Section II: Object of the contract
II.1) Description
II.1.1) Title attributed to the contract by the contracting authority:
Architectural services for the preparation of a project to construct an
office building to house the departments of the Delegation of the European
Commission in Côte d'Ivoire.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The European
Commission is planning to launch a project to construct an office building
for its delegation in Côte d'Ivoire, on a site which it owns in the Cocody
residential sector. Under this contract, the Commission wishes to hire an
architectural expert to be responsible for the reconnaissance (1st stage),
which aims to give shape to the requirements expressed and determine the
cost of construction.
The architect chosen via this procedure may, if applicable, be tasked with
carrying out other assignments relating to the detailed preliminary
design, the detailed design and the supervision of works (other stages) on
behalf of other parties involved in the project.

II.2) Quantity or scope of the contract
II.2.1) Total quantity or scope: Architectural services (study, design
and construction supervision) relating to the construction of an office
building of approximately 1 200 m² excluding communal areas, equipment
rooms and covered car park.
II.2.2) Options: Yes.
Description of these options: the contract is divided into 4 stages. The
last 3 stages (detailed preliminary design, detailed design and works
supervision) are optional.
II.3) Duration of the contract or time limit for completion: Duration: 48
months from the award of the contract.
Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: The successful tenderer will
have to provide a guarantee equivalent to 10 % of the value of the stage
to be awarded, before award can take place.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: For the first stage
of this contract, payments will be made in accordance with Article II.4 of
the European Commission's general terms and conditions for standard
service contracts.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: All the members of a candidate
grouping must comply with the non-exclusion and selection criteria and be
jointly and severally liable for performance of the contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The performance of 3 stages of the contract is subject to contractual
relationships being finalised with the other parties involved in the
project (for example a financing institution or a civil property company,
etc.).
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
A. dispatch of applications:
requests to participate must be sent in a letter posted no later than the
deadline given in point IV.3.4.
Requests to participate must be sent in a double envelope.
Both envelopes must be sealed and the inner one must be marked with both
the name of the department which it is addressed to (see previously) and
the following:
'03/2007/PR/SERV/DCE-CI — Demande de participation de (name of candidate)
— À ne pas ouvrir par le service du courrier'.
Self-seal envelopes must be sealed with sticky tape, with the sender's
signature written across the tape.
Candidates may choose to submit their written requests to participate:
(a) either by post or by courier, dispatched at the latest on the date
given in point IV.3.4, as evidenced by the postmark or the delivery
receipt, to the official address given in point I.1;
(b) or by delivery to the official address in point I.1. The full address
given in point I.1 must be written on the outer envelope. Delivery of the
request to participate will be confirmed by a dated receipt signed by an
authorised official from the aforementioned department who takes delivery
of the documents.
B. Candidates' particulars:
candidates (or each member in the case of groupings) must:
— quote the following reference in their requests to participate:

— enclose identity details (groupings shall provide separate sheets for
each member and state which is the lead company) as follows: name, legal
status, nationality, address, telephone and fax numbers, contact name and
e-mail address, VAT number, official registration number (where
applicable) and bank details,
— enclose the documents and information required under point III.2
'Conditions for participation'.
C. Legal position:
name of the country in which candidates have their head office or are
domiciled, enclosing the documents evidencing this under law in their
country of residence.
Candidates must enclose a duly signed and dated solemn declaration
certifying that they are not in any of the situations which would
disqualify them from taking part in a contract awarded by the European
Communities. The solemn declaration must take the form of the following
template, in its entirety:

(b) has not been convicted of an offence concerning professional conduct
by a judgment which has the force of res judicata;
(c) has not been guilty of grave professional misconduct proven by any
means the contracting authorities can substantiate;
(d) has fulfilled its obligations relating to the payment of
social-security contributions or taxes in accordance with the legal
provisions of its country of residence or those of the country of the
contracting authority or those of the country where the contract will be
carried out;
(e) has not been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) has not been declared to be in serious breach of contract for failure
to comply with contractual obligations, following another procurement
procedure or grant award procedure financed by the Community budget.
I am also aware that candidates or tenderers will not be considered for
contract award if, at the time of the procurement procedure, they:
1) are subject to a conflict of interests;
2) are guilty of misrepresentation in furnishing the information required
by the contracting authority in order to take part in the contract, or
have not furnished said information.

procedure under national laws or regulations,
— recent abstract of the judicial record or, failing this, an equivalent
document recently issued by an appropriate judicial or administrative body
in the country in which the tenderer resides, stating that he has not been
the subject of a judgment which has the force of res judicata for an
offence concerning his professional conduct or for fraud, corruption,
involvement in a criminal organisation or for any other illegal activity
detrimental to the Communities' financial interests,
— recent certificate issued by an appropriate body in the country in which
the tenderer resides, stating that he has fulfilled his obligations in
respect of payment of social-security contributions,
— recent certificate issued by an appropriate body in the country in which
the tenderer resides, stating that he has fulfilled his obligations in
respect of payment of taxes (direct taxes and VAT) in accordance with
legal provisions in said country.
Where no such documents or certificates are issued in the country
concerned, they may be replaced by a statement under oath, or failing
that, a solemn declaration made by the tenderer before a judicial or
administrative body, a notary or a qualified professional body in said
country.
NB: groupings of companies must furnish the necessary solemn declaration,
and supporting documents in the event they are awarded the contract, for
each individual member.
Proof of market access:
proof of enrolment on the relevant professional or trade register or proof
of legal incorporation as a company which is duly authorised, or has staff
or associates who are duly authorised, to undertake professional work in
the field to which this contract relates, in the country where the
services are to be carried out.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating whether requirements have been met:
— balance sheets for the past 3 years (for all partners involved in the
application),
— certified declarations as to overall annual turnover, and turnover
related to the services figuring in the contract, realised over the past 3
financial years,
— proof of professional insurance cover for candidates' activities in
relation to the object and the value of the contract.
Minimum level of standards required:
— for this invitation to tender, candidates must provide evidence of an
average specific annual turnover of at least EUR 75 000 over the past 3
years, failing which they risk exclusion.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met:
— indication of candidates' academic and professional qualifications (or
those of each member, should a grouping be involved) (academic
qualifications and CVs for the company's managerial staff and those people
to be responsible for the services),
— description of the work carried out during the past 5 years, with
details of the values, dates and locations involved. Satisfactory
performance and completion certificates must be furnished for the major
works described,
— statement as to candidates' average annual manpower for the past 3 years
(for each member, should a grouping be involved),
— indication of any parts of the services the candidate may intend
subcontracting (description of manpower and resources provided by the
subcontractors).
Minimum level of standards required:
— candidates must prove, by means of any appropriate document, that the
team they intend to mobilise for performance of the contract includes an
architect approved by the Ivorian authorities with at least 10 years'
professional experience (see point III.3.1),
— candidates must provide proof of having carried out at least 2
equivalent projects in the past 5 years.

III.3) Conditions specific to service contracts
III.3.1) Execution of the service is reserved for a particular
profession: Yes.
Candidates must be authorised to provide architectural services in Côte
d'Ivoire, in accordance with Ivorian law (Law No 70-488 of 3.8.1970,
establishing the Association of Architects and regulating the title and
the profession).
III.3.2) Legal entities should indicate the names and professional
qualifications of the staff responsible for execution of the service: Yes.

IV.1) Type of procedure

IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number:

Objective criteria for choosing the limited number of candidates:

— number and size of contracts described.
The aforementioned minimum number of candidates to be invited to tender
(5) will be adhered to providing that a sufficient number of candidates
meet the selection criteria.

terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.

IV.3.4;

Candidates are reminded that they must affirm that they are not in any of
