1. Publication reference: EuropeAid/117485/D/SV/ET 2. Procedure: International restricted tender. 3. Programme: 9th EDF: Mieso-Dire Dawa-Guelile road preparatory studies. 4. Financing: Subject to approval of a financing agreement. 5. Contracting authority: Government of the Federal Democratic Republic of Ethiopia represented by the Ethiopian Roads Authority, Addis Ababa, Ethiopia. Contract specification 6. Nature of contract: The contract concerns the provision of consultancy services to be carried out in connection with the feasibility, environmental impact assessment and detailed engineering design study, and works tender assistance services for the upgrading of the Mieso-Dire Dawa-Dewele road. 7. Contract description: An EDF financed study (7 ACP RPR 746) of the existing road connection (Arta-Yoboki-Galafi-Dobi pre-feasibility study, November 2000) has provided a comprehensive appraisal of alternative routes. The project adopts the conclusions of the aforementioned study, i.e. to develop the 'southern connection' Mieso-Dire Dawa-Guelile (387 km; 221 km rehabilitation and 156 km upgrading/new construction) as the main import/export route for Ethiopia, reducing the distance from Addis Ababa to the Port of Djibouti from the present 918 km to 765 km and providing a significant reduction in the transportation cost for the bulk of Ethiopian imports and exports. 8. Numbers and titles of lots: Not applicable. 9. Maximum budget: 1 905 000 EUR. 10. Scope for additional services: Subject to satisfactory performance, the consultant may be awarded the contract for one or several lots of the works supervision, to be financed from the separate financing agreement for works and subject to its approval. Conditions of participation 11. Eligibility: Participation in invitations to tender and in the award of contracts financed by the EDF shall be open on equal terms to: - natural persons, companies or firms or public or semi-public agencies of the States signatory to the Cotonou Agreement (ACP States and EU Member States); - cooperatives and other legal persons governed by public or by private law of the States signatory to the Cotonou Agreement (ACP States and EU Member States); - joint ventures or grouping of companies or firms of States signatory to the Cotonou Agreement (ACP States and EU Member States). This nationality rule also applies to the experts proposed by service providers taking part in tender procedures or service contract financed by the Community. 12. Candidature: All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply. A consortium may be a permanent, legally established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (i.e. the leader and all other partners) are jointly and severally liable to the contracting authority. The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded. 13. Number of applications: No more than one application can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application). In the event that a natural or legal person (including legal persons within the same legal group) submits more than one application, all applications in which that person (and legal persons within the same legal group) has participated will be excluded. 14. Short-list alliances prohibited: Any tenders received from tenderers comprising firms other than those mentioned in the short-listed application forms will be excluded from this restricted tender procedure. Short-listed candidates may not form alliances or subcontract to each other for the contract in question. 15. Grounds for exclusion: As part of the application form, candidates must provide the evidence that they do not find themselves in any of the situations mentioned in Section 2.3 of the General Regulations applicable to the European Development Fund (EDF), annexed to the Decision No 2/2002 of the Council of ACP-EC Ministers published in the OJ L 320 of 23 November 2003. 16. Subcontracting: Since the study may require some local/regional expertise, subcontracting of the local and/or regional firms will be allowed. No more than 30% of the contract value may be subcontracted, subject to approval from the contracting authority. However, subcontracting is only allowed with non-selected firms and only on condition that the tender explicitly states that the firm selected is the sole party contractually liable. 17. Number of candidates to be short-listed: On the basis of the applications received, at least 4 and at most 8 candidates will be invited to submit detailed tenders for this contract. Provisional timetable 18. Provisional date of invitation to tender: July 2004. 19. Provisional commencement date of the contract: December 2004. 20. Initial period of execution and possible extension of the contract: 33 months. Selection and award criteria 21. Selection criteria: The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole: 1) Economic and financial standing of candidate [based on item 3 of the application form]: the objective of this criterion is to examine whether or not the candidate (i.e. the consortium as a whole, in the case of an application from a consortium) is economically stable enough to perform the task in the event that the contract is awarded to it; and has sufficient financial stability to handle the proposed contract. Reference criteria: (a) the average annual turnover, excluding this contract must exceed 15 million EUR and (b) the averages of cash and cash equivalents at the beginning and end of year are positive. 2) Professional capacity of candidate [based on items 4 and 5 of the application form]: the objective of this criterion is to examine whether or not the candidate (i.e. the consortium as a whole, in the case of an application from a consortium) has sufficient ongoing staff resources and expertise to be able to handle the proposed contract and real expertise in fields related to the contract. Reference criteria: (a) at least 30 staff currently work for the applicant in fields related to this contract (15 on detailed design, EIA and feasibility studies and 15 on works supervision); and (b) at least 30% of all staff working for the candidate this year in fields related to this contract (i.e. detailed design, feasibility studies and works supervision) are permanent. 3) Technical capacity of candidate [based on items 5 and 6 of the application form]: the objective of this criterion is to examine whether or not the candidate (i.e. the consortium as a whole, in the case of an application from a consortium) has sufficient expertise and experience to be able to handle the proposed contract. Reference criteria: 1) the candidate has worked successfully on at least three (3) projects with a budget of at least that of this contract (i.e. app. 2 million EUR for detailed design, EIA and feasibility studies) in the past eight (8) years and 2) the candidate has worked successfully on at least three (3) projects with a budget of at least that of the estimated amount for the subsequent supervision (app. 7 million EUR) in the past ten (10) years and 3) the candidate has previous experience in countries outside the EU in fields related to this contract in the past three years. If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be re-examined to identify the eight best applications for the tender procedure. The criteria which will be taken into consideration during this re-examination, are: 1) previous experience from similar assignments (detailed design, EIA and feasibility studies only). In determining that, the consultant will be assessed by comparing the actual final cost and construction period of the design estimates he produced for the three (3) projects already assessed under criterion 3a. Hence variations between actual costs and periods and design estimates will be assessed as follows for each project: P = [0.6+(0.3*Fc+0.1*Ft] * A for x = ± 10% Fi=100% for ± 10% < x = ± 20% Fi=100% -0.5*(x-10) for ± 20% < x = ± 30% Fi=95% -1.0*(x-20) for ± 30% < x = ± 40% Fi=85% -1.5*(x-30) for ± 40% < x = ± 50% Fi=70% -2.0*(x-40) for ± 50% < x = ± 60% Fi=50% -2.5*(x-50) for ± 60% < x Fi=0 Where: Fi: the adjustment factor for each individual project [i.e. Fc adjustment factor for the project cost and Ft for the construction period] P: the number of points to be allocated A: the maximum number of points attributed for all projects (i.e. 100%) X: the absolute value of the percentage of variation to the reference value of the design of either the value of the project as completed or of the period of performance e.g.: X=+25%: Fi=95%-1.0*(25-20) = 90% The final adjustment factors Fc and Ft will be obtained by calculating the simple mean of the relevant Fc and Ft factors of the individual projects. In case information for these calculations is not submitted or is unavailable, the factor x will be set at 60%. 2) In the event that a further elimination is needed to obtain 8 candidates, selection will be based on the most pertinent previous experience from the geographic area. 22. Award criteria: As specified in the tender dossier annexed to the letter of invitation to tender which will be sent to short-listed candidates. Application 23. Deadline for receipt of applications: 1 July 2004 - 14.30. Any application received after this deadline will not be considered. 24. Application format and details to be provided: Applications must be submitted using the standard application form (available from the following Internet address: http://europa.eu.int/comm/europeaid/tender/ gestion/index_en.htm), whose format and instructions must be strictly observed. Any application which does not observe these provisions will be automatically eliminated. Any additional documentation (brochure, letter, etc.) sent with an application will not be taken into consideration. 25.
