Service contract notice for EDF
1. Publication reference: EuropeAid/121574/D/SV/KM.

This procedure has been launched with a suspension clause.
Contract award is conditional upon the financing agreement being signed.
5. Contracting authority: The awarding authority in the ACP beneficiary
country, namely the EDF National Authorising Officer in the Union of the
Comoros, Att: the Ministre d'État des Finances et du Budget, Moroni.
Contract specifications:
6. Object of the contract: Technical assistance contract.
7. Contract description: Technical assistance for two separate sections
of an education support programme worth EUR 16 000 000:
1) 2 technical assistants, resident in the country, for the project
management unit: namely, 1 principal technical assistant (48 man-months)
responsible for the operational aspects of programme implementation
(annual programme planning, preparing and following up invitations to
tender), and 1 technical assistant (24 man-months) to control the
administrative, contractual and financial aspects of implementation in
accordance with 9th EDF procedures (accountancy tracking and financial
monitoring in particular);
2) 1 technical assistant (12 man-months) to provide institutional support
in building up and reorganising the national Ministry of Education (i.e.
Union-wide) and the Ministries of Education on the autonomous islands so
as to define, introduce and oversee policy in the education sector. Said
person will be required for approximately 3 months per year, and will be
backed up by short-term experts (assignments totalling 5 man-months in
all) depending on the ministries' requirements.
8. Number and titles of lots: 1 lot.
9. Maximum available budget: EUR 1 500 000.
10. Any additional services: Additional services such as one-off studies
(factors involved in building capacity in ministries, for example) are
possible during the contract term if so required.
Conditions for participation:
11. Eligibility: Participation in the contract is open, on equal terms,
to:
- natural persons, companies, firms and public or semi-public agencies
from the ACP countries or from the Member States,
- cooperative companies and other entities governed by public or private
law from the Member States and/or the ACP countries,
- joint ventures, or groupings of companies or firms from the ACP
countries and/or the Member States.
The nationality rule also applies to experts put forward by service
provider companies.
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All
members of the consortium (i.e. lead company and all other partners) will
be jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, this will result in the application concerned being
automatically disqualified (in particular, the application from the whole
consortium where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application (this applies equally to all the legal entities
considered in law to be part of the same group), irrespective of the form
their participation may take (sole legal entity, or lead company or
partner in a consortium submitting an application). Should a natural
person or legal entity submit more than 1 application (this applies
equally to all the legal entities considered in law to be part of the
same group), then all the applications involving said party (and all the
legal entities considered in law to be part of the same group) will be
disqualified.
14. Prohibition on associations among shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted
procedure. Candidates invited to tender cannot form associations or
subcontractual relationships amongst themselves for the contract in
question.
15. Grounds for exclusion: In their application form candidates must
solemnly affirm that they are not in any of the situations referred to in
Section 2.3.3 of the Practical Guide to contract procedures financed by
the 9th EDF.
16. Subcontracting: No.
17. Number of candidates invited to tender: There must be at least 4,
but no more than 8, candidates on the shortlist.
Provisional schedule for activities:
18. Scheduled date for dispatch of invitations to tender: 8.9.2005.
19. Scheduled date for commencing activities: 2.1.2006.
20. Initial contract length, and possible extension: 48 months which may
be extended for a further 18 months. The figure of 48 months corresponds
to the longest service period required, that of the principal technical
assistant.
Selection and award criteria:
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
1) Candidates' economic and financial capacity:
a) average annual income for the past 2 years was in excess of EUR 900
000;
b) cash and cash equivalents at the beginning and end of the financial
year must be in surplus, overall.
2) Candidates' professional capacity:
a) at least 5 of the candidates' employees must be currently working in
fields connected with this contract;
b) at least 20 % of those employees working this year in fields connected
with this contract must be on permanent contracts with the candidates.
3) Candidates' technical capacity:
a) candidates must have satisfactorily delivered in the past 3 years on
at least 3 projects in fields connected with this contract, where the
budget was equivalent to or exceeded EUR 500 000.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these
candidates' applications will need to be re-examined to determine which 8
applications for the invitation to tender are the most suitable. Only the
following factor will be considered in the re-examination:
1) candidates have provided technical assistance during the past 3 years
to projects financed from the European Development Fund in fields
connected with this contract.
22. Award criteria: The criteria are specified in the invitation to
tender dossier appended to the letter of invitation to tender which will
be sent to shortlisted candidates.
Application submission procedures:
23. Final date for submission of applications: 10.8.2005 (15.00).
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied:
The standard application form must be used for applications. This form is
available from the following Web address:

of this form must be strictly adhered to.
Any application which fails to comply with these provisions will be
automatically rejected. Additional documentation (brochure, letter, etc.)
enclosed with the application will not be considered.
25. Procedures for dispatch of applications: Applications must be sent
to the contracting authority, and no other:
- either by registered post (official postal service), to the following
address:

- or by bearer (express courier services in particular) with the
application being delivered straight to the contracting authority, in

The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the application and must be

L'attribution du marché est conditionnée à la signature de la convention
de financement.
5. Autorité contractante: Le maître d'ouvrage de l'État ACP
bénéficiaire, soit l'Ordonnateur national du FED de l'Union des Comores,
Att: le Ministre d'État des finances et du budget, Moroni.
Spécifications du marché
6. Objet du marché: Marché d'assistance technique.
7. Description du marché: Mobilisation d'une assistance technique pour
deux volets distincts d'un programme d'appui à l'éducation de 16 000 000
EUR:
1) deux assistants techniques résidents pour la Cellule de gestion du
projet: 1) un assistant technique principal (48 h/mois) responsable des
aspects opérationnels de la mise en oeuvre du programme (programmation
annuelle, préparation et suivi des appels d'offres) et 2) un assistant
technique (24 h/mois) maîtrisant les aspects administratifs, contractuels
et financiers de la mise en oeuvre selon les procédures du 9ème FED (en
particulier suivi comptable et financier);
2) un assistant technique (12 h/mois) pour un appui institutionnel pour
le renforcement et la réorganisation du Ministère de l'éducation
nationale (au niveau de l'Union) et des Ministères de l'éducation des
Îles autonomes pour définir, mettre en oeuvre et effectuer le suivi de la
politique sectorielle de l'éducation. Il sera mobilisé à raison de trois
mois environ par an et sera soutenu par des experts court terme (missions
de 5 h/mois au total) selon les besoins des ministères.
8. Nombre et intitulé des lots: Un lot.
9. Budget maximal disponible: 1 500 000 EUR.
10. Prestations additionnelles éventuelles: En cours d'exécution du
contrat, et en fonction des besoins, des prestations supplémentaires
telles que des études ponctuelles (par exemple, sur des aspects relatifs
au renforcement des capacités des ministères) pourraient être incluses
dans le présent contrat.
Conditions de participation
11. Éligibilité: La participation au marché est ouverte à égalité de
conditions:
- aux personnes physiques, sociétés ou entreprises, organismes publics ou
à participation publique des États ACP et des États membres,
- aux sociétés coopératives et autres personnes de droit public ou de
droit privé des États membres et/ou des États ACP, et
- à toute entreprise commune ou groupement d'entreprises ou de sociétés
des États ACP et/ou des États membres.
Cette règle de la nationalité s'applique également aux experts proposés
par les sociétés prestataires de services.
12. Candidature: Toute personne physique ou morale éligible (au sens du
point 11 ci-dessus) ou groupement de ces personnes (consortium) peut
soumettre sa candidature.
Un consortium peut être un groupement permanent doté d'un statut
juridique ou un groupement informel créé aux fins d'un appel d'offres
spécifique. Tous les membres d'un consortium (c'est-à-dire, le chef de
file et tous les autres partenaires) sont conjointement et solidairement
responsables devant l'autorité contractante.
La participation d'une personne physique ou morale inéligible (au sens du
point 11) entraînera l'élimination automatique de la candidature
concernée (notamment, de la candidature de l'ensemble du consortium, dans
le cas où cette personne ferait partie d'un consortium).
13. Nombre de candidatures: Une personne physique ou morale ne peut
soumettre plus d'une candidature (cela vaut également pour toutes les
personnes morales faisant partie du même groupe du point de vue du
droit), quelle que soit la forme de sa participation (comme entité
juridique individuelle ou comme chef de file ou partenaire d'un
consortium présentant une candidature). Dans le cas où une personne
physique ou morale soumettrait plus d'une candidature (cela vaut
également pour toutes les personnes morales faisant partie d'un même
groupe du point de vue du droit), toutes les candidatures auxquelles
cette personne participe (et toutes les personnes morales faisant partie
du même groupe du point de vue du droit) seront éliminées.
14. Interdiction des alliances entre des candidats retenus sur la liste
restreinte: Toute offre reçue de la part de soumissionnaires comprenant
des sociétés autres que celles mentionnées sur les formulaires de
candidature ayant servi à l'établissement de la liste restreinte sera
éliminée de la présente procédure restreinte. Les candidats invités à
soumissionner ne peuvent ni s'associer entre eux ni établir des relations
subcontractuelles concernant le marché en question.
15. Situations d'exclusion: Dans le formulaire de candidature, les
candidats doivent attester sur l'honneur qu'ils ne se trouvent dans
aucune des situations visées au point 2.3.3 du Guide pratique pour les
procédures contractuelles financées par le 9ème FED.
16. Possibilités de sous-traitance: Non.
17. Nombre de candidats invités à soumissionner: Le nombre de candidats
devant composer une liste restreinte est de 4 au minimum et de 8 au
maximum.
Calendrier prévisionnel des opérations
18. Date prévue d'envoi des invitations à soumissionner: 8.9.2005.
19. Date prévue de commencement de l'action: 2.1.2006.
20. Durée initiale du marché et prorogation éventuelle: 48 mois sur la
base de la plus longue prestation (soit celle de l'assistant technique
principal, 48 h/m), avec une possibilité de prolonger le contrat pour une
durée de 18 mois.
Critères de sélection et d'attribution
21. Critères de sélection: Les critères de sélection suivants seront
appliqués aux candidats. Dans le cas où les candidatures seraient
soumises par un consortium, ces critères de sélection s'appliqueront au
consortium dans son ensemble:
1) Capacité économique et financière du/des candidat:
a) le revenu annuel moyen des 2 dernières années doit être supérieur à
900 000 EUR; et
b) la trésorerie et les équivalents de trésorerie de début et de fin
d'exercice sont, globalement, excédentaires.
2) Capacité professionnelle du candidat:
a) au moins 5 personnes faisant partie des effectifs du candidat
travaillent actuellement dans des domaines en rapport avec le présent
marché; et
b) au moins 20 % de l'ensemble des effectifs du candidat travaillant
cette année dans des domaines en rapport avec le présent marché sont
permanents.
3) Capacité technique du candidat:
a) le candidat a obtenu de bons résultats, au cours des 3 dernières
années, pour au moins 3 projets au budget au moins équivalent à 500 000
EUR et dans des domaines en rapport avec le présent marché.
Si le nombre de candidatures éligibles satisfaisant à l'ensemble des
critères de sélection est supérieur à 8, les atouts et faiblesses des
applications de ses candidats doivent être réexaminées pour identifier
les 8 meilleures candidatures pour l'appel d'offres. Les seuls éléments
qui seront pris en considération dans ce réexamen sont les suivants:
1) le candidat a fourni une assistance technique dans des projets
financés sous le Fonds européen de développement dans des domaines en
rapport avec le présent marché au cours des 3 dernières années.
22. Critères d'attribution: Ces critères sont précisés dans le dossier
d'appel d'offres annexé à la lettre d'invitation à soumissionner qui sera
envoyée aux candidats retenus sur la liste restreinte.
Constitution de la candidature
23. Date limite de remise des candidatures: 10.8.2005 à 15.00.
Toute candidature reçue après la date limite sera écartée.
24. Modalités de présentation des candidatures et renseignements à
fournir: Les candidatures doivent être rédigées uniquement au moyen du
formulaire de candidature standard (disponible à l'adresse Internet
suivante: http://europa.eu.int/comm/europeaid/index_fr.htm) les
dispositions et le modèle doivent être strictement respectés.
Toute candidature qui n'observe pas ces dispositions sera automatiquement
