7. Contract description: The overall objective of this project is to
assist Hungary's accession to the EU by helping the professionals through
the educational and training programmes to familiarise and learn the
methods required for the implementation of the Water framework directive
in Hungary.
8. Numbers and titles of lots: 1 lot.
9. Maximum budget: 300 000 EUR.
10. Scope for additional services: None.
Conditions of participation
11. Eligibility: Participation is open on equal terms to all natural and
legal persons of the EU Member States, to any of the beneficiary
countries of the Phare programme and to Turkey, Malta and Cyprus.
12. Candidature: All eligible natural and legal persons (as per item 11
above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a
grouping which has been constituted informally for a specific tender
procedure. All members of a consortium (i.e. the leader and all other
partners) are jointly and severally liable to the contracting authority.
The participation of an ineligible natural or legal person (as per item
11) will result in the automatic exclusion of that person. In particular,
if that ineligible person belongs to a consortium, the whole consortium
will be excluded.
13. Number of applications: No more than one application can be
submitted by a natural or legal person (including legal persons within
the same legal group), whatever the form of participation (as an
individual legal entity or as leader or partner of a consortium
submitting an application). In the event that a natural or legal person
(including legal persons within the same legal group) submits more than
one application, all applications in which that person (and legal persons
within the same legal group) has participated will be excluded.
14. Short-list alliances prohibited: Any tenders received from tenderers
comprising firms other than those mentioned in the short-listed
application forms will be excluded from this restricted tender procedure.
Short-listed candidates may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: As part of the application form, candidates
must provide the evidence required in section 2.3.3 of the practical
guide to contract procedures financed from the general budget of the
European Communities in the context of external actions (available from
the following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm).
Candidates or tenderers will be excluded from participation in a
procurement procedure if:
(a) they are bankrupt or being wound-up, are having their affairs
administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of
proceedings concerning those matters, or are in any analogous situation
arising from a similar procedure provided for in national legislation or
regulations;
(b) they have been convicted of an offence concerning their professional
conduct by a judgment which has the force of res judicata;
(c) they have been guilty of grave professional misconduct proven by any
means which the contracting authority can justify;
(d) they have not fulfilled obligations relating to the payment of social
security contributions or the payment of taxes in accordance with the
legal provisions of the country in which they are established or with
those of the country of the contracting authority or those of the country
where the contract is to be performed;
(e) they have been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) following another procurement procedure or grant award procedure
financed by the Community budget, they have been declared to be in
serious breach of contract for failure to comply with their contractual
obligations.
The contracting authority will accept, as satisfactory evidence that the
candidate or tenderer is not in one of the situations described in (a),
(b) or (e), production of a recent extract from the judicial record or,
failing that, a recent equivalent document issued by a judicial or
administrative authority in the country of origin or provenance showing
that those requirements are satisfied. The contracting authority will
accept, as satisfactory evidence that the candidate or tenderer is not in
the situation described in (d), a recent certificate issued by the
competent authority of the Member State concerned. Where no such
certificate is issued in the country concerned, it may be replaced by a
sworn or, failing that, a solemn statement made by the interested party
before a judicial or administrative authority, a notary or a qualified
professional body in its country of origin or provenance. Depending on
the national legislation of the country in which the tenderer or
candidate is established, the above documents relate to legal persons
and/or natural persons including, where considered necessary by the
contracting authority, company directors or any person with powers of
representation, decision-making or control in relation to the candidate
or tenderer.
Candidates must supply the proof usual under the law of the country in
which they are established that they do not fall into the categories
listed above. The date on the evidence or documents provided must be no
earlier than 180 days before the deadline for submission of tenders.
Tenderers must, in addition, provide a sworn statement that their
situations have not altered in the period that has elapsed since the
evidence in question was drawn up.
Minimum acceptable proofs are the following:
company registry;
specimen signature;
certificate from the Tax and Social Security Authorities (covering
situation 'd');
statement covering the remaining situations, signed by the tenderer and
any other documents required by the national law of the tenderer.
16. Subcontracting: Subcontracting up to 30% of the contract value is
allowed.
17. Number of candidates to be short-listed: On the basis of the
applications received, at least 4 and at most 8 candidates will be
invited to submit detailed tenders for this contract.
Provisional timetable
18. Provisional date of invitation to tender: May 2004.
19. Provisional commencement date of the contract: July 2004.
20. Initial period of execution and possible extension of the contract:
The project must be completed before September 30, 2005; no extension is
foreseen.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates.
1) Economic and financial standing of candidate/consortium [based on item
3 of the application form]:
a) total annual revenue of the candidate/consortium must exceed twofold
of the maximum budget of the contract for each of the past 3 years (2001,
2002, 2003);
b) the cash and cash equivalents at the beginning and end of year of the
candidate/each member of the consortium for at least two of the past 3
years (2001, 2002, 2003) must not be negative.
2) Professional capacity of candidate/consortium [based on items 4 and 5
of the application form]:
(a) total average number of permanent staff of the candidate/consortium
must be minimum 10 for each of the past 3 years (2001, 2002, 2003); and
at least 1 person must work on fields related to Water Frame Work
Directives.
3) Technical capacity of candidate/consortium [based on items 5 and 6 of
the application form]:
(a) the candidate or at least one consortium member has participated in
the implementation of a project on the basis of WFD;
(b) candidate/consortium must have expertise in the field of training (a
minimum of 3 training references with a value of 200 000.00 EUR in the
field of environment should be indicated).
Secondary selection criteria
If more than 8 eligible candidates meet the above selection criteria, the
relative strengths and weaknesses of the applications of these candidates
must be re-examined to identify the eight best applications for the
tender procedure. The only factors which will be taken into consideration
during this re-examination are:
1. candidate/consortium possess local field experience in the
implementation of the water management;
2. experience in the implementation of the WFD in Hungary.
22. Award criteria: As specified in the tender dossier annexed to the
letter of invitation to tender, which will be sent to short-listed
candidates.
Application
23. Deadline for receipt of applications: 17 May 2004, 16:00 Central
European Time.
Any application received after this deadline will not be considered.
24. Application format and details to be provided: Applications must be
submitted using the standard application form (available from the
following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm), whose format and instructions must be strictly observed.
Any application which does not observe these provisions will be
automatically eliminated. Any additional documentation (brochure, letter,
etc.) sent with an application will not be taken into consideration.
25. How applications may be submitted: Applications must be submitted in
English exclusively to the contracting authority:

The contract title and the publication reference (see item 1 above) must
be clearly marked on the envelope containing the application and must
always be mentioned in all subsequent correspondence with the contracting
authority.
Applications submitted by any other means will not be considered.
