Contract specifications:
6. Object of the contract: Technical assistance to the geology and
mining sectors (institutional support).
7. Contract description: The project aims to strengthen the capacities
of those government institutions in charge of the mining sector, with
regard to both human resources and equipment. There are five sections:
1) training of managerial staff in the mining sector in Libreville and
abroad,
2) strengthening the analytical capacities of the DG Études et
Laboratoires (Laboratories and studies DG): purchase of equipment and
training in its use,
3) strengthening the IT capacities of the DG Mines et Géologie (Mines and
Geology DG): audit of current state of affairs, purchase of
hardware/software and training in its use,
4) purchase of prospecting equipment and training in its use,
5) strengthening the level of support to the mining craft industry
(carrying out a survey to give an overview, identifying appropriate
operating techniques, organising a training seminar in Libreville).
8. Number and titles of lots: Not applicable.
9. Maximum available budget: 810 000 EUR/531 325 170 XOF.
10. Any additional services: Not applicable.
Conditions for participation:
11. Eligibility: Participation in the contract is open, on equal terms,
to all natural persons and legal entities from the European Union Member
States and from the African, Caribbean and Pacific (ACP) countries
signatory to the fourth Lomé Convention as amended by the agreement
signed in Mauritius on 4 November 1995.
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other partners) shall
be jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, this will result in the application concerned being
automatically disqualified (in particular, the application from the whole
consortium where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit one application (this applies equally to all the legal entities
considered in law to be part of the same group), irrespective of the form
their participation may take (as one single legal entity or as lead
company or partner in a consortium submitting an application). Should a
natural person or legal entity submit more than one application (this
applies equally to all the legal entities considered in law to be part of
the same group), then all the applications involving said party (and all
the legal entities considered in law to be part of the same group) will
be disqualified.
14. Prohibition on associations among shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted
procedure. Candidates invited to tender cannot form an association
amongst themselves nor can they establish subcontractual relationships
for the contract in question.
15. Grounds for exclusion: Candidates must certify, in their application
form, that they are not in any of the situations cited in Section 2.3.3
of the Practical Guide to EC external aid contract procedures (available
from the following Internet address: http://europa.eu.int/comm/europeaid/
index_fr.htm).
16. Subcontracting: Subcontracting to other companies may be permitted.
Subcontracting to other companies may be permitted provided that this has
been clearly stated by the tenderer in his tender, that the subcontractor
meets both the eligibility criteria in point 2 'Eligibility for
contracts' (Decision No 2/2002 of the ACP-EC Council of Ministers of 7
October 2002, published in OJEC No 2002/911/EC on 23 November 2002) and
the conditions in point 7, 'Ethics clauses' (as above), and that the
subcontracting does not relate to an excessive proportion of the tender.
The proportion to be subcontracted must be stated in the invitation to
tender file.
17. Number of candidates invited to tender: There must be at least 4,
but no more than 8, candidates on the shortlist.
Provisional schedule for activities:
18. Scheduled date for dispatch of invitations to tender: 1 October 2004.
19. Scheduled date for commencing activities: 15 February 2005.
20. Initial contract length, and possible extension: 3,5 years.
Selection and award criteria:
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
1) Candidates' economic and financial standing [based on section 3 of the
application form]:
a) an extract from the balance sheets for the past 3 financial years;
b) turnover for the past 3 financial years;
or, failing that:
c) candidates' average annual turnover must be at least four times the
maximum amount budgeted for this contract per year (i.e. the maximum
budget stated in the contract notice divided by the initial length of the
contract in years, where this is more than one year);
d) cash and cash equivalents at the beginning and end of the financial
year must be in surplus, overall.
Candidates who meet criteria a), b), c) and d) will have an advantage.
2) Candidates' professional capacity [based on sections 4 and 5 of the
application form]:
a) international experience in airborne geophysical projects, geological
mapping and prospecting for mineral deposits in equatorial zones together
with experience of providing support to State institutions in charge of
mining for training, setting up databases and geographical information
systems;
b) at least 30% of those employees working this year in fields connected
with this contract must be on permanent contracts with the candidate;
c) % of managerial staff in candidates' average annual workforce;
d) number of international scientific publications (level A), during the
past ten years, regarding fields connected with this contract.
3) Candidates' technical capacity [based on sections 5 and 6 of the
application form]:
a) candidates must have obtained good results during the past fifteen
years for at least five projects with a budget equivalent to the budget
for this contract and where the fields involved were connected with those
in this contract;
or
b) references for the main services provided in the fields envisaged
during the past ten years.
If more than eight applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these
candidates' applications will be re-examined to determine which eight
applications are the best for the invitation to tender. Only the
following factor will be considered in the re-examination:
- whether the candidate has worked in Africa during the past three years.
If necessary, candidates will be chosen based on the number of months
they were there.
22. Award criteria: The criteria are specified in the invitation to
tender dossier appended to the letter of invitation to tender which will
be sent to shortlisted candidates.

23. Final date for submission of applications: 31.8.2004 (10.00),
Libreville local time.
Applications received after this deadline will be rejected.

Spécifications du marché
6. Objet du marché: Assistance technique géologique et minière (appui
institutionnel).
7. Description du marché: Le projet vise à renforcer les capacités des
institutions gouvernementales en charge du secteur minier, tant au niveau
des ressources humaines qu'en équipements. Il comporte cinq volets:
1) formation de cadres miniers à Libreville et à l'étranger,
2) renforcement des capacités analytiques de la DG Études et
Laboratoires: achat d'équipements et formation à leur utilisation,
3) renforcement des capacités informatiques de la DG Mines et Géologie:
audit de l'existant, achat de matériel / logiciel et formation à leur
utilisation,
4) achat d'équipements de prospection et formation à leur utilisation,
5) renforcement des capacités d'appui aux activités minières artisanales
(réalisation d'une étude de synthèse, identification de techniques
d'exploitation appropriées, tenue à Libreville d'un séminaire de
formation).

Conditions de participation
11. Éligibilité: La participation au marché est ouverte, à égalité de
conditions, à toutes les personnes physiques et morales des États membres
de l'Union européenne et des pays Afrique Caraïbes Pacifique (ACP)
signataires de la convention de Lomé IV telle que révisée par l'accord
signé à Maurice le 4 novembre 1995.
12. Candidature: Toute personne physique ou morale éligible (au sens du
point 11 ci-dessus) ou groupement de ces personnes (consortium) peut
soumettre sa candidature.
Un consortium peut être un groupement permanent doté d'un statut
juridique ou un groupement informel créé aux fins d'un appel d'offres
spécifique. Tous les membres d'un consortium (c'est-à-dire, le chef de
file et tous les autres partenaires) sont conjointement et solidairement
responsables devant le pouvoir adjudicateur.
La participation d'une personne physique ou morale inéligible (au sens du
point 11) entraînera l'élimination automatique de la candidature
concernée (notamment, de la candidature de l'ensemble du consortium, dans
le cas où cette personne ferait partie d'un consortium).
13. Nombre de candidatures: Une personne physique ou morale ne peut
soumettre plus d'une candidature (cela vaut également pour toutes les
personnes morales faisant partie du même groupe du point de vue du
droit), quelle que soit la forme de sa participation (comme entité
juridique individuelle ou comme chef de file ou partenaire d'un
consortium présentant une candidature). Dans le cas où une personne
physique ou morale soumettrait plus d'une candidature (cela vaut
également pour toutes les personnes morales faisant partie d'un même
groupe du point de vue du droit), toutes les candidatures auxquelles
cette personne participe (et toutes les personnes morales faisant partie
du même groupe du point de vue du droit) seront éliminées.
14. Interdiction des alliances entre des candidats retenus sur la liste
restreinte: Toute offre reçue de la part de soumissionnaires comprenant
des sociétés autres que celles mentionnées sur les formulaires de
candidature ayant servi à l'établissement de la liste restreinte sera
éliminée de la présente procédure restreinte. Les candidats invités à
soumissionner ne peuvent ni s'associer entre eux ni établir des relations
subcontractuelles concernant le marché en question.
15. Situations d'exclusion: Dans le formulaire de candidature, les
candidats doivent attester qu'ils ne se trouvent dans aucune des
situations visées au point 2.3.3 du Guide pratique d'attribution des
contrats d'aide extérieure de la CE (disponible à l'adresse Internet

16. Possibilités de sous-traitance: La sous-traitance avec d'autres
sociétés peut être autorisée.
La sous-traitance avec d'autres sociétés peut être autorisée à condition
d'être clairement stipulée dans l'offre par le soumissionnaire, que le
sous-traitant satisfasse aux conditions d'éligibilité prévues au point 2
"Éligibilité aux marchés" (Décision n° 2/2002 du Conseil des Ministres
ACP-CE du 7 octobre 2002, parue au JOCE n° 2002/911/CE le 23.11.2002) et
aux conditions prévues au point 7 "Clauses déontologiques" (id. sup.), et
que la sous-traitance ne représente pas une proportion excessive de
l'offre.
La proportion de sous-traitance doit être précisée dans le dossier
d'appel d'offres.
17. Nombre de candidats invités à soumissionner: Le nombre de candidats
devant composer une liste restreinte est de 4 au minimum et de 8 au
maximum.
Calendrier prévisionnel des opérations
18. Date prévue d'envoi des invitations à soumissionner: 1er octobre
2004.
19. Date prévue de commencement de l'action: 15 février 2005.
20. Durée initiale du marché et prorogation éventuelle: 3,5 ans.
Critères de sélection et d'attribution
21. Critères de sélection: Les critères de sélection suivants seront
appliqués aux candidats. Dans le cas où les candidatures seraient
soumises par un consortium, ces critères de sélection s'appliqueront au
consortium dans son ensemble:
1) Capacité économique et financière du candidat [à préciser en fonction
de la rubrique 3 du formulaire de candidature]:
a) un extrait des bilans comptables des 3 derniers exercices;
b) le chiffre d'affaires des 3 derniers exercices;
ou bien, à défaut
c) le chiffre d'affaires annuel moyen du candidat doit être au moins
quatre fois supérieur au budget annualisé maximal alloué au marché (soit
le budget maximal stipulé dans l'avis de marché divisé par la durée
initiale du marché en années, si supérieure à un an);
d) la trésorerie et les équivalents de trésorerie de début et de fin
d'exercice sont globalement, excédentaires.
Le cumul des points a), b), c) et d) sera un plus pour le candidat.
2) Capacité professionnelle du candidat [à préciser en fonction des
rubriques 4 et 5 du formulaire de candidature]:
a) expérience internationale dans les projets de géophysique aéroportée,
cartographie géologique et prospection minière en zone équatoriale ainsi
que dans l'appui aux institutions étatiques en charge des Mines pour la
formation, l'installation de bases de données et de SIG;
b) au moins 30 % de l'ensemble des effectifs du candidat travaillant
cette année dans des domaines en rapport avec le présent marché sont
permanents;
c) % de cadres par rapport à l'effectif moyen annuel du candidat;
d) nombre de publications scientifiques de niveau international (rang A),
dans les domaines en rapport avec le présent marché, depuis les dix
dernières années.
3) Capacité technique du candidat [à préciser en fonction des rubriques 5
et 6 du formulaire de candidature]:
a) le candidat a obtenu de bons résultats, au cours des quinze dernières
années, pour au moins cinq projets au budget comparable à celui du
présent marché et dans des domaines en rapport avec celui-ci;
ou
b) les références des principaux services fournis dans le domaine des
actions envisagées durant les dix dernières années.
Si le nombre de candidatures éligibles satisfaisant à l'ensemble des
critères de sélection est supérieur à huit, les atouts et faiblesses des
applications de ces candidats doivent être réexaminées pour identifier
les huit meilleures candidatures pour l'appel d'offres. Le seul élément
qui sera pris en considération dans ce réexamen est le suivant:
- que le candidat ait travaillé en Afrique ces trois dernières années. Si
nécessaire, le nombre de mois de présence départagera les candidats.
22. Critères d'attribution: Ces critères sont précisés dans le dossier
d'appel d'offres annexé à la lettre d'invitation à soumissionner qui sera
envoyée aux candidats retenus sur la liste restreinte.
Constitution de la candidature
23. Date limite de remise des candidatures: 31 août 2004 à 10.00, heure
de Libreville.
Toute candidature reçue après la date limite sera écartée.
