Contract specifications
6. Description of the contract: The subject of the contract is the
supply, delivery, installation and commissioning by the contractor of the
following goods:
Lot 1 — 5 grid-connected PV systems in Kosrae:
This lot consists of the supply, delivery and commissioning of 5
fully-operational photovoltaic (PV) generators connected to the KUA public
grid. The total peak power to be installed is 45,25 kWp, +/- 5 %. 4
generators will be designed and implemented as rooftop installations, 1
will be installed on a structure for car park shading.
Lot 2 — 1 grid-connected PV system in Palau:
This lot consists of the supply, delivery and commissioning of a
fully-operational photovoltaic (PV) generator of 100 kWp +/- 10 %,
installed on a car park shading structure and connected to the PPUC public
grid.
7. Number and titles of lots: Lot 1 — 5 grid-connected PV systems in
Kosrae.
Lot 2 — 1 grid-connected PV system in Palau.
Tenders may be for 1 or both lots.
Terms of participation
8. Eligibility and rules of origin: Participation is open on equal terms
to all natural and legal persons (participating either individually or in
a grouping (consortium) of tenderers) of the 15 EU Member States that
contributed to the 9th EDF and all the countries and territories of the
ACP region covered by the Cotonou Agreement (see also point 21 below). All
goods supplied under this contract must originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical Guide to contract procedures financed by the 9th EDF'.
10. Number of tenders: Tenderers (including firms within the same legal
group, other members of the same consortium, and subcontractors) may
submit only 1 tender for 1 or more lots. Tenderers may not submit a tender
for a variant solution in addition to their tender for the supplies
required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 2 % of
the budget available for the contract/specify separate lots where
necessary when submitting their tender. This guarantee will be released to
unsuccessful tenderers not later than 60 days after the signing of the
contract and to the successful tenderer(s) upon signature of the contract
by all parties. This guarantee will be called upon if the tenderer does
not fulfil all obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which has submitted the next best
compliant tender.
13. Information meeting and/or site visit: No information meeting is
planned.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of execution: The delivery period for all supplies (from the
date of signature of the contract by the contractor to the delivery of the
supplies at Palau and Kosrae) is 90 days. The period of performance of the
installation, commissioning and training is 120 days from delivery of
supplies in Palau and Kosrae, or at a later date as set out by the
Supervisor or the Supervisor's representative.
Selection and award criteria
16. Selection criteria: See Section 20 of the instructions to tenderers.
17. Award criteria: Because the supply contract involves complex
services, including design, supply, installation, commissioning and
training, the award criterion will be not be the price only. Quality of
the services offered will also be taken into account.
Tendering
18. How to obtain the tender dossier: The tender dossier is available
from the following Internet address: http://europa.eu.int/comm/europeaid/
tender/index_en.htm. The tender dossier is also available for collection
from the contracting authority. Tenders must be submitted using the
standard tender form included in the tender dossier, whose format and
instructions must be strictly observed.
Tenderers may submit questions in writing to the following address up to
21 days before the deadline for submission of tenders, specifying the
publication reference and the contract title:

Any clarification of the tender dossier will be communicated
simultaneously in writing to all the tenderers at the latest 11 days
before the deadline for submission of tenders. No further clarification
will be provided after this date.
19. Deadline for submission of tenders: All tenders must be received at
the address provided above (point 18) before 29.10.2007 (16:00), Fiji
local time, by registered letter with acknowledgement of receipt or
hand-delivered against receipt signed by the REP-5 Programme Manager or
his/her representative.
Any tender received after this deadline will not be considered.
20. Tender opening session: The tenders will be opened in public session
on 30.10.2007 (10:00), Fiji local time, at the REP-5 Project Management
Unit Office in Suva by the committee appointed for the purpose. The
committee will draw up minutes of the meeting, which will be available on
request.
21. Legal basis: ACP–EC Partnership Agreement signed at Cotonou on
23.6.2000.
Decision No 2/2002 of the ACP–EC Council of Ministers published in OJ L
320 of 23.11.2002.
