5. Contracting authority: The European Community, represented by the
Commission of the European Communities, for and on behalf of the
Government of the Republic of Kazakhstan.
Contract specification
6. Nature of contract: Fee-based.
7. Contract description: Improve the quality of the higher education
system in Kazakhstan by developing a sound and effective system of
quality assurance within Kazakhstan's higher education system, consistent
with international standards and able to meet the rapidly changing needs
of a market economy. Activities will include capacity-building in the
Ministry of Education and National Accreditation Centre to develop an
effective system of quality assurance in line with the Bologna
declaration with a view to develop criteria and methodologies of
comparison. An institutional and legal policy and implementation strategy
will be developed in order to improve quality assurance education system
for HE in line with the Bologna declaration. Finally, a new system for
the quality assurance and monitoring of HE will be developed, as well as
a new public and independent education quality control body in the HE
system.

Conditions of participation
11. Eligibility: Participation is open on equal terms to all natural and
legal persons of the EU Member States, (Austria, Belgium, Cyprus,
Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland,
Italy, Latvia, Lithuania, Luxemburg, Malta, Poland, Portugal, Slovakia,
Slovenia, Spain, Sweden, the Czech Republic, the Netherlands, the United
Kingdom and the countries and territories of the regions covered and/or
authorised by the Regulation or other specific instruments applicable to
the programme under which the contract is financed (see also point 21
below), i.e. the beneficiary countries of the Tacis programme (Armenia,
Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyz Republic, Moldova,
Mongolia, the Russian Federation, Tajikistan, Turkmenistan, Ukraine and
Uzbekistan) and of the Phare programme (Bulgaria, Romania).
12. Candidature: All eligible natural and legal persons (as per point 11
above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a
grouping which has been constituted informally for a specific tender
procedure. All members of a consortium (i.e., the leader and all other
partners) are jointly and severally liable to the contracting authority.
The participation of an ineligible natural or legal person (as per point
11) will result in the automatic exclusion of that person. In particular,
if that ineligible person belongs to a consortium, the whole consortium
will be excluded.
13. Number of applications: No more than one application can be
submitted by a natural or legal person (including legal persons within
the same legal group) whatever the form of participation (as an
individual legal entity or as leader or partner of a consortium
submitting an application). In the event that a natural or legal person
(including legal persons within the same legal group) submits more than
one application, all applications in which that person (and legal persons
within the same legal group) has participated will be excluded.
14. Shortlist alliances prohibited: Any tenders received from tenderers
comprising firms other than those mentioned in the shortlisted
application forms will be excluded from this restricted tender procedure.
Shortlisted candidates may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: As part of the application form, candidates
must submit a statement to the effect that they are not in any of the
exclusion situations listed in Section 2.3.3 of the Practical Guide to
contract procedures financed from the general budget of the European
Communities in the context of external actions (available from the
following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm).
16. Subcontracting: This will be permitted up to 5 % of the contract
value.
17. Number of candidates to be shortlisted: On the basis of the
applications received, at least 4 and at most 8 candidates will be
invited to submit detailed tenders for this contract.
Provisional timetable
18. Provisional date of invitation to tender: Early December 2005.
19. Provisional commencement date of the contract: March 2006.
20. Initial period of execution and possible extension of the contract:
18 calendar months. Extension will only be possible at the discretion of
the contracting authority and providing that activities end before
31.12.2007 (FDI).
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. In the case of applications submitted by a consortium,
these selection criteria will be applied to the consortium as a whole:
1) Economic and financial standing of candidate:
(a) the average annual turnover of the candidate must be at least
equivalent to the annualised maximum budget of the contract (i.e., the
maximum budget stated in the procurement notice divided by the initial
contract duration in years, where this exceeds 1 year); and/or
(b) the average of cash and cash equivalents at the beginning and end of
year are positive.
2) Professional capacity of candidate:
(a) The applicant must have at least 6 staff members working in fields
related to this contract. Relevant fields include: education, education
quality assurance and policy advice in the field of education.
3) Technical capacity of candidate:
The objective of this criterion is to examine whether or not the
candidate (i.e., the consortium as a whole, in the case of an application
from a consortium):
(a) has sufficient expertise and experience to be able to handle the
proposed contract.
Example of reference criterion:
(a) the candidate must have substantial experience working in the former
Soviet Union;
(b) experience working in central Asia will be an advantage;
(c) the candidate must have worked on at least one project involving
quality assurance in the education sector with a budget of EUR 100 000 or
more in within the last 3 years;
(d) Candidate must have a strong background in policy advice in the field
of education. If more than 8 eligible candidates meet the above selection
criteria, the relative strengths and weaknesses of the applications of
these candidates must be re-examined to identify the 8 best applications
for the tender procedure. The only factors which will be taken into
consideration during this re-examination are:
1) performance in previous EC contracts;
2) relative experience compared to other applicants;
3) significant involvement in major, international projects relevant to
this tender procedure during the past 3 years.
22. Award criteria: As specified in the tender dossier annexed to the
letter of invitation to tender which will be sent to shortlisted
candidates.

23. Deadline for receipt of applications: 28.11.2005 (16.00) local time,
Almaty.
Any application received after this deadline will not be considered.
24. Application format and details to be provided: Applications must be
submitted using the standard application form (available from the
following Internet address: http://europa.eu.int/comm/europeaid/
index_en.htm) whose format and instructions must be strictly observed.
Any application which does not observe these provisions will be
automatically eliminated. Any additional documentation (brochure, letter,
etc.) sent with an application will not be taken into consideration.
25. How applications may be submitted: Applications must be submitted in
English exclusively to the contracting authority:
either by recorded delivery (official postal service) to:

The contract title and the publication reference (see point 1 above) must
be clearly marked on the envelope containing the application and must
always be mentioned in all subsequent correspondence with the contracting
authority.
Applications submitted by any other means will not be considered.
26. Operational language: All written communications for this tender
procedure and contract must be in English.
