Libreville - Gabon Supplies contract notice 1. Publication reference: EuropeAid/122230/D/S/GA. 2. Procedure: Open. 3. Programme: European Development Fund (EDF). 4. Financing: Financing agreement: institutional support/strengthening of the DGEL's analytical capacities/support for the mining industry - CF 6590/GA. 5. Contracting authority: Monsieur le Ministre d'État, Ministre de la Planification et de la Programmation du Développement, EDF National Authorising Officer, Libreville - Gabon. Contract specifications: 6. Contract description: Under the contract the successful tenderer shall deliver the goods referred to hereafter to Libreville, install and commission them and provide training, maintenance and after-sales service for such goods. Delivery time: 6-12 weeks depending on the lot and weekly working hours. 7. Number and titles of lots: The equipment is split into the following 3 lots: lot 1, ICP-OES: plasma atomic emission spectrometer - 1; lot 2, ancillary AAS equipment: graphite oven - 1, hollow cathode lamp for Au, As, Hg, Cd, Pb - 1 lamp per element; lot 3, laboratory supplies: sand baths - 4, orbital shaker - 1, water demineralisation system - 1, extractor fans - 2, muffle furnace - 1, analytical balance - 1, compressed-air compressor - 1, zirconium crucibles - 50, PTFE beakers - 50, fusion machine - 1. Conditions for participation: 8. Eligibility and rules of origin: Participation in the contract is open, on equal terms, to all natural persons and legal entities from the European Union Member States and from the ACP countries and territories, irrespective of whether they are taking part as individuals or in a grouping (consortium) of tenderers (see also 21). All the goods supplied under this contract must originate in these countries. 9. Grounds for exclusion: Tenderers must furnish proof that they are not in any of the situations listed in Section 2.3.3 of the Practical Guide to contract procedures financed by the European Development Fund. 10. Number of tenders: Tenderers (including other companies considered in law to be part of the same group, other members of the same consortium and subcontractors) can submit 1 or more tenders for 1 or more lots. Tenders for part of a lot will not be considered. Tenderers may state in their tender whether they would grant a discount should they be awarded several lots. Tenderers cannot submit a variant tender in addition to their tender for the supplies required in the invitation to tender dossier. 11. Tender guarantee: When submitting their tender, tenderers must provide a tender guarantee for 2 % of the contract value. This will be returned to unsuccessful tenderers once the invitation to tender procedure has been completed and to successful tenderer(s) once the contract has been signed by all parties. This guarantee will be drawn on if the tenderer does not honour all the obligations stipulated in the invitation to tender. 12. Performance bond: The successful tenderer will be required to provide a performance bond for 10 % of the contract value when the contract is signed. The bond must be furnished within 30 days of the date on which the tenderer receives the contract signed by the contracting authority. If the successful tenderer does not furnish the bond within the time allowed, the contract will be rendered void and a new contract may then be drawn up and sent to the tenderer with the second most suitable compliant tender. 13. Briefing and/or site visit: There are no plans for a briefing. 14. Tender validity: Tenders are to be valid for 90 days from the final date for submission of tenders. 15. Time limits for completion: Completion deadlines are as follows, counting from the date on which the contract is signed by all parties: For lot 1: delivery: 12 weeks, installation and commissioning: 1 week after delivery, training: 1 week (at the latest) after installation and commissioning, after-sales service/maintenance: once per year for 3 years. For lot 2: delivery: 10 weeks, installation and commissioning: 1 week after delivery, training: 1 week (at the latest) after installation and commissioning, after-sales service/maintenance: once per year for 3 years. For lot 3: delivery: 6 weeks. Selection and award criteria: 16. Selection criteria: 16.1 Participation in the procedure is open, under the same conditions, to: - natural persons, companies, firms and public or semi-public agencies from the ACP countries or from the Member States, - cooperative companies and other entities governed by public or private law from the Member States and/or the ACP countries, - joint ventures, or groupings of companies or firms from the ACP countries and/or the Member States. 16.2 These conditions apply to all nationals of the aforementioned countries and all legal entities and companies formed and governed under civil, commercial or public law of these countries and whose registered office, administrative headquarters or main business activity is in said countries. A company or legal entity with a registered office in one of the aforementioned countries must pursue genuine and ongoing activities relating to that country's economy. Tenderers must furnish evidence as to their situation. 16.3 The aforementioned rules apply to: a) tenderers; b) members of groupings of companies; c) subcontractors. 16.4 Natural persons, companies or firms in any of the situations set out in section 2.3.3 of the Practical Guide to contract procedures financed by the 9th European Development Fund are disqualified from this procurement procedure. They risk, where applicable, exclusion from contracts and grants under the conditions set out in section 2.3.4 of the Guide. Furthermore, tenderers or candidates who have been guilty of misrepresentation will be fined an amount equal to 10 % of the total value of the contract being awarded. That rate may be increased to 20 % in the event of a repeat infringement within 5 years of the first one. 16.5 In order to take part, candidates must prove, to the satisfaction of the contracting authority, that they fulfil the requisite legal, technical and financial conditions and possess sufficient capacity and resources to fulfil the contract. 17. Award criteria: Tenderers from ACP countries whose tenders offer goods originating from ACP countries for at least 50 % of the value of the contract will be accorded a bonus of 15 % in comparison with tenders of equivalent technical and economic quality. Criteria for the award of the contract, to be applied to technically compliant tenders: tender price and, where proposals for after-sales service and/or training are required, the quality of such proposals. Moreover, if 2 tenders are deemed to be equally suitable, preference will be given to: (a) tenders submitted by tenderers from ACP countries, (b) or, failing this: - tenders making greatest use of physical or human resources from ACP countries, - tenders most likely to subcontract to natural persons, companies or firms from ACP countries, - tenders from consortia of natural persons, companies or firms from ACP countries or the European Union. It is also available from the contracting authority, at the address quoted hereafter. The standard tender form must be used to draw up tenders. This form can be found in the invitation to tender dossier, and its clauses and format must be strictly adhered to.
