SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION III.1) Conditions relating to the contract III.1.1) Deposits and guarantees required: A deposit to 30 000 GBP in the form of a cheque or a banker's guarantee is required to be paid at the time the application for the tender is submitted. III.1.2) Main terms of financing and payment and/or reference to the provisions in which these are contained: Successful tenderers will be required to finance all costs associated with providing the required service and provide an indication of the value of a one off payment to Gibtelecom for the rights on a non-exclusive basis to use their database and provide an indication of the percentage of net billed revenue derived from advertising etc. to be paid to Gibtelecom Ltd More detailed information is contained in the tender documents. III.1.3) Legal form to be taken by the grouping of suppliers, contractors or service providers to whom the contract is awarded: If the service provider is a grouping, precise information on the legal form taken by the grouping is required. III.2) Conditions for participation III.2.1) Information concerning the personal situation of the contractor, supplier or service provider and information and formalities necessary for the evaluation of the minimum capacity required: A statement outlining the qualifications of the management staff and those of persons who would be responsible for providing the service, including those of any subcontractors, together with Organizational charts identifying individual posts and their inter-relationships is required. During the last contract, the successful tenderer set up a Gibraltar Registered Company. Apart from the printing, all aspects of the production, graphics, proof reading and marketing of the Directory were handled by a team of locally employed experienced staff, either directly or by subcontracting a locally based company for the production of the website and CD ROM. This has worked well for Gibtelecom. An indication of whether the successful tenderer would run the business in Gibraltar using locally employed experienced staff or to indicate what means and how it would run the contract is required. III.2.1.1) Legal position - means of proof required: Registration of Incorporation of the Company of the Tenderer is required. III.2.1.2) Economic and financial capacity - means of proof required: A statement of accounts and turnover of the business or extracts therefrom relating to the business of the service provider including the accounts of any subcontractors where publication of the statement is required under the law of the relevant states in which the service provider and/or subcontractor is established. III.2.1.3) Technical capacity - means of proof required: A statement outlining the main characteristics of the technical equipment held by the service provider and/or any subcontractor to be employed in providing the service is required. Qualifications required: Evidence of service providers accessibility to a suitable publishing system is required furthermore the service provider must prove his compliance with applicable technical standards by furnishing: i) a certificate issued by the relevant competent authorities, attesting that the service provider and/or any subcontractor, has fulfilled his obligations relating to the payment of social security contributions and taxes under the law of the relevant state in which the service provider and/or any subcontractor is established. ii) Evidence that the tenderer has an appropriate plan to run the business in Gibraltar and an indication of whether the tenderer would run the business in Gibraltar using locally experienced staff or to indicate what means and how it would run the contract is required. iii) Evidence of previous experience of producing similar telephone directories in Gibraltar or abroad.
