6. Contract description: Work to construct the:
- DSVCo (Direction de la Santé de la Ville de Conakry - Conakry
healthcare authority): main building (R+1) and annexes,
- DCS (Direction Communale de la Santé - municipal healthcare authority)
of Ratoma in Conakry: main building and annexes.
7. Number and titles of lots: 1 lot only.
Conditions for participation:
8. Eligibility and rule of origin: Participation in the contract is
open, on equal terms, to all legal entities and natural persons from the
European Union Member States and from ACP countries and territories (see
also 21). All the goods supplied under this contract must originate in
these countries.
9. Grounds for exclusion: Tenderers must furnish proof that they are not
in any of the situations listed hereafter.
In accordance with Article 4(2) of the general regulations for contracts
financed by the EDF (1990), legal entities and natural persons may not
take part in this invitation to tender procedure nor be awarded the
contract if:
a) they are bankrupt;
b) their right to issue payments has been suspended by a judicial
decision other than an adjudication of bankruptcy which, under their
national law, entails full or partial loss of the right to administer or
dispose of their property;
c) judicial proceedings have been instituted against them that imply the
pronouncement of a decision to suspend payments and which may result in
an adjudication of bankruptcy or any other situation which, under their
national law, would entail full or partial loss of the right to
administer or dispose of their property;
d) they have been convicted of a crime, offence or transgression
concerning their professional conduct;
e) they have been guilty of misrepresentation with regard to the
information needed to take part in an invitation to tender;
f) they have failed to fulfil their contractual obligations with regard
to another contract awarded by the awarding authority.
10. Number of tenders: Tenderers (including other companies considered
in law to be part of the same group, other members of the same consortium
and subcontractors) can only submit 1 tender. Tenders for part of a lot
will not be considered. Tenderers cannot submit a variant tender in
addition to their tender for the work required in the invitation to
tender dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee for an
amount equal to 1 % of the tender value (excluding taxes and customs
duties) when they submit their tender. This will be returned to
unsuccessful tenderers once the invitation to tender procedure has been
completed and to successful tenderer(s) once the contract has been signed
by all parties. This guarantee will be drawn on if the tenderer does not
honour all the obligations stipulated in the invitation to tender.
12. Performance bond: The successful tenderer will be required to
furnish a performance bond for 10 % of the contract value (excluding
taxes and customs duties) when the contract is signed. Said bond must be
provided within 30 days of notification of contract award being received.
If the successful tenderer does not furnish the bond within the time
allowed, the contract will be rendered void and a new contract may then
be drawn up and sent to the tenderer with the second best compliant
tender.
13. Briefing and/or site visit: There are no plans for a briefing.
Tenderers must visit each construction site.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Time limit for completion: 8 months, including mobilisation period,
from the date on which the contracting authority orders work to begin,
via instructions given by the supervisor.
Selection and award criteria:
16. Selection criteria: The selection criteria can be found in the
instructions to tenderers.
17. Award criteria: Price will be the sole award criterion applied to
tenders which comply administratively and technically with requirements
in the invitation to tender dossier.

18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier can be obtained from the following address:

against payment of GNF 600 000 (not including carriage). It can also be
consulted on the contracting authority's premises. The standard tender
form enclosed with the invitation to tender dossier must be used to draw
up tenders, and the clauses and format of this form must be strictly
adhered to.
Questions regarding this invitation to tender must be sent in writing to
the following address, quoting the publication reference given in 1:

Tenders received after this time on the final date will not be considered.

Conditions de participation
8. Éligibilité et règle de l'origine: La participation au marché est
ouverte, à égalité de conditions, à toutes les personnes physiques et
morales des États membres de l'Union européenne et des pays et
territoires ACP (voir également rubrique 21 ci-après). Tous les biens
fournis dans le cadre du présent marché doivent être originaires de ces
pays.
9. Situations d'exclusion: Les soumissionnaires doivent fournir les
preuves attestant qu'ils ne se trouvent dans aucune des situations
suivantes.
Conformément à l'article 4.2 de la Réglementation générale relative aux
marchés financés par le FED (1990), ne peuvent participer à la présente
procédure d'appel d'offres ni être attributaires d'un marché, les
personnes physiques ou morales:
a) qui sont en état de faillite;
b) à l'égard desquelles les paiements ont été suspendus par une décision
judiciaire autre qu'un jugement déclaratif de faillite et entraînant,
conformément à leur droit national, la perte totale ou partielle du droit
d'administrer leurs biens ou d'en disposer;
c) contre lesquelles a été engagée une procédure judiciaire qui comporte
le prononcé d'une décision suspendant les paiements et qui peut aboutir à
une déclaration de faillite ou à toute autre situation entraînant,
conformément à leur droit national, la perte totale ou partielle du droit
d'administrer leurs biens ou d'en disposer;
d) qui ont fait l'objet d'une condamnation prononcée par un jugement
définitif pour tout crime, délit ou contravention relatif à leur
comportement professionnel;
e) qui se sont rendues coupables de fausses déclarations en ce qui
concerne les renseignements exigés pour leur participation à un appel
d'offres;
f) qui ont manqué à leurs obligations contractuelles dans l'exécution
d'un autre marché passé avec le maître d'ouvrage.
10. Nombre d'offres: Les soumissionnaires (y compris les autres sociétés
faisant partie du même groupe du point de vue du droit, les autres
membres du même consortium et les sous-traitants) peuvent soumettre
seulement une offre. Les offres ne portant que sur une partie d'un lot ne
seront pas prises en considération. Les soumissionnaires ne peuvent pas
soumettre une offre pour une variante en plus de leur offre pour les
travaux requis dans le dossier d'appel d'offres.
11. Garantie de soumission: Les soumissionnaires doivent fournir une
garantie de soumission d'un montant équivalent à 1 % du montant hors
taxes / hors douanes (HT/HD) de leur offre financière lors de la remise
de leur offre. Cette garantie sera restituée aux soumissionnaires non
retenus une fois que l'appel d'offres aura été mené à terme, et à
l'attributaire ou aux attributaires après la signature du contrat par
toutes les parties. Cette garantie sera utilisée si le soumissionnaire
n'honore pas toutes les obligations stipulées dans l'appel d'offres.
12. Garantie de bonne exécution: Il sera demandé à l'attributaire de
fournir une garantie de bonne exécution de 10 % de la valeur hors taxes /
hors douanes (HT/HD) du marché à la signature du contrat. Cette garantie
doit être fournie dans un délai de 30 jours à compter de la réception de
la notification d'attribution. Si l'attributaire ne fournit pas la
garantie requise dans le délai imparti, le contrat sera frappé de
nullité; un nouveau contrat pourra être établi et adressé au
soumissionnaire ayant présenté la deuxième meilleure offre conforme.
13. Réunion d'information et/ou visite de site: Aucune réunion
d'information n'est prévue.
Une visite de chaque site de construction est obligatoire.
14. Validité des offres: Les offres sont valables pendant une période de
90 jours à compter de la date limite de remise des offres.
15. Période d'exécution: 8 mois, y compris la période de mobilisation, à
compter de la date de démarrage des activités communiquée par le maître
d'ouvrage via un ordre de service émanant du maître d'oeuvre.
Critères de sélection et d'attribution
16. Critères de sélection: Les critères de sélection sont présentés dans
les instructions aux soumissionnaires.
17. Critères d'attribution: Le prix est le critère d'attribution unique
parmi les offres administrativement et techniquement conformes aux
prescriptions du dossier d'appel d'offres.

18. Comment obtenir le dossier d'appel d'offres: Le dossier d'appel
d'offres peut être obtenu à l'adresse suivante:

moyennant le paiement de 600 000 GNF, qui exclut les frais de port. Il
peut également être consulté dans les locaux de l'autorité contractante.
Les offres doivent être rédigées uniquement au moyen du formulaire de
soumission type inclus dans le dossier d'appel d'offres, dont les
dispositions et le format doivent être strictement respectés.
Toute question concernant le présent appel d'offres doit être adressée
