Location - Eritrea Project No 9.ACP.ERY.001 Works procurement notice 1. Publication reference: EuropeAid/120067/D/W/ER 2. Procedure: Open international tender. 3. Programme: 9th European Development Fund. 4. Financing: Financing Agreement 9092/ERY. 5. Contracting authority: National Authorising Officer for EDF funds, Ministry of National Development, PO Box 257, Asmara, Eritrea, represented by the Ministry of Public Works acting as project supervisor. Contract specification 6. Description of the contract: The scope of the works is the detailed survey, construction drawings, rehabilitation and upgrading of the Nefasit-Dekemhare existing paved road (37,3 km), the construction of a new paved road (28 km) between Dekemhare and Tera Imni (currently gravelled), and the construction of the by-pass of Dekemhare (estimated length between 2,5 km and 6 km, final design to be prepared). Works include construction of 7 new bridges totalling 225 m. 7. Number and titles of lots: This tender is considered in one indivisible lot. However, the works are divided in three sections: section 1: Nefasit - Dekemhare; section 2: Dekemhare - Tera Imni; section 3: Dekemhare by-pass. Tenderers will be tendering for all sections, but must indicate in their tender the price for each section, as indicated in the bill of quantities. Terms of participation 8. Eligibility and rules of origin: Participation is open on equal terms to all natural and legal persons participating either individually or in a grouping (consortium) of tenderers of the Member States of the European Union eligible under 9th EDF (EU 15) and ACP States. All goods supplied under this contract must originate in these countries. 9. Grounds for exclusion: Tenderers must submit a statement to the effect that they are not in any of the situations listed in point 3 of the instructions to tenderers. 10. Number of tenders: Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors) may submit only one tender. Tenderers may submit a tender for a variant solution in addition to their tender for the works required in the tender dossier. 11. Tender guarantee: Tenderers must provide a tender guarantee of 1% of the tender price in euro when submitting their tender. The guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. 12. Performance guarantee: The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract. This guarantee must be provided no later than 30 days after the tenderer receives the contract signed by the contracting authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the second best admissible tender. 13. Information meeting and/or site visit: A mandatory information meeting and site visit will be held on 23-24 November 2004. Selection criteria: Tenderers shall only be considered eligible to participate if they can prove their capacity to carry out works of a similar magnitude by way of certified references by the relevant contracting authorities. 17. Award criteria: The works shall be awarded to the lowest tender, once the proposal has been judged technically responsive. Tendering 18.
