Contract specifications
6. Contract description: The aim of the contract is: the delivery,
installation, commissioning and maintenance by the successful tenderer of
2 identical inductively coupled argon plasma atomic emission spectrometers
and 1 mercury analyser for the Direction générale des études et
laboratoires (Gabon). Training is also included.
7. Number and titles of lots: There are 2 lots in the contract:
— lot 1: 2 identical inductively coupled argon plasma atomic emission
spectrometers,
— lot 2: 1 mercury analyser.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open,
on equal terms, to all natural persons and legal entities from the
European Union Member States and from the ACP countries and territories,
irrespective of whether they are taking part as individuals or in a
grouping (consortium) of tenderers (see point 21 also). All the goods
supplied under this contract must originate in these countries.
9. Grounds for exclusion: Tenderers must furnish proof that they are not
in any of the situations listed in section 2.3.3 of the Practical Guide to
contract procedures financed by the European Development Fund.
10. Number of tenders: Tenderers (including other companies considered in
law to be part of the same group, other members of the same consortium and
subcontractors) can only submit 1 tender for both lots. Tenderers may
state in their tender whether they would grant a discount should they be
awarded several lots. Tenderers cannot submit a variant tender in addition
to their tender for the supplies required in the invitation to tender
dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee for 2 %
of the tender value per lot when they submit their tender. This will be
returned to unsuccessful tenderers once the invitation to tender procedure
has been completed and to the successful tenderer(s) once the contract has
been signed by all parties. This guarantee will be drawn on if the
tenderer does not honour all the obligations stipulated in the invitation
to tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and site visit: There are no plans for a briefing or a site
visit.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Time limit for completion: Delivery within 12 weeks of the date of
notification of instructions by the EDF National Authorising Officer for
the spectrometers in lot 1 and within 30 days of the date of notification
of instructions by the EDF National Authorising Officer for the mercury
analyser in lot 2.
Selection and award criteria
16. Selection criteria: Criteria concerning tenderers' technical
capacity:
(1) at least 3 similar projects implemented over the past 3 years;
(2) quality of the maintenance proposal in terms of personnel and
logistics;
(3) competence of staff providing training (accreditation on products
supplied, etc.).
17. Award criteria: The contract will be awarded to the tenderer offering
the lowest total price for the equipment and related services; however,
quality of the services and of the company will be taken into account, in
accordance with requirements in the invitation to tender dossier.
Tender submission
18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier is available from the following web address:
http://europa.eu.int/comm/europeaid/tender/index_fr.htm. It is also
available from the contracting authority. Tenders must be drawn up in
French only using the standard submission form found in the invitation to
tender dossier. The clauses and format of this form must be strictly
adhered to.
Questions regarding this invitation to tender must be sent in writing,
quoting the publication reference in 1, to:

They must be sent at least 21 days prior to the final date for submission
of tenders, given in point 19, and the contracting authority must reply at
least 11 days prior to same final date for submission of tenders.
19. Final date for submission of tenders: 19.10.2007 (10:00), local time
in Gabon.
Tenders received after this deadline will not be considered.
20. Tender opening session: 19.10.2007 (11:00), local time in Gabon, in
the conference room of the Cellule d'appui à l'ON, Libreville, Gabon.
21. Legal basis: ACP-EC Cotonou Agreement, signed on 23.6.2000.
Decision No 2/2002 of the ACP-EC Council of Ministers of 7.10.2002
regarding the implementation of Articles 28, 29 and 30 of Annex IV to the
Cotonou Agreement and its Annex.
