2. Procedure: International restricted tender under suspensive clause.
3. Programme: EDF.
4. Financing: This contract will be financed by 9th EDF NIP resources,
i.e. financing agreement. The tender is under suspensive clause and is
therefore subject to approval of the financing agreement and shall only
then become effective.
5. Contracting authority: Territorial Authorizing Officer for the EDF
for the Government of Aruba, Oranjestad, Aruba.

6. Nature of contract: Fee-based.
7. Contract description: The Aruba National Museum project is to be
financed under the 9th EDF contributing to the upgrading and
diversification of Aruba's tourism product. The project purpose is the
creation of a National Museum and at the same time to retain and recover
the cultural significance of the historic Ecury site, thereby
contributing to the preservation and safeguarding of Aruba's cultural
heritage for cultural, commercial, and educational use.
The project concerns the conservation and conversion of the historic
Ecury complex in Oranjestad into the National Museum of Aruba. The
supervision contract comprising of two stages: 1. supervision of
construction works; 2. post-construction services.

11. Eligibility: 11. Eligibility:
Participation is open on equal terms to all natural and legal persons of
the EU Member States prior to 1 May 2004 and the following ACP and OCT
States:

Equatorial Guinea, Kenya, Lesotho, Liberia, Madagascar, Malawi, Mali,
Mauritius, Mauritania, Mozambique, Namibia, Niger, Nigeria, Uganda,
Central African Republic, Democratic Republic of the Congo, Rwanda, Sao
Tome and Principe, Senegal, Seychelles, Sierra Leone, Somalia, Sudan,
Swaziland, Tanzania, Chad, Togo, Zambia and Zimbabwe.
Caribbean: Antigua and Barbuda, Bahamas, Barbados, Belize, Dominica,
Grenada, Guyana, Haiti, Jamaica, Dominican Republic, St Kitts and Nevis,
Saint Lucia, Saint Vincent and the Grenadines, Surinam, Trinidad and

Saint-Pierre-et-Miquelon, French Southern Territories, British Indian
Ocean Territory, Turks and Caicos, British Virgin Islands, Wallis and
Futuna Islands.
12. Candidature: All eligible natural and legal persons (as per item 11
above). Or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a
grouping which has been constituted informally for a specific tender
procedure. All members of a consortium (i.e. the leader and all other
partners) are jointly and severally liable to the contracting authority.
The participation of an ineligible natural or legal person (as per item
11) will result in the automatic exclusion of that person. In particular,
if that ineligible person belongs to a consortium, the whole consortium
will be excluded.
13. Number of applications: No more than one application can be
submitted by a natural or legal person (including legal persons within
the same legal group), whatever the form of participation (as an
individual legal entity or as leader or partner of a consortium
submitting an application). In the event that a natural or legal person
(including legal persons within the same legal group) submits more than
one application, all applications in which that person (and legal persons
within the same legal group) has participated will be excluded.
14. Short-list alliances prohibited: Any tenders received from tenderers
comprising firms other than those mentioned in the short-listed
application forms will be excluded from this restricted tender procedure.
Short-listed candidates may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: As part of the application form, candidates
must submit a statement to the effect that they are not in any of the
exclusion situations listed in Section 2.3.3 of the Practical Guide to
contract procedures financed from the EDF, available from following
internet address: http://europa.eu.int/comm/europeaid/tender/gestion/
index_en.htm.
16. Subcontracting: Since the study may require some local/regional
expertise, subcontracting of the local and/or regional firms will be
allowed. No more than 30% of the contract value which may be
subcontracted. However, subcontracting is only allowed with non-selected
firms and only on condition that the tender explicitly states that the
firm selected is the sole party contractually liable.
17. Number of candidates to be short-listed: On the basis of the
applications received, at least 4 and at most 8 candidates will be
invited to submit detailed tenders for this contract.
Provisional timetable
18. Provisional date of invitation to tender: January 2005.
19. Provisional commencement date of the contract: June 2005.
20. Initial period of execution and possible extension of the contract:
20 months.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. In the case of applications submitted by a consortium,
these selection criteria will be applied to the consortium as a whole:
1) economic and financial standing of candidate [based on item 3 of the
application form]:
the objective of this criterion is to examine whether or not the
candidate (i.e. the consortium as a whole, in the case of an application
from a consortium) is economically stable enough to perform the task in
the event that the contract is awarded to it; and has sufficient
financial stability to handle the proposed contract.
Reference criteria:
(a) the average annual turnover of the candidate must exceed 3 times the
annualised maximum budget of the contract (i.e. the maximum budget stated
in the procurement notice divided by the initial contract duration in
years, where this exceeds 1 year); and/or
(b) the averages of cash and cash equivalents at the beginning and end of
year are positive.
2) professional capacity of candidate [based on items 4 and 5 of the
application form]:
The objective of this criterion is to examine whether or not the
candidate (i.e. the consortium as a whole, in the case of an application
from a consortium) has sufficient ongoing staff resources and expertise
to be able to handle the proposed contract and real expertise in fields
related to the contract.
Reference criteria:
(a) the candidate has specific experience with the execution of contracts
of this nature and a professional certificate appropriate to this
contract, and;
(b) quality and competence of the staff within the fields of, but not
limited to, architecture and planning, cultural heritage conservation,
civil engineering, construction management;
(c) at least 4 staff currently work for the applicant in fields related
to this contract;
(d) at least 20% of all staff working for the candidate this year in
fields related to this contract are permanent.
3) technical capacity of candidate [based on items 5 and 6 of the
application form]:
the objective of this criterion is to examine whether or not the
candidate (i.e. the consortium as a whole, in the case of an application
from a consortium) has sufficient expertise and experience to be able to
handle the proposed contract.
Reference criteria:
(a) the candidate has worked successfully on at least two projects with a
budget of at least that of this contract is fields related to this
contract in the past three years, and;
(b) has previous experience in fields related to this contract in an
ACP/OCT state in the past five years.
If more than 8 eligible candidates meet the above selection criteria, the
relative strengths and weaknesses of the applications of these candidates
must be re-examined to identify the eight best applications for the
tender procedure. The only factor which will be taken into consideration
during this re-examination are:
1) quality and competence of the staff;
2) previous experience from similar assignments;
3) previous experience from the geographic area.
22. Award criteria: As specified in the tender dossier annexed to the
letter of invitation to tender which will be sent to short-listed
candidates.
Application
23. Deadline for receipt of applications: 24.1.2005, 12.00 Aruba time.
Any application received after this deadline will not be considered.
24. Application format and details to be provided: Applications must be
submitted using the standard application form (available from the
following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm ), whose format and instructions must be strictly observed.
Any application which does not observe these provisions will be
automatically eliminated. Any additional documentation (brochure, letter,
etc.) sent with an application will not be taken into consideration.
25. How applications may be submitted: Applications must be submitted in
English exclusively to the contracting authority:
- either by recorded delivery (official postal service) to: The

The contract title and the publication reference (see item 1 above) must
be clearly marked on the envelope containing the application and must
always be mentioned in all subsequent correspondence with the contracting
authority.
Applications submitted by any other means will not be considered.
26. Operational language: All written communications for this tender
procedure and contract must be in English.
27. Additional information: This tender will be launched under
suspensive clause and will therefore only come into force once the global
commitment is approved, i.e. the Financing Agreement.
28. Date of publication of contract forecast: 1 July 2004.
29. Legal basis: The contract shall be governed by the EDF General
Regulations, the General Conditions and the Procedural Rules of
Conciliation and Arbitration of Service Contracts financed by the EDF.
