic operators may rely on
the capacities of members of the consortium or of other entities.
17. Award criteria: Price.
The award of a contract to the successful tenderer will be subject to the
statement of endorsement being issued by the recipient (beneficiary) (see
Section 2.4.13 of the 'Practical Guide to contract procedures for EC
external actions' and Section 24 of the instructions to tenderers).
Tendering
18. How to obtain the tender dossier: The tender dossier is available
from: http://ec.europa.eu/europeaid/work/procedures/index_en.htm. The
tender dossier is also available from the contracting authority. Tenders
must be submitted using the standard tender form for a supply contract
included in the tender dossier, whose format and instructions must be
strictly observed.

before the deadline for submission of tenders in point 19. The contracting
authority must reply to all tenderers' questions at least 11 days before
the deadline for submission of tenders. Eventual clarifications to the

http://ec.europa.eu/europeaid/work/procedures/index_en.htm.
19. Deadline for submission of tenders: 18.4.2008 (10:00), Kiev time.
Any tender received after this deadline will not be considered.
